Item Veto and Expanded Impoundment Proposals
In recent years conflicting budget priorities and divided political control have accentuated the institutional tensions between the executive and legislative branches inherent in the federal budget process. President Clinton, like his two predecessors, called for an item veto, or possibly expanded impoundment authority, to provide him with greater control over federal spending. This report discusses the ongoing congressional interest in the pace of U.S. technological advancement due to its influence on U.S. economic growth, productivity, and international competitiveness. Because technology can contribute to economic growth and productivity increases, congressional interest has focused on how to augment private-sector technological development. Legislative activity over the past decade has created a policy for technology development, albeit an ad hoc one. Because of the lack of consensus on the scope and direction of a national policy, Congress has taken an incremental approach aimed at creating new mechanisms to facilitate technological advancement in particular areas and making changes and improvements as necessary.

Medical Records Privacy: Questions and Answers on the HIPAA Final Rule

Flag Protection: A Brief History and Summary of Recent Supreme Court Decisions and Proposed Constitutional Amendment
This report is divided into two parts. The first gives a brief history of the flag protection issue, from the enactment of the Flag Protection Act in 1968 through current consideration of a constitutional amendment. The second part briefly summarizes the two decisions of the United States Supreme Court, Texas v. Johnson and United States v. Eichman, that struck down the state and federal flag protection statutes as applied in the context punishing expressive conduct.

House and Senate Vacancies: How Are They Filled?
Vacancies in Congress occur due to the death, resignation, or declination (refusal to serve) of a Senator or Representative, or as the result of expulsion or exclusion by either house. The Constitution requires that vacancies in both houses be filled by special election, but in the case of the Senate, it empowers state legislatures to provide for temporary appointments by the state governor until special elections can be scheduled. This report describes this process.

Foreign Students in the United States: Policies and Legislation
This report examines various issues pertaining to foreign students in the United States. Since the Immigration Act of 1924, the United States has expressly permitted foreign students to study in U.S. institutions. Most foreign students are at least 18 years old and are enrolled in higher education programs. Foreign students are generally considered to enrich cultural diversity of the educational experience for U.S. residents as well as enhance the reputation of U.S. universities as world-class institutions. Concerns have arisen in recent years that have caused Congress to take a new look at the Immigration and Nationality Act (INA) provisions that govern their admission.

Access to Government Information in the United States
The Constitution of the United States makes no specific allowance for any one of the co-equal branches to have access to information held by the others and contains no provision expressly establishing a procedure for, or a right of, public access to government information. Nonetheless, Congress has legislated various public access laws. These include two records access statutes—the Freedom of Information Act (5 U.S.C. 552) and the Privacy Act (5 U.S.C. 552a)—and two meetings access statutes—the Federal Advisory Committee Act (5 U.S.C. App.) and the Government in the Sunshine Act (5 U.S.C. 552b). Moreover, due to the American separation of powers model of government, interbranch conflicts over the accessibility of information are neither unexpected nor necessarily destructive. The federal courts, historically, have been reluctant to review and resolve “political questions” involving information disputes between Congress and the executive branch. Although there is considerable interbranch cooperation, such conflicts probably will continue to occur on occasion.

Visa Issuances: Policy, Issues, and Legislation
This report addresses the current policy on immigration visa issuances and options for reassigning this function to the Department of Homeland Security (DHS). It opens with an overview of visa issuances, with sections on procedures for aliens coming to live in the United States permanently and on procedures for aliens admitted for temporary stays. An analysis of the grounds for excluding aliens follows. The report summarizes the debate on transferring visa issuance policy functions to homeland security and concludes with a discussion of the legislative proposals to reassign the visa issuance activities and to revise visa issuance policies.

Individuals with Disabilities Education Act (IDEA) and Medicaid
This report begins with an overview of Individuals with Disabilities Education Act (IDEA). It then discusses the distinction made in IDEA between medical services and health services. The report then summarizes the provisions in law that link Medicaid funding to IDEA. Next the report provides an overview of the complexities of Medicaid eligibility and covered services. Following that discussion, the report analyzes possible reasons why Medicaid appears to cover relatively little of IDEA health-related costs. Farm Bill Trade and Food Aid Provisions
This report discusses the trade provisions of omnibus farm legislation, passed and signed into law in May 2002. The measure includes a trade title reauthorizing, through 2007, the major foreign food aid and agricultural export programs. The National Commission to Ensure Consumer Information and Choice in the Airline Industry was created by the Aviation Investment and Reform Act for the 21st Century (AIR-21), enacted in April 2000, to study the market position and general condition of retail travel agents in today's competitive markets for the sale of air travel services. The commission will examine whether the financial condition of travel agents is declining and, if so, the effect of such a decline on consumers. It also will explore whether there are impediments to information regarding the services and products offered by the airline industry, and, if so, the effects of those impediments on travel agents, Internet-based distributors and consumers.

The Creation of the Science Commission
For 155 years, the Smithsonian Institution has had as its mission "the increase and diffusion of knowledge." Given the important questions facing the scientific world today, the existing level of institutional financial and physical resources, the strengths of the Institution's people and its collections, how should the Smithsonian set priorities for scientific research in the years ahead and, in general, carry out its historic mission more effectively? 1) How should scientific research be organized to optimize the use of the Institution's human, physical and financial resources? 2) How should the performance of scientific research by individuals and research departments be evaluated? 3) How can the relationship between research and public programming be enhanced? 4) What suggestions, of any type might the Science Commission have to strengthen research at the Smithsonian? 5) What should be the qualifications of those chosen to lead key scientific research units of the Smithsonian? 6) What should be done to enhance public recognition of Smithsonian science?
