The Environmental Protection Agency's FY2002 Budget
On April 9, 2001, the President requested $7.3 billion in discretionary budget authority for the Environmental Protection Agency (EPA) for FY2002, $512.0 million (or 7%) less than the FY2001 funding level of $7.8 billion. The request would not have continued funding of about $500 million for activities earmarked for FY2001, and contained provisions shifting more enforcement responsibilities to the states. Popular wastewater infrastructure funding, state roles, and the future of Superfund were some of the predominant topics. On July 17, the House Appropriations Committee recommended $7.545 billion,$229 million more than requested (H.R. 2620, H. Rept. 107-159).

The Debt Limit: The Need to Raise It After Four Years of Surpluses
Increases in total federal debt are driven by government deficits (which increase debt held by the public) and by the surpluses credited to (and federal accounting for) debt-holding federal accounts, mostly federal trust funds such as the Social Security, Medicare, Transportation, and Civil Service trust funds.

Chemical Plant Security
Facilities handling large amounts of potentially hazardous chemicals (i.e., chemical facilities) might be of interest to terrorists, either as targets for direct attacks meant to release chemicals into the community or as a source of chemicals for use elsewhere. Because few terrorist attacks have been attempted against chemical facilities in the United States, the risk of death and injury in the near future is estimated to be low, relative to the likelihood of accidents at such facilities or attacks on other targets using conventional weapons. For any individual facility, the risk is very small, but risks may be increasing with potentially severe consequences for human health and the environment. Available evidence indicates that many chemical facilities may lack adequate safeguards.

Campaign Financing

Concerns over financing federal elections have become a seemingly perennial aspect of our political system, centered on the enduring issues of high campaign costs and reliance on interest groups for needed campaign funds. Election Projections: First Amendment Issues
Media projections may be based both on exit polls and on information acquired as to actual ballot counts. The First Amendment would generally preclude Congress from prohibiting the media from interviewing voters after they exit the polls. It apparently would also preclude Congress from prohibiting the media from reporting the results of those polls. Congress, could, however, ban voter solicitation within a certain distance from a polling place, and might be able to include exit polling within such a ban.

Armenia, Azerbaijan, and Georgia: Political Developments and Implications for U.S. Interests
The United States recognized the independence of all the former Soviet republics by the end of 1991, including the South Caucasus states of Armenia, Azerbaijan, and Georgia. The United States has fostered these states' ties with the West in part to end the dependence of these states on Russia for trade, security, and other relations. The FREEDOM Support Act of 1992 provides authorization for assistance to the Eurasian states for humanitarian needs, democratization, and other purposes. In the aftermath of the September 11, 2001, terrorist attacks on the United States, the Administration appealed for a national security waiver of the prohibition on aid to Azerbaijan, in consideration of Azerbaijan's assistance to the international coalition to combat terrorism. Azerbaijani and Georgian troops participate in stabilization efforts in Afghanistan and Iraq, and Armenian personnel serve in Iraq.

The Vietnam-U.S. Normalization Process
U.S.-Vietnam diplomatic and economic relations remained essentially frozen for more than a decade after the 1975 communist victory in South Vietnam. Washington and Hanoi have incrementally normalized relations over the past decade. The pace has been relatively slow due to continued debate in the United States and Vietnam over improved relations. Congress has played a significant role in the normalization process.

Access to Government Information in the United States
The Constitution of the United States makes no specific allowance for any one of the co-equal branches to have access to information held by the others and contains no provision expressly establishing a procedure for, or a right of, public access to government information. Nonetheless, Congress has legislated various public access laws. These include two records access statutes—the Freedom of Information Act (5 U.S.C. 552) and the Privacy Act (5 U.S.C. 552a)—and two meetings access statutes—the Federal Advisory Committee Act (5 U.S.C. App.) and the Government in the Sunshine Act (5 U.S.C. 552b). Moreover, due to the American separation of powers model of government, interbranch conflicts over the accessibility of information are neither unexpected nor necessarily destructive. The federal courts, historically, have been reluctant to review and resolve “political questions” involving information disputes between Congress and the executive branch. Although there is considerable interbranch cooperation, such conflicts probably will continue to occur on occasion.

Immigration: Legislative Issues on Nonimmigrant Professional Specialty (H-1B) Workers
The economic prosperity of the 1990s fueled a drive to increase the levels of employment-based immigration. The nation enjoyed its longest economic expansion, and the unemployment rate had remained low. Both the Congress and the Federal Reserve Board then expressed concern that a scarcity of labor could curtail the pace of economic growth. A primary legislative response was to increase the supply of foreign temporary professional workers through FY2003. The 108th Congress now weighs whether to extend the increases or let the levels revert to the statutory limit.

Asia Pacific Economic Cooperation (APEC) and the 2000 Summit in Brunei
On November 15-16, 2000, the Eighth Asia Pacific Economic Cooperation (APEC) Leaders' Meeting (summit) was held in Bandar Seri Begawan, Brunei. In addition to the APEC summit, President Clinton held bilateral summits with several leaders of APEC countries including China, Russia, Japan, and South Korea. For the United States, APEC raises fundamental questions of special interest to Congress. One is whether consensus can be achieved on the APEC vision of free trade and investment in the Asia Pacific or whether future trade liberalization will be confined primarily to bilateral free-trade agreements or multilateral trade negotiations under the World Trade Organization. Others are whether provision of fast-track negotiating authority to the President should cover negotiations under APEC and whether APEC should be expanded to address political as well as economic issues.

Ergonomics in the Workplace: Is It Time for an OSHA Standard?
Improper ergonomic design of jobs is one of the leading causes of work-related illness, accounting for perhaps a third of employers’ costs under state workers’ compensation laws. Due to the wide variety of circumstances, however, any comprehensive standard would probably have to be complex and costly, while scientific understanding of the problem is not complete.

Defense Outsourcing: The OMB Circular A-76 Policy
This report provides information on the Office of Management and Budget’s (OMB) Circular A-76, “Performance of Commercial Activities,” and the impact of a related reform initiative, the Federal Activities Inventory Reform Act (FAIR) of 1998, within the Department of Defense. The Circular defines federal policy for determining whether recurring commercial activities should be outsourced to commercial sources, Governmental facilities, or through inter-service support agreements. The FAIR Act creates statutory reporting requirements for federal executive agencies, by requiring Federal executive agencies to identify activities “not inherently governmental” and consider outsourcing through managed competitions. However, FAIR does not require that agencies contract out these activities.
