Coast Guard Polar Icebreaker Modernization: Background, Issues, and Options for Congress

Coast Guard polar icebreakers perform a variety of missions supporting U.S. interests in polar regions. The Coast Guard's two heavy polar icebreakers - Polar Star and Polar Sea - have exceeded their intended 30-year service lives. Following a decision to design and build one or more new polar icebreakers, the first replacement polar icebreaker might enter service in eight to 10 years, by which time Polar Star and Polar Sea could be more than 40 years old. The issue for Congress is whether to approve, reject, or modify Coast Guard plans for modernizing its polar icebreakers. Congressional decisions on this issue could affect the Coast Guard's ability to perform its polar missions, Coast Guard funding requirements, and the U.S. shipbuilding industrial base.

Marine protected areas (MPAs) are generally defined as areas reserved by law or other effective means to protect part or all of the enclosed environment. This report identifies a number of issues related to establishing MPAs in the United States. It begins by defining the concept and administrative actions taken to provide spatial protection in marine areas. It then considers some of the key issues and potential benefits and costs of designating additional MPAs. It concludes by considering potential areas of congressional interest for the 111th Congress. Existing federal laws related to the use of MPAs are summarized in the Appendix.

Navy Nuclear Aircraft Carrier (CVN) Homeporting at Mayport: Background and Issues for Congress

On January 14, 2009, the Navy announced that it wants to transfer one of its nuclear-powered aircraft carriers (CVNs) to the Navy home port at Mayport, FL, known formally as Naval Station (NAVSTA) Mayport. The Navy's proposed FY2010 budget requests $46.3 million in Military Construction (MilCon) funding for channel dredging at Mayport. The Navy states that a key reason it wants to transfer a CVN to Mayport is to hedge against the risk of a catastrophic event that could damage the Navy's CVN homeporting facilities at Norfolk, VA, and nearby Newport News, VA. This report discusses potential questions for Congress to consider related to budget appropriations for such a transfer, the potential negative economic effects that a CVN transfer would have on the local homeport, and the other general questions regarding the Navy.

Limitations in Appropriations Measures: An Overview of Procedural Issues

This report discusses internal congressional rules and procedures regarding money and policy decisions. It begins by explaining the contrasting procedural contexts that influence the consideration of limitation provisions in appropriations measures on the House and Senate floor. Next, it defines the two forms of limitations that have been allowed under House and Senate precedents, with examples of previous purposes that have been allowed. This report then proceeds to identify the variety of substantive challenges that exist in structuring a limitation provision so that it does not constitute legislative language and thereby violate House and Senate rules. Finally, this report concludes by discussing the effect of points of order during floor consideration and the burden of proof that exists for proponents of limitation provisions to successfully overcome procedural objections.

This report examines selected major H.R. 238 provisions that would authorize appropriations for the Commodity Futures Trading Commission (CFTC) of $250 million for each of FY2017 through FY2021, expand the current 5 cost-benefit analysis provisions in the CEA to 12 considerations and add a requirement that the CFTC conduct quantitative as well as qualitative assessments, potentially broaden the bona fide hedging definition to allow anticipated, as well as current, risks to be hedged, which might increase the number of swaps that qualify as hedges, and mandate that, starting 18 months from enactment, the regulatory requirements of the eight largest foreign swaps markets be considered comparable to those of the United States--unless the CFTC issued a rule finding that any of those foreign jurisdictions' requirements were not comparable to U.S. requirements.

This report discusses President Trump's Proclamation on on Enhanced Vetting for Foreign Nationals from Designated Countries which was issued on September 24, 2017 and is a newly revised version of the previously blocked executive orders which blocked entry to people from certain Muslim-majority countries and refugees temporarily. The new list of countries with travel bans or special scrutiny consists of Iran, Libya, Somalia, Syria, Yemen, North Korea, Chad, and Venezuela (only certain government officials).
