FEMA Reorganization Legislation in the 109th Congress

In the aftermath of Hurricane Katrina, Members of Congress and others raised questions about the scope and reach of federal emergency management policies, the procedures used to administer federal statutory authorities, the qualifications of personnel, and other issues. Most of the questions focused on the Federal Emergency Management Agency (FEMA), the agency primarily responsible for coordinating federal and non-federal disaster response activities. This report provides information on provisions of the Senate-approved amendment (S.Amdt. 4560) to the FY2007 appropriations bill, H.R. 5316, and H.R. 5351 that address concerns identified after Hurricane Katrina. To provide a context for information on the legislation, this report first summarizes findings and recommendations of the congressional and White House studies pertinent to the pending legislation reported from the House committees.

Community Development Block Grant Funds in Disaster Relief and Recovery

This report discusses how Community Development Block Grant (CDBG) programs are funded by Congress and what they have been used for in recent years: recovery efforts following terrorist attacks, riots, and natural disasters. The 111th Congress is considering $100 million in CDBG funds to help states and communities undertake disaster recovery activities in presidentially declared disaster areas affected by severe storms and flooding during the period from March 2010 through May 2010. The act limited distribution of these funds to states where the entire state was declared a disaster area (Rhode Island) and to states where at least 20 counties within the state were declared disaster areas (Tennessee, Kentucky, and Nebraska).

Air Quality Issues and Animal Agriculture: EPA's Air Compliance Agreement

In an effort to collect scientifically credible data regarding the effect of animal agriculture on water resources (specifically animal waste and emissons from animal feeding operations (AFO), the Environmental Protection Agency (EPA) in January 2005 announced the Air Compliance Agreement. The agreement is intended to produce air quality monitoring data on AFO emissions during a two-year study, while at the same time protecting participants through a “safe harbor” from liability under certain provisions of federal environmental laws. This report discusses the agreement and the perspectives of both its supporters and opponents.

Resonance Capture of Neutrons by Thorium Cylinders

The dependence of the resonance integral for thorium upon geometry and thorium temperature has been determined through reactivity coefficient measurements performed in the Hanford Test Pile. The geometry dependence was investigated using thorium cylinders of various diameters in the form of solid elements and shells. The temperature dependence (Doppler broadening) was studied by heating thorium elements and permitting them to cool while observing the change in pile reactivity.

"Theoretical calculations have been carried our for the two ordering phases which occur in the FeAl system. The statistical treatment involves first and second neighbor interaction parameters as well as a magnetic interaction between first neighbor iron atoms. The phase diagram and the amount and type of long range order for slowly cooled alloys are calculated. Further calculations include short range order for the disordered phase at three compositions and two temperatures. As expected, the short range order increases as a critical temperature is approached either in composition of in temperature."

Deepwater Horizon Oil Spill Disaster: Risk, Recovery, and Insurance Implications

This report begins with a review of the Deepwater Horizon incident and identifies the limits of liability facing the operators of offshore oil rigs. The next two sections of the report examine risk management in the offshore energy exploration and production business, the scope of the oil spill financial responsibility and insurance requirements, and the marine insurance industry that offers specialized coverage for offshore oil and gas firms. The fourth section outlines the various approaches to compensating oil pollution victims, including compensation funds, commercial insurance, federal disaster assistance, and tort law.
