Trying Terrorists as War Criminals (open access)

Trying Terrorists as War Criminals

On November 13, 2001, President Bush signed a Military Order pertaining to the detention, treatment, and trial of certain non-citizens in the war against terrorism. The President’s Military Order makes it apparent that he plans to treat the attacks as acts of war rather than criminal acts, and to prosecute those responsible as war criminals, trying them by special military commission rather than in federal court. The purpose of this the report is to clarify the legal basis for treating the acts as war crimes and the ramifications of applying the law of war rather than criminal statutes to prosecute the perpetrators. The discussion focuses on the trial of alleged terrorists and conspirators by a military commission rather than the federal courts. A longer treatment of the issues in this report and an analysis of other relevant issues, including the Military Order, are contained in CRS Report RL 31191.

Budget Reconciliation FY2006: Provisions Affecting the Medicaid Federal Medical Assistance Percentage (FMAP)

The federal medical assistance percentage (FMAP) is the rate at which states are reimbursed for most Medicaid service expenditures. The FY2006 budget reconciliation bills passed by the House (H.R. 4241) and Senate (S. 1932) include provisions that would affect state FMAPs for Medicaid in a number of ways. This report describes these provisions and estimates their impact on FY2006 FMAPs.

Congress' Power to Legislate Control Over Hate Crimes: Selected Legal Theories (open access)

Congress' Power to Legislate Control Over Hate Crimes: Selected Legal Theories

Congress has no power under the commerce clause over “noneconomic, violent criminal conduct” that does not cross state lines said Chief Justice William Rehnquist in United States v. Morrison. Congress, however, enjoys additional legislative powers under the spending clauses and the legislative clauses of the Thirteenth and Fifteenth Amendments. Extensive, if something less than all encompassing, national legislation may be possible under the confluence of authority conveyed by the commerce clause, spending clause, and the legislative clauses of the constitution’s Reconstruction Amendments, provided the limitations of the First, Sixth and Tenth Amendments are observed.

Border Security: Fences Along the U.S. International Border

This report outlines the issues involved with the Department of Homeland Security's (DHS's) completion of a three-tiered, 14-mile fence, along the border near San Diego, California. The state of California delayed completion of the fence due primarily to legal and policy conflicts with its federally-approved, state-run Coastal Management Program. Former authorization for the fence only allowed the waiver of the Endangered Species Act and the National Environmental Policy Act. During the 109th Congress, provisions to facilitate the completion of the border fence were included in the REAL ID Act of 2005 (H.R. 41 8), which was subsequently added to H.R. 1268, the Emergency Supplemental Appropriations Act, and signed into law on May 1 1,2005 (P.L. 109-13). The border fence provisions allow the Secretary of DHS to waive all legal requirements determined necessary to ensure expeditious construction of authorized barriers and roads.
