Regulation of Broadcast Indecency: Background and Legal Analysis

Two prominent television events in the past two years placed increased attention on the FCC and its indecency regulations. The airing of the 2003 Golden Globe Awards and the subsequent ruling by the FCC’s Enforcement Bureau, coupled with the controversy surrounding the 2004 Super Bowl halftime show, brought broadcast indecency to the forefront of the congressional agenda during the 108th Congress. Several bills were introduced, but not enacted, in the 108th Congress to increase the penalties imposed for broadcast indecency and to prohibit the broadcast of certain words and phrases in any grammatical form. Similar legislation has been introduced in the 109th Congress.

Aviation Security-Related Findings and Recommendations of the 9/11 Commission

In response to the 9/11 Commission’s aviation security-related recommendations, two bills — H.R. 5121 and H.R. 10 — introduced in the House contain several provisions to enhance aviation security. Additionally, floor amendments to S. 2845, the National Intelligence Reform Act of 2004, contain numerous aviation security provisions, many of which address 9/11 Commission recommendations related to aviation safety. S. 2845 was passed (96-2) by the Senate on October 6, 2004. The House passed H.R. 10 on October 8 by a vote of 282-134. A conference has been requested to resolve numerous differences between H.R. 10 and S. 2845.

Defense Outsourcing: The OMB Circular A-76 Policy

This report provides information on the Office of Management and Budget’s (OMB) Circular A-76, “Performance of Commercial Activities,” and the impact of a related reform initiative, the Federal Activities Inventory Reform Act (FAIR) of 1998, within the Department of Defense. The Circular defines federal policy for determining whether recurring commercial activities should be outsourced to commercial sources, Governmental facilities, or through inter-service support agreements. The FAIR Act creates statutory reporting requirements for federal executive agencies, by requiring Federal executive agencies to identify activities “not inherently governmental” and consider outsourcing through managed competitions. However, FAIR does not require that agencies contract out these activities.

Recruiting and Retention: An Overview of FY2004 and FY2005 Results for Active and Reserve Component Enlisted Personnel

This report provides a brief overview of the recruiting and retention rates for Active and Reserve Component enlisted personnel during FY2004 and the first eight months of FY2005. Since the September 11, 2001 attacks on the World Trade Center and the Pentagon, the United States has launched several major military operations which have dramatically increased the operations tempo of the military services, required the large scale mobilization of reservists, and resulted in significant battle casualties. These factors have been particularly applicable to the Army, Army Reserve, and Army National Guard which have shouldered the bulk of the manpower burden associated with the occupation of Iraq. The Marine Corps and Marine Corps Reserve has also been heavily involved in Iraq. Many observers have expressed concern that these factors might lead to lower recruiting and retention rates, thereby jeopardizing the vitality of today’s all-volunteer military. Recruiting and retention results for FY2004 and FY2005 to date are summarized below. This report will be updated as necessary.

Deficit Impact of Reconciliation Legislation Enacted in 1990, 1993, and 1997

The budget reconciliation process is an optional procedure that operates as an adjunct to the annual budget resolution process. The FY2006 budget resolution, H.Con.Res. 95, includes reconciliation instructions affecting mandatory spending and revenues. For the first time since 1997, reconciliation is proposed to reduce mandatory spending as part of a deficit-reduction plan. As background on past efforts in this regard, the deficit impact of three major reconciliation acts enacted in the 1990s is briefly summarized.

Immigration Policy on Expedited Removal of Aliens

Expedited removal, an immigration enforcement strategy originally conceived to operate at the borders and ports of entry, is being expanded, raising a set of policy, resource, and logistical questions. Expedited removal is a provision under which an alien who lacks proper documentation or has committed fraud or willful misrepresentation of facts may be removed from the United States without any further hearings or review, unless the alien indicates a fear of persecution. Congress added expedited removal to the Immigration and Nationality Act (INA) in 1996, making it mandatory for arriving aliens, and giving the Attorney General the option of applying it to aliens in the interior of the country who have not been admitted or paroled into the United States and who cannot affirmatively show that they have been physically present in the United States continuously for two years. Until recently, expedited removal was only applied to aliens at ports of entry.

The Availability of Judicial Review Regarding Military Base Closures and Realignments

The 2005 round of military base realignments and closures (BRAC) is now underway. The Defense Base Closure and Realignment Act of 1990 (Base Closure Act), as amended, establishes mandatory procedures to be followed throughout the BRAC process and identifies criteria to be used in formulating BRAC recommendations. However, judicial review is unlikely to be available to remedy alleged failures to comply with the Base Closure Act’s provisions. This report includes a synopsis of the relevant law regarding the availability of judicial review in this context.
