Environmental Reauthorizations and Regulatory Reform: From the 104th Congress to the 106th
The 104th Congress pursued efforts to reform environmental regulations on several fronts: (1) revising regulatory decision making processes; (2) attaching specific reforms to funding bills; (3) establishing a House corrections day calendar of bills addressing specific regulatory problems; and (4) incorporating regulatory reforms into individual program reauthorization bills. The 105th Congress has pursued regulatory reform in four primary directions: (1) proposals to establish a comprehensive cost-benefit/risk analysis framework for regulatory programs, (2) private property “takings” initiatives, (3) amendments and reforms directed at individual environmental statutes, and (4) oversight of environmental programs.

The Passenger Service Act, Domestic Ocean Passenger Services, and the 106th Congress
The Passenger Service Act (PSA) requires that domestic ocean passenger transportation be provided only by ships that are U.S.-owned, U.S.-built and operated by U.S. crews. Proposed legislation to relax some PSA restrictions was introduced during the 105th Congress. Both the Chairman of the Senate Commerce Committee and the Chairman of the House Transportation and Infrastructure Committee, Subcommittee on the Coast Guard and Maritime Transportation, have made recent public statements indicating their strong interets enacting changes to the passenger Service Act during the 106th Congress. This report will be updated as developments warrant.

The Harbor Maintenance Tax and the 106th Congress
Prior to 1986, general funds of the U.S. treasury were used to pay 65% of the cost to operate ocean and inland ports and to maintain and deepen their channels. The other 35 percent is paid by ports, or by state or local governments. In 1986, Congress enacted the Harbor Maintenance Tax and used the revenues to provide some of the funds for what has come to be considered the federal portion of such costs

Campaign Finance Bills in the 106th Congress: Comparison of Shays-Meehan, as passed, with McCain-Feingold, as considered
On September 14, 1999, the House passed the Shays-Meehan bill--H.R. 417, the Bipartisan Campaign Finance Reform Act of 1999, as amended, by a vote of 252-177. Senate sponsors of the companion measure, S. 26 (McCain-Feingold), revised their proposal and, on September 16, introduced S. 1593, containing just four sections of H.R. 417 and S. 26. The Senate debated S. 1593 from October 13-20, culminating in unsuccessful cloture votes October 19 on two amendments: Daschle amendment 2298, substituting text nearly identical to the House-passed H.R. 417; and Reid amendment 2229 (a perfecting amendment to no. 2298), substituting text of S. 1593 as offered, plus McCain amendment 2294 (adopted October 14), which added certain disclosure requirements. This report compares provisions of the House-passed bill with the one considered by the Senate in October 1999. No further updates are planned.

Campaign Finance Debate in the 106th Congress: Comparison of Measures Under House Consideration
On September 14, the House passed H.R. 417 on a vote of 252-177, as amended by three perfecting amendments: Bereuter/Wicker #6; Faleomavaega #1; and Sweeney #21. This report features two tables. Bills introduced in the 106th Congress would have raised the limit on contributions to individualretirement accounts(IRAs) and eased other federal IRA rules. The House passed H.R. 5203, incorporating the higher IRA contribution limits of H.R.1102, on September 19, 2000. The IRA provisions of the bill would have cost $21.7 billion in foregone revenue over 10 years. The Senate Finance Committee ordered H.R. 1102 reported (with amendments) on September 7, 2000, but the bill did not reach the Senate floor before the 106th Congress adjourned in December 2000. The Finance Committee’s bill, in addition to raising contribution limits, would have allowed tax credits in lieu of deductions for a portion of IRA contributions.

Cuba: Issues and Legislation in the 106th Congress
Numerous measures were introduced in the 106th Congress that reflected the range of views on U.S. policy toward Cuba. Legislative initiatives proposed both easing and increasing sanctions against Cuba. In the end, legislation passed reflected both approaches: it allowed the export of food and medicine to Cuba, but prohibited any U.S. financing, both public and private, of such exports. Travel to Cuba for tourism was also prohibited.

Federal Mandatory Minimum Sentencing Statutes: An Overview of Legislation in the 106th Congress
This report discusses federal mandatory minimum sentencing statutes, which demand that execution or incarceration follow criminal conviction. They cover drug dealing, murdering federal officials, and using a gun to commit a federal crime. They circumscribe judicial sentencing discretion. The Individuals with Disabilities Education Act: Discipline Legislation in the 106th Congress
Although Congress described its 1997 changes to discipline provisions in the Individuals withDisabilitiesEducationAct (IDEA) as a “carefulbalance,” it was not long before amendmentsto change the provisionssurfaced. In 1999 the Senate passed S. 254, 106th Cong., the Violent and Repeat Juvenile Accountability and Rehabilitation Act of 1999, and the House passed H.R. 1501, 106th Cong., the Child Safety and Protection Act, both of which contained amendments to IDEA. These amendments would have changed section 615 of IDEA to eliminate IDEA’s different disciplinary procedures for children with disabilities in certain situations. In the Senate the amendment applied to children with disabilities who carry a gun or firearm while in the House the amendment would cover a weapon. These amendments were not enacted.
