The high current and forecast budget deficits as well as pay-as-you-go (PAYGO) procedures have resulted in congressional and executive branch interest in raising additional revenue through proposals for improved tax compliance. The Bush Administration’s FY2009 budget includes a proposal (the proposal) to require each payment card processor to inform the IRS on the net dollar amount paid to reimburse each merchant (i.e., seller) for his payment card receipts in a calendar year. Payment cards consist of both credit cards and debit cards. This report examines the proposal by describing current law, presenting the proposal contained in the FY2009 budget, describing the structure of the payment card industry, analyzing the justifications for the proposal, explaining the criticisms of the proposal, and offering concluding observations.

It is most often invoked after conviction and the exhaustion of the ordinary means of appeal. It is at once the last refuge of scoundrels and the last hope of the innocent. It is an intricate weave of statute and case law whose reach has flowed and ebbed over time.

The purpose of this report is to provide background for and summarize current developments in U.S. - People’s Republic of China (PRC) relations, including current and pending congressional actions involving the PRC.

The Future Combat System (FCS) is the U.S. Army’s multiyear, multibillion dollar program at the heart of the Army’s transformation efforts. The FCS program exists in a dynamic national security environment which could significantly influence the program’s outcome. The FCS is experiencing a number of program development issues - with some technologies advancing quicker than anticipated, others progressing along predicted lines, while still others not meeting the Army’s expectations. Congress, in its authorization, appropriation, and oversight roles may wish to review the FCS program in terms of its capabilities and program costs.

In 1971, Congress passed legislation to repeal the Emergency Detention Act of 1950 and to enact the following language: “No citizen shall be imprisoned or otherwise detained by the United States except pursuant to an Act of Congress.” The new language, codified at 18 U.S.C. §4001(a), is called the Non-Detention Act. This statutory provision received attention after the 9/11 terrorist attacks when the Administration designated certain U.S. citizens as “enemy combatants” and claimed the right to detain them indefinitely without charging them, bringing them to trial, or giving them access to counsel. In litigation over Yaser Esam Hamdi and Jose Padilla, both designated enemy combatants, the Administration has argued that the Non-Detention Act restricts only imprisonments and detentions by the Attorney General, not by the President or military authorities.

This report briefly describes the three categories of federal programs for wildfire protection: [1] protection of the federal lands managed by the U.S. Department of Agriculture, Forest Service (FS), and by the U.S. Department of the Interior, whose wildfire programs are coordinated by the Bureau of Land Management (BLM); [2] assistance for state and local governments and communities in protecting nonfederal lands; [3] support for fire research, fire facilities, and improvements in forest health. This report examines various issues pertaining to foreign students in the United States. Since the Immigration Act of 1924, the United States has expressly permitted foreign students to study in U.S. institutions. Most foreign students are at least 18 years old and are enrolled in higher education programs. Foreign students are generally considered to enrich cultural diversity of the educational experience for U.S. residents as well as enhance the reputation of U.S. universities as world-class institutions. Concerns have arisen in recent years that have caused Congress to take a new look at the Immigration and Nationality Act (INA) provisions that govern their admission.
