Financial Audit: Restatements to the National Science Foundation's Fiscal Year 2003 Financial Statements

Correspondence issued by the Government Accountability Office with an abstract that begins "The Secretary of Treasury, in coordination with the Director of the Office of Management and Budget (OMB), is required to annually prepare and submit audited financial statements of the U.S. government to the President and Congress. We are required to audit these consolidated financial statements (CFS) and report on the results of our work. An issue meriting concern and close scrutiny that emerged during our fiscal year 2004 CFS audit was the growing number of Chief Financial Officers (CFO) Act agencies that restated certain of their financial statements for fiscal year 2003 to correct errors. Errors in financial statements can result from mathematical mistakes, mistakes in the application of accounting principles, or oversight or misuse of facts that existed at the time the financial statements were prepared. Frequent restatements to correct errors can undermine public trust and confidence in both the entity and all responsible parties. Further, when restatements do occur, it is important that financial statements clearly communicate, and readers of the restated financial statements understand, that the financial statements originally issued by management in the previous year and the opinion thereon should no longer be relied …

Under TRICARE, beneficiaries may obtain care through a managed care option that requires enrollment and the use of civilian provider networks, which are developed and managed by contractors. Beneficiaries who do not enroll may receive care through TRICARE Standard, a fee-for-service option, using nonnetwork civilian providers or through TRICARE Extra, a preferred provider organization option, using network civilian providers. Nonenrolled beneficiaries in some locations have reported difficulties finding civilian providers who will accept them as patients. The National Defense Authorization Act (NDAA) for fiscal year 2004 directed GAO to provide information on access to care for nonenrolled TRICARE beneficiaries. This report describes (1) how DOD and its contractors evaluate nonenrolled beneficiaries' access to care and the results of these evaluations; (2) impediments to civilian provider acceptance of nonenrolled beneficiaries, and how they are being addressed; and (3) how DOD has implemented the NDAA fiscal year 2004 requirements to take actions to ensure nonenrolled beneficiaries' access to care. Agencies have begun efforts to address their strategic human capital needs; however, no agency has completed a strategic human capital management plan for their acquisition workforce. Overall, agencies' plans reflected different levels of attention to human capital, ranging from merely identifying human capital challenges to putting forward solutions to address those challenges, such as by defining actual plans, committing resources, and assigning accountability."

A letter report issued by the Government Accountability Office with an abstract that begins "Competitive sourcing is aimed at promoting competition between federal employees and the private sector as a way to improve government operations. Key work activities--those that are either inherently governmental or core to the agency's mission--are generally exempt from competitions. In fiscal year 2004, Congress began placing spending limitations on the Forest Service's competitive sourcing program because of concerns about how the program was managed. Also, like other agencies, the Forest Service must report annually to Congress on the savings achieved from any competitions it conducted. GAO was asked to determine the extent to which the Forest Service has (1) plans and guidance to help implement its competitive sourcing program effectively and (2) sufficient cost data to ensure that it complied with its spending limitations and accurately reported its savings to Congress for fiscal years 2004 through 2006. To answer these objectives, GAO examined the agency's strategic plan, guidance, and available cost data for competitive sourcing and interviewed key agency officials."

Delta II, however, is no longer in production, and no other vehicle in the relative cost and performance range is currently certified for NASA use. Thus, NASA faces a potential gap in the availability of medium class launch vehicles that could cause design challenges, delays, or funding issues. GAO was asked to assess (1) NASA's and the Delta II contractor's, steps to ensure resources (budget, workforce, and facilities) are available to support safe Delta II operations through the last planned NASA flight in 2011; (2) NASA's plans and contingencies for ensuring a smooth transition from current small and medium class launch vehicles to other launch vehicles for future science missions; (3) the risks associated with NASA's planned approach to fill the medium launch capability gap; and (4) technical and programmatic implications to science missions if NASA commits to new launch vehicles before they are certified and proven. Correspondence issued by the Government Accountability Office with an abstract that begins "The principal role of the Chemical Safety and Hazard Investigation Board (CSB) is to investigate accidental releases of regulated or extremely hazardous substances to determine the conditions and circumstances that led to the accident and to identify the cause or causes so that similar accidents might be prevented. Accidental releases of these toxic and hazardous chemicals occur frequently and often have serious consequences. CSB reported to Congress that the agency received notification of approximately 900 chemical accidents in calendar year 2007, and that 31 of these accidents were serious or even fatal events that warranted the commitment of CSB investigators. CSB began operating in 1998 as an independent agency created under the Clean Air Act Amendments of 1990. The act directs CSB to (1) investigate and report on the cause or probable cause of any accidental chemical releases from stationary sources resulting in a fatality, serious injury, or substantial property damages; (2) make recommendations to reduce the likelihood or consequences of accidental chemical releases and propose corrective measures; and (3) establish regulations for reporting accidental releases. In 2005, USCIS embarked on a major, multiyear program to transform its process to a system that is to incorporate electronic application filing, adjudication, and case management. In 2007, GAO reported that USCIS was in the early stages of the Transformation Program and that USCIS's plans partially or fully met key practices. In 2008, USCIS contracted with a solutions architect to help develop the new system. As requested, GAO evaluated the extent to which USCIS has followed DHS acquisition policy in developing and managing the Transformation Program. The Implementing Recommendations of the 9/11 Commission Act directed GAO to report on public transit information sharing. This report describes (1) the primary mechanisms used to share security information with public transit agencies; and evaluates (2) public transit agencies' satisfaction with federal efforts to share security-related information (e.g., security threats) and opportunities to improve these efforts; and (3) the extent to which DHS has identified goals and measures for sharing information. GAO surveyed 96 of the 694 U.S. public transit agencies based on 2008 ridership and received 80 responses. The 96 public transit agencies surveyed represent about 91 percent of total 2008 ridership. Correspondence issued by the Government Accountability Office with an abstract that begins "For about 40 years, the Department of Energy's Rocky Flats site, near Denver, served as a production facility that made plutonium triggers, or "pits," for nuclear weapons. That role resulted in radiological and chemical contamination of many of the site's buildings and its soil and water. Cleanup of the site, which commenced in 1996, has been a monumental undertaking. The cleanup is being conducted under the Rocky Flats Cleanup Agreement, which is the legally binding agreement that provides the framework for the cleanup effort. The cleanup agreement specifies the roles of the Department of Energy (DOE) and the two regulatory agencies for the site: the Environmental Protection Agency (EPA) and the Colorado Department of Public Health and Environment (Colorado). In February 2001, when GAO last reported on DOE's project to clean up and close the Rocky Flats site, the project was slightly over cost and behind schedule. The vast amount of work remaining to be done at that time, along with various major challenges facing the cleanup contractor, made it doubtful that the contractor could achieve its December 2006 closure goal. A letter report issued by the Government Accountability Office with an abstract that begins "As the responsible DOD agency for leading, advocating, and coordinating all DOD efforts to defeat improvised explosive devices (IED) the Joint IED Defeat Organization (JIEDDO) was directed to develop DOD’s counter-IED strategic plan in February 2006 under DOD Directive 2000.19E. As previously recommended by GAO, JIEDDO has made several attempts to develop such a plan, but its strategic-planning actions have not followed leading strategic-management practices or have since been discontinued. For example, JIEDDO’s 2007 strategic plan did not contain a means of measuring its performance outcomes—a leading strategic-management practice. In addition, JIEDDO’s 2009–2010 strategic plan contained performance measures, but JIEDDO discontinued using these measures because it later determined that the measures were not relevant to the organization’s goals. Although DOD tasked JIEDDO to develop its counter-IED strategic plan, DOD has not translated DOD’s counter-IED general mission objective of eliminating IEDs as a weapon of strategic influence into actionable goals and objectives. JIEDDO issued a new counter-IED strategic plan in January 2012; however, the new plan does not apply to all other counter-IED efforts departmentwide, only to those managed by JIEDDO. In connection with fulfilling our requirement to audit the fiscal year 2004 CFS, we evaluated the Department of the Treasury's (Treasury) financial reporting procedures and related internal control over the process for compiling the CFS, including the management representation letter provided us by Treasury and OMB. Written representation letters from management, required by U.S. generally accepted government auditing standards, ordinarily confirm oral representations given to the auditor, indicate and document the continuing appropriateness of those representations, and reduce the possibility of a misunderstanding between management and the auditor. Testimony issued by the Government Accountability Office with an abstract that begins "The Centers for Medicare & Medicaid Services (CMS) is responsible for protecting the Medicare program's fiscal integrity and ensuring that it pays only for those services that are its responsibility. Medicare Secondary Payer (MSP) provisions make Medicare a secondary payer to certain group health plans (GHP) and non-group health plans (NGHP), which include auto or other liability insurance, no-fault insurance, and workers' compensation plans. CMS has the right to recover Medicare payments made that should have been the responsibility of another payer, but CMS has not always been aware of these MSP situations. In 2007, Congress added mandatory reporting requirements for GHPs and NGHPs that should enable CMS to be aware of MSP situations. CMS reports that mandatory reporting was pushed back from 2009 to 2011 for some NGHPs and from 2009 to 2012 for others, in part due to concerns raised by the industry. GAO was asked to present background information about the MSP process as it pertains to NGHPs. The most current upsurge in prices is no exception. According to data from the Energy Information Administration (EIA), the average retail price of regular unleaded gasoline in the United States has increased almost every week this year since January 29th and reached an all-time high of $3.10 the week of May 14th. Over this time period, the price has increase 94 cents per gallon and added about $20 billion to consumers' total gasoline bill, or about $146 for each passenger car in the United States. Given the importance of gasoline for the nation's economy, it is essential to understand the market for gasoline and the factors that influence gasoline prices. In this context, this testimony addresses the following questions: (1) what key factors affect the prices of gasoline and (2) what effects have mergers had on market concentration and wholesale gasoline prices? For example, at Camp Arifjan, Kuwait the Army uses contractors to provide logistics support for operations in Iraq and Afghanistan. Contractors at Camp Arifjan refurbish and repair a variety of military vehicles such as the Bradley Fighting Vehicle, armored personnel carriers, and the High-Mobility, Multi-Purpose Wheeled Vehicle (HMMWV). However, while contractors provide valuable support to deployed forces, we have frequently reported that long-standing DOD contract management and oversight problems increase the opportunity for waste and make it more difficult for DOD to ensure that contractors are meeting contract requirements efficiently, effectively, and at a reasonable price. Since 1995, the statutory debt limit has been increased 12 times to its current level of $14.294 trillion. The Department of the Treasury (Treasury) recently notified Congress that the current debt limit could be reached as early as April 5, 2011, and the Congressional Budget Office (CBO) projects that under current law debt subject to the limit will exceed $25 trillion in 2021. This report (1) describes the actions that Treasury traditionally takes to manage debt near the limit, (2) analyzes the effects that approaching the debt limit has had on the market for Treasury securities, and (3) describes alternative mechanisms that would permit consideration of the link between policy decisions and the effect on debt when or before decisions are made. The Army and DFAS-IN did not have an effective, repeatable process for identifying the population of active duty payroll records. For example, it took 3 months and repeated attempts before DFAS-IN could provide a population of service members who received active duty Army military pay in fiscal year 2010. Further, because the Army does not have an integrated military personnel and payroll system, it was necessary to compare the payroll file to active Army personnel records. However, the Defense Manpower Data Center (DMDC), DOD’s central repository for information on DOD-affiliated personnel, did not have an effective process for comparing military pay account files with military personnel files to identify a valid population of military payroll transactions. It took DMDC over 2 months and labor-intensive research to compare and reconcile the total number of fiscal year 2010 active duty payroll accounts to its database of personnel files. A letter report issued by the Government Accountability Office with an abstract that begins "The marine transportation system is a critical part of the nation's infrastructure. To facilitate the safety and efficiency of this system, the Coast Guard maintains aids-to-navigation (ATON), such as buoys and beacons, and conducts domestic icebreaking in the Great Lakes, St. Lawrence Seaway, and northeast coast. To conduct these missions, the Coast Guard has a fleet of more than 200 vessels, ranging from 225-foot seagoing buoy tenders and 140-foot domestic icebreakers to 21-foot boats. After the terrorist attacks of September 11, 2001, many of these assets took on additional responsibilities for security patrols and other homeland security duties. Although some assets have been recently acquired, many others are reaching or have exceeded their design service lives, raising concerns about how well and for how much longer these older assets may be able to carry out their missions. In response, GAO examined (1) recent trends in the amount of time these assets have spent performing missions; (2) asset condition and its effect on mission performance; and (3) the actions taken by the Coast Guard to continue to achieve the missions of these assets. A letter report issued by the Government Accountability Office with an abstract that begins "In April 2005, GAO reported on factors affecting the timely production of up-armored high-mobility multi-purpose wheeled vehicles (HMMWV) and add-on armor kits for HMMWVs, as well as other items critically needed by deployed forces during Operation Iraqi Freedom. Due to high interest by Congress and the public regarding vehicle armor, GAO initiated this subsequent engagement to examine issues affecting the production and installation of armor for medium and heavy trucks. The objectives were to (1) determine the extent to which truck armor was produced and installed to meet identified requirements, (2) identify what factors affected the time to provide truck armor, and (3) identify what actions the Department of Defense (DOD) and the Army have taken to improve the timely availability of truck armor. To address these objectives, GAO collected and analyzed supply data for medium and heavy tactical trucks used by Army forces."

Border Security: Key Unresolved Issues Justify Reevaluation of Border Surveillance Technology Program

A letter report issued by the Government Accountability Office with an abstract that begins "In September 2004, the Department of Homeland Security (DHS) established America's Shield Initiative (ASI)--a program that included a system of sensors, cameras, and databases formerly known as the Integrated Surveillance Intelligence System (ISIS)--to detect, characterize, and deter illegal breaches to the northern and southern U.S. borders. The goals of the ASI program were to address ISIS capability limitations and support the department's antiterrorism mission. In April 2005, department officials told GAO that ISIS was subsumed within ASI. By congressional mandate, GAO reviewed the program to determine (1) the operational needs that ASI was intended to address and DHS's plans for ASI, (2) the steps that DHS had taken to ensure that ASI was aligned with the department's enterprise architecture, and (3) the actions that DHS had taken to establish the capability to effectively manage ASI. In written comments, DHS agreed with a draft of this report, stating that it was factually correct in virtually all aspects. DHS also commented that it has ceased work on ASI and redirected resources to its Secure Border Initiative. It also described program management corrective actions that it plans to implement."

Testimony issued by the Government Accountability Office with an abstract that begins "The judiciary pays over $900 million in rent annually to GSA for court-related space, representing a growing proportion of the judiciary's budget. The judiciary's rent payments are deposited into GSA's Federal Buildings Fund (FBF), a revolving fund used to finance GSA's real property services, including the construction and repair of federal facilities under GSA control. In December 2004, the judiciary requested a $483 million dollar permanent, annual rent exemption which GSA denied, saying that it undermined the intent of FBF and that GSA was unlikely to obtain appropriations to replace lost FBF income. GAO reviewed (1) recent trends in the judiciary's rent and space occupied and (2) challenges that the judiciary faces in managing its rent costs."

Improper Payments: Progress Made but Challenges Remain in Estimating and Reducing Improper Payments

Testimony issued by the Government Accountability Office with an abstract that begins "GAO's work over the past several years has demonstrated that improper payments are a long-standing, widespread, and significant problem in the federal government. The Improper Payments Information Act of 2002 (IPIA) has increased visibility over improper payments by requiring executive branch agency heads, using guidance from the Office of Management and Budget, to identify programs and activities susceptible to significant improper payments, estimate amounts improperly paid, and report on the amounts of improper payments and their actions to reduce them. This testimony addresses (1) progress made in agencies' implementation of IPIA for fiscal year 2008, and (2) several major challenges that continue to hinder full reporting of IPIA information. GAO was also asked to provide an overview of Medicare and Medicaid programs' implementation of IPIA. This testimony is based primarily on GAO products, Office of Inspector General (OIG) audit reports, and agencies' fiscal year 2008 reported improper payment information, including information reported by the Department of Health and Human Service's (HHS) Centers for Medicare and Medicaid Services (CMS).
