Individuals with Disabilities Education Act: Full Funding of State Formula

This report discusses Individuals with Disabilities Education Act (IDEA), which assists participating states to serve school-age children with disabilities. The state funding formula, which provides a foundation amount based on states’ FY1999 grants and allocates remaining amounts based on states’ shares of school-age children and of school-age poor children, authorizes a maximum allotment per disabled child served of 40% of the national average per pupil expenditure (APPE). Annual appropriations have never been sufficient to provide each state its maximum allotment; in FY2002, states will receive approximately 16.5% of the national APPE per disabled child served. Some advocates for the program have called upon the Congress to fully fund the formula. An estimated $18.2 billion would be required to provide states the maximum allotment allowed per disabled child served in FY2002, about 2.4 times more than the appropriation of $7.5 billion for FY2002.

Economic slowdowns in Asia and the United States in the beginning of 2001 have hurt China’s export industries, and the September 11, 2001 terrorist attacks against the United States will likely further dampen foreign demand for Chinese products and could reduce the level of planned foreign investment in China. The Chinese government has used public spending in recent years to boost the economy, and it is likely that it will continue to maintain such policies until the global economy begins to recover.

The Federal Reserve's Arrangement for Emergency Loans to Japanese Banks

The U.S. Federal Reserve reportedly has an arrangement with the Bank of Japan to provide emergency loans to Japanese banks operating overseas in exchange for U.S. Treasury securities. The collateralized loans would be extended on short notice for banks facing emergency liquidity needs. The purpose of the arrangement is to forestall the possible sale by Japanese banks of large amounts of U.S. Government securities (thereby raising U.S. interest rates) and to boost confidence in Japan's financial system. The loans would not risk U.S. taxpayers' funds. The Chairmen of both House and Senate Banking Committees have made statements about the arrangement, thus making it a matter oflegislative interest.

China is now the third largest U.S. trading partner, its second largest source of imports, and its fourth largest export market. However, U.S.-China commercial ties have been strained by a number of issues, including a surging U.S. trade deficit with China, China's refusal to float its currency, and failure to fully comply with its World Trade Organization (WTO) commitments, especially its failure to provide protection for U.S. intellectual property rights (IPR). This report explores these issues in detail, especially concerning the lack of protection for U.S. IPR.

Veterans' Medical Care Appropriations and Funding Process

The Department of Veterans Affairs (VA) provides benefits to veterans who meet certain eligibility rules. Benefits to veterans range from disability compensation and pensions to hospital and medical care. VA provides these benefits to veterans through three major operating units: the Veterans Health Administration (VHA), the Veterans Benefits Administration (VBA) and the National Cemetery Administration (NCA). VHA is primarily a direct service provider of primary care, specialized care, and related medical and social support services to veterans through an integrated health care system. Veterans are enrolled in priority groups that determine payments for service and nonservice-connected medical conditions. In FY2004, Congress appropriated $28.4 billion for VHA to be spent through an account structure composed of four new accounts: medical services, medical administration, medical facilities, and medical and prosthetic research.

On May 1, 2004, 10 states joined the European Union (EU), enlarging the Union to 25 members. The EU views the enlargement process as an historic opportunity to promote stability in Europe and further the integration of the continent by peaceful means. In addition to the 10 new members (Cyprus, the Czech Republic, Estonia, Hungary, Latvia, Lithuania, Malta, Poland, Slovakia, and Slovenia), three other states — Bulgaria, Romania, and Croatia — hope to accede to the EU by 2007. Turkey is also a candidate and is expected to begin accession negotiations in 2005. Macedonia has also applied for EU membership.

Congressional Pay

The question of a salary increase for Members of Congress was considered by both Houses numerous times during the 97th Congress. The issue was last considered during December in the FY83 Further Continuing Appropriations. As sent to the President, the measure provided for a 15% pay increase for Members of the House of Representatives and other senior Federal officials, but not for Senators. The resolution was signed into law by the President on Dec. 21, 1982. Previously, in September, Congress approved a pay cap through Dec. 17, 1982 for Members and other senior Federal officials.
