This report discusses selected legal issues that frequently arise in the context of recent legislation to address vulnerabilities of critical infrastructure to cyber threats, efforts to protect government networks from cyber threats, and proposals to facilitate and encourage sharing of cyber threat information amongst private sector and government entities. This report also discusses the degree to which federal law may preempt state law.

Military Justice: Courts-Martial, An Overview

Recent high profile military-related cases involving U.S. armed forces in Afghanistan, including the deadly attack on Afghan civilians allegedly by a service member, the accidental burning of the Quran, and service members allegedly urinating on Afghan corpses, have resulted in increased public and congressional interest in military discipline and the military justice system. The Uniform Code of Military Justice (UCMJ) authorizes three types of courts-martial: (1) summary court-martial; (2) special court martial; and (3) general court-martial. Depending on the severity of the alleged offense, the accused's commanding officer enjoys great discretion with respect to the type of court-martial to convene. This report discusses the court martial procedure in further detail.

Interview with Cece Cox, Executive Director of Resource Center of Dallas and longtime activist in the LGBT community. The interview includes Cox's personal experiences of childhood in Bartlesville, Oklahoma, her college years at Northwestern University, and coming out the family, friends, and co-workers. Cox talks about the awareness of her sexual orientation, the supportive reactions of family, her decision to move to Dallas, Texas for a job, her involvement in the Dallas LGBT community, thoughts on Texas Penal Code 21.06-the Sodomy Law, the struggle for gay men to receive AIDS treatment at Parkland Memorial Hospital, Dallas Gay Alliance's activism in AIDS treatment and care as well as in the struggle for equal treatment and human rights. Additionally, Cox talks about her impressions of Don Baker, Judge Jerry Buchmeyer and his decision to overturn penal code 21.06, changes in Dallas's LGBT community, family life, and Resource Center Dallas's history and services. The interview also includes an appendix with articles, Vol. 4, No. 2 of the THRF News newsletter, and a certificate of incorporation for the Foundation For Human Understanding.

Nuclear Nonproliferation: Further Actions Needed by U.S. Agencies to Secure Vulnerable Nuclear and Radiological Materials

Testimony issued by the Government Accountability Office with an abstract that begins "The President’s 4-year initiative is a worthwhile effort designed to accelerate U.S. and international efforts to secure nuclear material worldwide. However, as GAO reported in December 2010, the governmentwide strategy approved by the National Security Council (NSC) for the initiative lacked specific details regarding how the initiative will be implemented. As a result, key details associated with the initiative are unclear, including its overall estimated cost, time frame for completion of work, and scope of planned work. In its 2010 report, GAO recommended, among other things, that NSC lead the interagency development of a more detailed implementation plan for the President’s 4-year initiative. NSC did not comment on GAO’s recommendations."
