This report discusses legislation regarding the death penalty in the 109th Congress. The USA PATRIOT Improvement and Reauthorization Act (Reauthorization Act) contains a number of death penalty related provisions. Some create new federal capital offenses; some add the death penalty as a sentencing option in the case of preexisting federal crimes; some alter the procedural attributes of federal capital cases. Other proposals offered during the 109th Congress would have followed the same pattern: some new crimes; some new penalties for old crimes; and some procedural adjustments. Only one of the other proposals, the Adam Walsh Child Protection and Safety Act, passed, although at least one House approved several others. Three proposals do not fit the pattern; they either would have abolished the death penalty as a federal sentencing alternative or would have imposed a moratorium upon executions.

This report discusses the the Department of Agriculture's (USDA) ability to make loans to farmers to enable them to construct, improve, repair, or replace dwellings and other farm buildings to provide decent, safe, and sanitary living conditions for themselves or their tenants, lessees, sharecroppers, and laborers. USDA was also authorized to make grants or combinations of loans and grants to those farmers who could not qualify to repay the full amount of a loan, but who needed the funds to make the dwellings sanitary or to remove health hazards to the occupants or the community.

Under the American Jobs Creation Act of 2004 (AJCA, P.L. 108-357), the Internal Revenue Service (IRS) has acquired for the second time in its history the legal authority to hire private debt collection agencies (PCAs) to assist in the collection of certain individual tax debt. The grant of authority grew out of a proposal made by the Bush Administration in its budget request for the IRS in both FY2004 and FY2005. This report focuses on IRS’s current plan for hiring PCAs to collect delinquent individual taxes and the policy issues it raises. It begins with an examination of the scope of IRS’s authority to use PCAs under the AJCA and concludes with a discussion of the main issues for Congress as it oversees IRS’s efforts to implement and manage the private tax debt collection initiative. This report examines various issues pertaining to foreign students in the United States. Since the Immigration Act of 1924, the United States has expressly permitted foreign students to study in U.S. institutions. Most foreign students are at least 18 years old and are enrolled in higher education programs. Foreign students are generally considered to enrich cultural diversity of the educational experience for U.S. residents as well as enhance the reputation of U.S. universities as world-class institutions. Concerns have arisen in recent years that have caused Congress to take a new look at the Immigration and Nationality Act (INA) provisions that govern their admission.

In an attempt to expand oversight of federal spending, including earmarks, S. 2590 would provide the public with access to an online database containing information about entities that are awarded federal grants, loans, and contracts. This report summarizes S. 2590, compares it to H.R. 5060, and outlines the arguments in favor of the bill and those critical of it. The final section discusses the implications of using the Federal Assistance Award Data System (FAADS) and the Federal Procurement Data System (FPDS) to populate the bill’s proposed database.

The protection of classified national security and other controlled information is of concern not only to the executive branch, which determines what information is to be safeguarded, for the most part,1 but also to Congress, which uses such information to fulfill its constitutional responsibilities. As a result, Congress has established procedures and mechanisms to protect controlled information in its custody. These arrangements, however, differ between the House and the Senate and among panels in each chamber. The Senate, for instance, has established an Office of Senate Security to centralize responsibility for personnel and information security, whereas the House has not created a counterpart. Proposals to change the system, some of which could prove controversial or costly, usually seek to set uniform standards or increase requirements for access. This report will be updated as conditions require.

This report discusses policy topics that involve wetlands. The U.S. Fish and Wildlife Service released its most recent periodic survey of changes in wetland acreage nationwide in March 2006. Covering 1998 to 2004, it concluded that during this time period there was a small net gain in overall wetland acres for the first time that this survey has been conducted. Others caution, however, that much of this gain was in ponds, rather than natural wetlands.
