Clean Water: Further Implementation and Better Cost Data Needed to Determine Impact of EPA's Storm Water Program on Communities

A letter report issued by the Government Accountability Office with an abstract that begins "Urban storm water runoff is a major contributor to the nation's degraded waters. Under the Clean Water Act, the Environmental Protection Agency (EPA) established a program requiring communities to obtain permits and implement activities to control storm water pollution. EPA's Phase I regulations (1990) applied to communities with populations of 100,000 or more, and its Phase II regulations (1999) covered smaller urban communities. Communities must report progress in meeting permit requirements. Some have raised concerns that storm water requirements impose an undue burden. To evaluate storm water program costs, EPA developed estimates for both phases. GAO was asked to (1) determine the progress in implementing the storm water program, (2) evaluate the extent to which the program burdens communities, (3) examine the accuracy of EPA's cost estimates, and (4) examine the data available for assessing program burden. GAO collected data for all states and a sample of 130 communities, among other steps."

Defense Transportation: DOD Needs a Comprehensive Approach to Planning for Implementing Its New Personal Property Program

A letter report issued by the Government Accountability Office with an abstract that begins "The Department of Defense (DOD) has been working to improve its personal property program since the mid-1990s to fix long-standing problems, such as excessive loss or damage to servicemembers' property and poor quality of service from moving companies. DOD plans to replace its current program with Families First, a program that promises to offer servicemembers an improved claims process and quality of service. GAO was mandated to (1) assess the steps DOD has taken to achieve the goals and benefits of the Families First program; (2) evaluate the growth in costs of the program, including the costs for a new information management system, since GAO's last assessment in 2003; and (3) assess the extent to which DOD faces management challenges--such as staffing--in implementing Families First. To address these objectives, GAO analyzed DOD's program, funding and staffing data, and interviewed personal property officials and stakeholders."

Exporting Software and the Extraterritorial Reach of U.S. Patent Law: Microsoft Corp. v. AT&T Corp.

Generally speaking, United States patent law does not have extraterritorial effect. The exception, however, is § 271(f) of the Patent Act, which makes it an act of patent infringement to manufacture within the United States the components of a patented invention and then export those disassembled parts for combination abroad into an end product. This report discusses Microsoft Corp. v. AT&T Corp. (550 U.S. ___ , No. 05-1056, decided April 30, 2007), in which the U.S. Supreme Court held that software companies are not liable for patent infringement under § 271(f) when they export software that has been embodied in machine-readable, physical form (a CD-ROM, for example), with the intent that such software be copied abroad for installation onto foreign-manufactured computers.
