Electricity Restructuring and the Constitutionality of Retail Reciprocity Requirements

Retail reciprocity requirements have been included in the electricity restructuring legislation of at least four states. These requirements mandate generally that out-of-state utilities which operate in a state “closed” to retail competition cannot market power to retail consumers in the “open” state. Because state reciprocity requirements enacted without congressional authorization are probably unconstitutional under the Commerce Clause of the U.S. Constitution, Congress would have to include a reciprocity provision in federal electricity restructuring legislation if it wants to support the view that such a provision will increase competition. This report reviews the treatment of state reciprocity requirements by the U.S. Supreme Court and discusses Congress’ power under the Commerce Clause.

European Views and Policies Toward the Middle East

Managing policy differences on a range of issues emanating from the Middle East poses serious challenges for the United States and its European allies and friends. The most vitriolic dispute has centered on the conflict in Iraq. However, divisions over how best to approach the ongoing Israeli-Palestinian conflict, manage Iran and Syria, and combat terrorism also persist. How deep and lasting the clash over Iraq and subsequent Middle East policies will be to transatlantic relations will likely depend on several factors, including whether Washington and European capitals can cooperate more robustly to rebuild Iraq; whether Europeans perceive a renewed U.S. commitment to revive the Middle East peace process; and whether differences over Mideast issues spill over into NATO or impede EU efforts to forge a deeper Union.

The Endangered Species Act and Claims of Property Rights "Takings"

This report first outlines the ESA provisions most relevant to the act’s impacts on private property, and then surveys the major ESA-relevant principles of Fifth Amendment takings law. The report then proceeds to its core topic: the court decisions adjudicating whether government measures based on the ESA effect a taking of property under the Fifth Amendment. The cases address four kinds of ESA measures: (1) restrictions on land uses that might adversely affect species listed as endangered or threatened; (2) reductions in water delivery to preserve lake levels or instream flows needed by listed fish; (3) restrictions on the defensive measures a property owner may take to protect his/her property from listed animals; and (4) restrictions on commercial dealings in members of listed species.

The United Arab Emirates (UAE): Issues for U.S. Policy

The United Arab Emirates (UAE) has undergone a major leadership transition over the past year after the deaths of the leaders of the two main emirates, and it is beginning to undertake political reform. Its relatively open economy and borders have produced social tolerance and political stability but have also contributed to proliferation, terrorist transiting, and human trafficking, particularly in the emirate of Dubai. Since March 2005, the United States and UAE have been negotiating a free trade agreement (FTA), although the outcome of it and other relations with the United States might be affected by the outcome of the U.S.debate over whether to permit a Dubai-owned port operations company to take over management of six major U.S. ports. The ADA definition is a functional one and does not list specific disabilities. This report discusses the definition of "disability." It also briefly discusses the Supreme Court's opinions and analyze how the lower courts are interpreting the Supreme Court's holdings.
