For FY2004, the President’s budget requested $7.6 billion in budget authority for the Environmental Protection Agency (EPA), $448 million (or 6%) less than the $8.1 billion current funding level. Freedom of Speech and Press: Exceptions to the First Amendment

The First Amendment to the United States Constitution provides that “Congress shall make no law . . . abridging the freedom of speech, or of the press. . . .” This language restricts government both more and less than it would if it were applied literally. It restricts government more in that it applies not only to Congress, but to all branches of the federal government, and to all branches of state and local government. It restricts government less in that it provides no protection to some types of speech and only limited protection to others. This report provides an overview of the major exceptions to the First Amendment – of the ways that the Supreme Court has interpreted the guarantee of freedom of speech and press to provide no protection or only limited protection for some types of speech.

Clean Water Act Issues in the 108th Congress

The Clean Water Act Issues has again received attention in the 108th Congress. At issue is how the federal government will assist states and cities in meeting needs to rebuild, repair, and upgrade wastewater treatment plants, especially in light of capital costs which are projected to be as much as $390 billion over the next two decades. In October 2004, the Senate Environment and Public Works Committee reported legislation to authorize $20 billion in funding for clean water infrastructure (S. 2550), while in July 2003, a House Transportation and Infrastructure subcommittee also approved a water infrastructure financing bill (H.R. 1560). Still, prospects for further action during the 108th Congress are uncertain.

Afghanistan: Current Issues and U.S. Policy

The United States and its allies are helping Afghanistan emerging from more than 22 years of warfare, although substantial risk to Afghan stability remains. Before the U.S. military campaign against the orthodox Islamist Taliban movement began on October 7, 2001, Afghanistan had been mired in conflict since the Soviet invasion of Afghanistan in 1979. The defeat of the Taliban has enabled the United States and its coalition partners to send forces throughout Afghanistan to search for Taliban and Al Qaeda fighters and leaders that remain at large, including Osama bin Laden. As the war against remaining Al Qaeda and Taliban elements winds down, the United States is shifting its military focus toward stabilizing the interim government, including training a new Afghan national army, and supporting the international security force (ISAF) that is helping the new government provide security.

A Brief Summary of the Medical Privacy Rule

This report provides a brief overview of the recently modified medical privacy rule, “Standards for the Privacy of Individually Identifiable Health Information”(“privacy rule”) published on August 14, 2002 by the Department of Health and Human Services (HHS). The privacy rule went into effect April 14, 2001, with compliance required by April 2003 for most entities. The regulation creates a new federal floor of privacy protections while leaving in place more protective state rules or practices. The rule establishes a set of basic consumer protections and a series of regulatory permissions for uses and disclosures of protected health information.

New World Gold Mine and Yellowstone National Park

Crown Butte Mines, Inc. wants to develop its New World gold mine deposit located near Yellowstone National Park. The proposed mine is located almost entirely on private property about 3 miles east of the northeast corner of Yellowstone National Park and next to the Absaroka-Beartooth Wilderness area. The New World Mine Project would mine an estimated 1,800 tons of gold/silver/copper ore per day (500,000 tons annually), valued at an estimated $800 million over a 10-15 year period. The project would include an underground mine, an ore processing mill, a tailings pond, a waste rock storage site, access roads, a work camp and transmission lines. A draft environmental impact statement (EIS), required under both NEPA and the Montana Environmental Policy Act, is in the final months of a three-year preparation.
