The Federal Role in Rail Transit Safety
On June 22, 2009, two transit trains in Washington, DC, collided, resulting in nine deaths and dozens of injuries. It was the worst crash in the history of the Washington Metropolitan Area Transit Authority's rail transit system. This crash has raised questions about the safety of rail transit and the government's role in ensuring that safety. Nationwide, rail transit is considered one of the safest modes of transportation. This report discusses the State Safety Oversight Program, which went into effect in 1997 and mandates that states are responsible for the safety of the rail transit systems within their borders. This report also explores several issues that Federal Transit Administration (FTA) representatives have discussed in regards to improving the Safety Oversight Program.

Leave Benefits in the United States
This report begins by reviewing the federal statutes that pertain directly or indirectly to employer provision of leave benefits for any purpose, including a discussion of the California and New Jersey family leave insurance programs. The Security and Prosperity Partnership of North America (SPP) is a trilateral initiative that was launched in March 2005 for the purpose of increasing and enhancing security and prosperity in the United States, Canada, and Mexico. Navy Nuclear Aircraft Carrier (CVN) Homeporting at Mayport: Background and Issues for Congress
On January 14, 2009, the Navy announced that it wants to transfer one of its nuclear-powered aircraft carriers (CVNs) to the Navy home port at Mayport, FL, known formally as Naval Station (NAVSTA) Mayport. The Navy's proposed FY2010 budget requests $46.3 million in Military Construction (MilCon) funding for channel dredging at Mayport. The Navy states that a key reason it wants to transfer a CVN to Mayport is to hedge against the risk of a catastrophic event that could damage the Navy's CVN homeporting facilities at Norfolk, VA, and nearby Newport News, VA. This report discusses potential questions for Congress to consider related to budget appropriations for such a transfer, the potential negative economic effects that a CVN transfer would have on the local homeport, and the other general questions regarding the Navy.

Alert Systems for Missing Adults in Eleven States: Background and Issues for Congress
This report discusses the emerging development of nationwide alert systems to recover missing adults, such as those with mental impairment (such as Alzheimer's disease), developmental disabilities, or suicidal tendencies. This report provides an overview of such alert systems in 11 states: Colorado, Delaware, Florida, Georgia, Kentucky, North Carolina, Ohio, Oklahoma, Rhode Island, Texas, and Virginia. This report also provides a discussion of issues for Congress to consider with respect to the federal role, if any, in developing state alert programs for missing adults.

Assistance to Firefighters Program: Distribution of Fire Grant Funding
The Assistance to Firefighters Grant (AFG) Program, also known as fire grants or the FIRE Act grant program, was established by the FY2001 National Defense Authorization Act. The fire grant program is now in its ninth year. Over $4.8 billion has been appropriated to the fire grant program since FY2001. This report discusses the inception of this program, as well as current supplemental legislation and proposed funding, which is already projected to provoke negative criticism from the fire community for being inadequate.

America COMPETES Act: Programs, Funding, and Selected Issues

Access to Government Information in the United States
The U.S. Constitution makes no specific allowance for any one of the three branches of the federal government to have access to information held by the others. No provision in the U.S. Constitution expressly establishes a procedure for public access to government information. Congress has legislated various public access laws. Among these laws are two records access statutes, The Freedom of Information Act, the Privacy Act, and two meetings access statutes, the Federal Advisory Committee Act, and the Government in the Sunshine Act. This report offers an overview of the four information access laws noted above, and provides citations to additional resources related to these tools.

Flag Protection: A Brief History and Summary of Recent Supreme Court Decisions and Proposed Constitutional Amendments
Many Members of Congress see continued tension between "free speech" decisions of the Supreme Court, which protect flag desecration as expressive conduct under the First Amendment, and the symbolic importance of the United States flag. This report is divided into two parts. The first gives a brief history of the flag protection issue, from the enactment of the Flag Protection Act in 1968 through current consideration of a constitutional amendment. The second part briefly summarizes the two decisions of the United States Supreme Court, Texas v. Johnson and United States v. Eichman, that struck down the state and federal flag protection statutes as applied in the context punishing expressive conduct.

Federal Tort Claims Act
The Federal Tort Claims Act is the statute by which the United States authorizes tort suits to be brought against itself. With exceptions, it makes the United States liable for injuries caused by the negligent or wrongful act or omission of any federal employee acting within the scope of his employment, in accordance with the law of the state where the act or omission occurred. This report discusses, among other things, the application of the Feres doctrine to suits for injuries caused by medical malpractice in the military, the prohibition of suits by victims of atomic testing, Supreme Court cases interpreting the discretionary function exception, the extent to which federal employees may be held liable for torts they commit in the scope of their employment, and the government contractor defense to products liability design defect suits.

Freedom of Speech and Press: Exceptions to the First Amendment
This report provides an overview of the major exceptions to the First Amendment - of the ways that the Supreme Court has interpreted the guarantee of freedom of speech and press to provide no protection or only limited protection for some types of speech. For example, the Court has decided that the First Amendment provides no protection to obscenity, child pornography, or speech that constitutes "advocacy of the use of force or of law violation ... where such advocacy is directed to inciting or producing imminent lawless action and is likely to incite or produce such action."
