Emergency Communications Legislation, 2002-2006: Implications for the 110th Congress

Since September 11, 2001, several bills introduced in the U.S. Congress have included provisions to assist emergency communications. Key provisions from a number of these bills have become law. This report summarizes progress in developing legislation, especially in the 109th Congress, in three areas of emergency communications: communications among first responders and other emergency personnel; emergency warnings and alerts; and 911 call centers and systems. Each area could be the subject of further consideration in the 110th Congress, through oversight, additional legislation, or funding.

Excited Utterances, "Testimonial" Statements, and the Confrontation Clause

The United States Supreme Court will hear oral argument this term in appeals from two state supreme court cases, Hammon v. Indiana and Davis v. Washington, concerning the admissibility of “excited utterance” statements made by non-testifying witnesses at criminal trials. In the landmark Crawford v. Washington case in 2004, the Court held that the Sixth Amendment’s Confrontation Clause forbids hearsay “testimonial” evidence from being introduced against the accused unless the witness is unavailable to testify and the defendant has had a prior opportunity to crossexamine the witness. However, the Crawford Court declined to provide a comprehensive definition of “testimonial,” leaving such task “for another day.”

U.S.-China economic ties have expanded substantially over the past several years. China is now the third largest U.S. trading partner, its second largest source of imports, and its fourth largest export market. However, U.S.-China commercial ties have been strained by a number of issues, including a surging U.S. trade deficit with China, China's refusal to float its currency, and failure to fully comply with its World Trade Organization (WTO) commitments, especially its failure to provide protection for U.S. intellectual property rights (IPR). This report explores these issues in detail, especially concerning the lack of protection for U.S. IPR.

China's Economic Conditions

China’s economy remained relatively healthy in 2002, despite economic slowdowns in other parts of the world. Foreign investment continued to pour into China, and the Chinese government effectively used public spending to boost the economy. However, painful economic reforms will be necessary to keep the economic strong in 2003 and beyond. The recent outbreak in early 2003 of a very contagious virus called SevereAcuteRespiratory Syndrome (SARS) in China appears to have had a short-term negative impact on the Chinese economy.

Initiated in part as a proposal to reform U.S. high schools, concurrent enrollment programs enable high school aged students to take college level course work and receive college credit while enrolled in high school. Concurrent enrollment programs can be best described as a secondary/postsecondary school hybrid. This report provides a brief history of these programs and a description of the different types of programs, including participation data.
