Border Patrol: Goals and Measures Not Yet in Place to Inform Border Security Status and Resource Needs

Testimony issued by the Government Accountability Office with an abstract that begins "Since fiscal year 2011, the Department of Homeland Security (DHS) has used changes in the number of apprehensions on the southwest border between ports of entry as an interim measure for border security as reported in its annual performance plans. In fiscal year 2011, DHS reported a decrease in apprehensions, which met its goal to secure the southwest border. Our analysis of Border Patrol data showed that apprehensions decreased within each southwest border sector from fiscal years 2006 to 2011, generally mirroring decreases in estimated known illegal entries. Border Patrol attributed these decreases in part to changes in the U.S. economy and improved enforcement efforts. In addition to apprehension data, sector management collect and use other data to assess enforcement efforts within sectors. Our analysis of these data show that the percentage of estimated known illegal entrants apprehended from fiscal years 2006 to 2011 varied across southwest border sectors; in the Tucson sector, for example, there was little change in the percentage of estimated known illegal entrants apprehended over this time period. CBP's $724 million program intends to modernize the functionality, data, and aging infrastructure of legacy TECS and move it to DHS's data centers by 2016. To date, CBP has deployed functionality to improve its secondary inspection processes to air and sea ports of entry and, more recently, to land ports of entry in 2013. However, CBP is in the process of revising its schedule baseline for the second time in under a year. For example, most of them obligated less than $500 million each in fiscal year 2012, while the largest program, Head Start, obligated approximately $8 billion in that year. FMCSA, whose primary mission is to reduce commercial motor vehicle-related crashes, fatalities and injuries, has made progress on CSA but needs to complete both implementation throughout all states and a Carrier Safety Fitness Determination rulemaking before CSA is fully implemented. CSA represents a different, more data-driven approach to motor carrier safety. Under CSA, which introduces a new system for identifying and responding to carrier safety risks, FMCSA intends to increase the number of carriers it evaluates and reduce crashes involving commercial vehicles. In light of delays in implementing CSA, Congress is concerned about FMCSA's ability to implement the program and directed GAO to monitor the program's implementation and review FMCSA's capacity to meet milestones within its planned cost estimates. To achieve that goal, the U.S. assistance strategy has for years included both a security element focused on counterterrorism activities and a civilian element focused on development activities. In 2009, in response to the increasing economic, social, and political challenges facing Yemen, the U.S. government undertook a comprehensive review of its policy toward Yemen. This review led to a whole-of-government strategy that still includes both security and civilian assistance, but that, according to U.S. officials, is more integrated than in prior years. The strategy seeks to simultaneously address security needs as well as the underlying economic, social, and political grievances that can lead to violent extremism. U.S. officials told us that assistance activities under this strategy have had to adjust to the changing security situation on the ground. Testimony issued by the Government Accountability Office with an abstract that begins "GAO identified 56 contracts and task orders that were active during fiscal year 2010 and the first three quarters of fiscal year 2011 under which contracting offices obligated roughly $35.2 million on Arlington’s behalf. These contracts supported cemetery operations, construction and facility maintenance, and new efforts to enhance information-technology systems for the automation of burial operations. The Army has taken a number of steps since June 2010 at different levels to provide for more effective management and oversight of contracts, establishing new support relationships, formalizing policies and procedures, and increasing the use of dedicated contracting staff to manage and improve its acquisition processes. However, GAO found that ANCP does not maintain complete data on its contracts, responsibilities for contracting support are not yet fully defined, and dedicated contract staffing arrangements still need to be determined. The success of Arlington’s acquisition outcomes will depend on continued management focus from ANCP and its contracting partners to ensure sustained attention to contract management and institutionalize progress made to date. A statement of record issued by the Government Accountability Office with an abstract that begins "Several agencies have key roles and responsibilities in the multi-phased personnel security clearance process, including the Director of National Intelligence (DNI) who, as the Security Executive Agent, is responsible for developing policies and procedures related to security clearance investigations and adjudications, among other things. The Deputy Director for Management at the Office of Management and Budget chairs the Performance Accountability Council that oversees reform efforts to enhance the personnel security process. The security process includes: the determination of whether a position requires a clearance, application submission, investigation, and adjudication. Specifically, agency officials must first determine whether a federal civilian position requires access to classified information. After an individual has been selected for a position that requires a personnel security clearance and the individual submits an application for a clearance, investigators—often contractors—from the Office of Personnel Management (OPM) conduct background investigations for most executive branch agencies. Adjudicators from requesting agencies use the information from these investigations and federal adjudicative guidelines to determine whether an applicant is eligible for a clearance. Further, individuals are subject to reinvestigations at intervals based on the level of security clearance."

Two separate BJA grant programs provide funding to state and local law enforcement to facilitate their body armor purchases. The BVP program offers 2-year grants on a reimbursable, matching basis to state and local law enforcement agencies to assist in their purchasing of ballistic-resistant and stab-resistant body armor. Generally, the JAG program provides 4-year grant money up front that can be used to fund body armor procurement along with other criminal justice activities. Since the BVP program’s inception in 1999, it has reimbursed grantees $247 million for their purchases of nearly 1 million vests. The JAG program has provided nearly $4 billion from fiscal years 2006 through 2011, but BJA does not know how much of this amount grantees have spent on body armor because it is not required to track expenditures for specific purposes. Further complicating agencies’ ability to identify and address duplicative investments is miscategorization of investments within agencies. Each of the agencies has recently initiated plans to address many of these investments. DHS’s efforts have resulted in the identification and elimination of duplication, but DOD’s and DOE’s initiatives have not yet led to the elimination or consolidation of duplicative investments or functionality. Until DOD and DOE demonstrate progress on their efforts to identify and eliminate duplicative investments, and correctly categorize investments, it will remain unclear whether they are avoiding investment in unnecessary systems. Each of the agencies we reviewed has IT investment management processes in place that are, in part, intended to prevent, identify, and eliminate unnecessary duplicative investments. Even with such investment review processes, of the 810 investments we reviewed,we identified 37 potentially duplicative investments at DOD and DOE within three FEA categories (Human Resource Management, Information and Technology Management, and Supply Chain Management)."

This deficiency may be more critical today than 3 years ago because current budget constraints make prioritization essential. Since the publication of our report in 2009, the number of high-containment laboratories has increased. Although modern high-containment technologies (for example, high-efficiency particulate air [HEPA] filtration) in conjunction with laboratory design have been effective in reducing the level of risk, there is nevertheless some degree of risk associated with design, construction, operations, and maintenance of high-containment laboratories. This was realized following a Centers for Disease Control and Prevention (CDC) power failure incident in Atlanta, Georgia, where no biological agent was released but that showed the difficulties in maintaining biological containment, and a leaky pipe incident in Pirbright, United Kingdom, that failed to maintain biological containment. Increasing the number of laboratories also increases the aggregate national risk."

Correspondence issued by the Government Accountability Office with an abstract that begins "According to the Centers for Disease Control and Prevention (CDC), pathogens such as Salmonella, E. coli, and Listeria cause an estimated 14 million cases of foodborne illnesses each year, resulting in about 60,000 hospitalizations and 1,800 deaths. Foodborne illness symptoms can range from mild gastroenteritis to life-threatening renal syndromes. The populations most susceptible to the more serious symptoms include very young children, individuals 60 years and older, pregnant women, and people who have a weakened immune system. In 2007, about 20 to 25 percent of the U.S. population was in this high-risk category. Moreover, consumers' vulnerability to foodborne illness is increasing as a result of changes in demographics, among other things. For example, older Americans will make up an estimated 20 percent of the U.S. population by 2015. The pathogens that account for much of the most severe foodborne illness can be greatly reduced by subjecting food to ionizing radiation, also known as food irradiation. The Departments of Commerce (Commerce), Housing and Urban Development (HUD), and Agriculture (USDA); the Small Business Administration (SBA); and the Office of Management and Budget (OMB) have taken steps to collaborate more in administering these programs in response to a recommendation in GAO's August 2012 report. For example, OMB has established a Cross-Agency Priority goal for entrepreneurship and small business and an associated interagency working group. However, the four agencies have not implemented a number of good collaborative practices GAO has identified, such as establishing compatible policies and procedures to better support rural businesses. Correspondence issued by the Government Accountability Office with an abstract that begins "The Medicare Part D program, administered by the Department of Health and Human Services' (HHS) Centers for Medicare & Medicaid Services (CMS), provides a voluntary, outpatient prescription drug benefit for eligible individuals 65 years and older and eligible individuals with disabilities. CMS contracts with private companies--such as health insurance companies and companies that manage pharmacy benefits--to provide Part D prescription drug plans for Medicare beneficiaries. These companies are referred to as Part D sponsors. About 27 million individuals were enrolled in Medicare Part D as of December 2009, and estimated Medicare Part D spending was $51 billion in fiscal year 2009. Because of Medicare's vulnerability to fraud, waste, and abuse, GAO has designated Medicare as a high-risk program. We and HHS's Inspector General have previously reported that the size, nature, and complexity of the Part D program make it a particular risk for fraud, waste, and abuse. As discussed in our report, SBA had completed one of the seven LMAS-Incremental Improvement Projects (IIPs) and awarded contracts for work on three others as of October 2011.
