Courthouse Construction: Sufficient Data and Analysis Would Help Resolve the Courtroom-Sharing Issue

A letter report issued by the General Accounting Office with an abstract that begins "The judiciary is in the midst of a multibillion-dollar courthouse construction program. New courthouses are being built to house new judgeships created because of increasing caseloads and to replace obsolete courthouses occupied by existing judges. For years, there has been a debate about whether district judges could share courtrooms to save taxpayer dollars without compromising judicial administration. In 1997, GAO issued a report calling for better courtroom use data and analysis to enhance facility planning. In response, the Administrative Office of the U.S. Courts (AOUSC) contracted with Ernst & Young to study the judiciary's facilities program in 1999. As part of the study, AOUSC asked Ernst & Young to analyze courtroom utilization, assignment, and sharing by judges. GAO found that the Ernst & Young study did not provide the type of data and analysis that GAO and other research organizations, such as the Rand Institute for Civil Justice and the Federal Judicial Center, have determined would be needed to help resolve the courtroom-sharing issue."

However, DOD has not been taking steps critical to ensuring that it gets the best services at the best prices. GAO's review of 22 DOD orders revealed that 17 of them were placed without seeking competitive quotes. GSA's established procedures require that agencies seek competitive quotes to ensure that the government gets the best price for IT services. Many DOD contracting officers were unaware of this requirement and placed orders under FSS contracts without seeking quotes from multiple contractors. The Federal Acquisition Regulation covering FSS contracts does not provide clear guidance to contracting officers on these special ordering procedures."

Biennial Budgeting: Three States' Experiences

A letter report issued by the General Accounting Office with an abstract that begins "Members of Congress periodically have expressed interest in converting the federal budget process from an annual to a biennial cycle. Congress believes that the time spent on these activities has come at the expense of congressional oversight and authorization responsibilities. To better understand states' experiences with the biennial budget cycle, GAO studied three states: Arizona, Ohio, and Connecticut. GAO found that the states' reasons for changing their budget cycles varied. For example, Arizona adopted a biennial cycle to increase legislative oversight and reduce time spent on the budget. Connecticut adopted it as part of a fiscal reform effort. To execute a biennial budget successfully, the states' experiences suggest that the legislative and executive branches must agree on how the off-year budget process will work. Different approaches to managing the off-year budget have been developed by states, including establishing formal guidelines for off-year budget changes and relying on leadership control. Efforts to increase legislative oversight in the off-year by converting to a biennial budget process may be difficult.
