Farm Economic Relief: Issues and Options for Congress

In response to low prices, natural disasters, and other farm-related problems, Congress has, over 3 successive years, provided a total of about $23 billion in supplemental aid – in addition to funds already programmed through the 1996 farm bill (P.L. 104-127). The most recent aid was attached to a crop insurance reform bill signed into law on June 22, 2000 (P.L. 106-224). This Agriculture Risk Protection Act of 2000 includes $7.113 billion for additional farm income and related assistance, of which $5.5 billion is to be spent in FY2000.

This report discusses "Section 32", which is a permanent appropriation that since 1935 has earmarked the equivalent of 30% of annual customs receipts to support the farm sector through a variety of activities. The first gives a brief history of the protection of the flag issue from the enactment of the Flag Protection Act in 1968 until the present consideration of an amendment to the Constitution in the 106th Congress. The second part briefly summarizes the two decisions of the United States Supreme Court, Texas v. Johnson and United States v. Eichmann, which struck down the state and federal flag protection statutes as applied in the context punishing expressive conduct.

Vacancies in Congress occur due to the death, resignation, or declination (refusal to serve) of a Senator or Representative, or as the result of expulsion or exclusion by either house. The Constitution requires that vacancies in both houses be filled by special election, but in the case of the Senate, it empowers state legislatures to provide for temporary appointments by the state governor until special elections can be scheduled. This report describes this process.

The Marine Protection, Research and Sanctuaries Act has two basic aims: to regulate international ocean disposal of materials, into authorized related research. Permit and enforcement provisions of the law are often referred to as the Ocean Dumping Act. The basic provisions of the act have remained virtually unchanged since 1972, when it was enacted to establish a comprehensive waste management system to regulate disposal or dumping of all materials into marine waters that are within U.S. jurisdiction, although a number of new authorities have been added. This report represents a summary of the law, describing the essence of the statute.

Free Trade Agreements and the WTO Exceptions

World Trade Organization (WTO) Members must grant immediate and unconditional most-favored-nation (MFN) treatment to the products of other Members with respect to tariffs and other trade matters. Free trade agreements (FTA) are facially inconsistent with this obligation because they grant countries who are party to the agreement the ability to receive more favorable trade benefits than those extended to other trading partners. Due to the prevailing view that such arrangements are trade enhancing, Article XXIV of the General Agreement on Tariffs and Trade (GATT) contains a specific exception for FTAs. The growing number of regional trade agreements, however, has made it difficult for the WTO to efficiently monitor the consistency of FTAs with the provided exemption. This report examines this issue.

On May 1, 2004, 10 states joined the European Union (EU), enlarging the Union to 25 members. The EU views the enlargement process as an historic opportunity to promote stability in Europe and further the integration of the continent by peaceful means. In addition to the 10 new members (Cyprus, the Czech Republic, Estonia, Hungary, Latvia, Lithuania, Malta, Poland, Slovakia, and Slovenia), three other states — Bulgaria, Romania, and Croatia — hope to accede to the EU by 2007. Turkey is also a candidate and is expected to begin accession negotiations in 2005. Macedonia has also applied for EU membership.
