The Department of Defense Rules for Military Commissions: Analysis of Procedural Rules and Comparison with Proposed Legislation and the Uniform Code of Military Justice

This report provides a background and analysis comparing military commissions as envisioned under M.C.O. No. 1 to general military courts-martial conducted under the UCMJ. The report notes some of the criticism directed at the President’s M.O., and explains how those concerns are addressed by the military commission orders and instructions. The report provides two charts to compare the regulations issued by the Department of Defense and standard procedures for general courts-martial under the Manual for Courts-Martial. The second chart, which compares procedural safeguards incorporated in the regulations with established procedures in courts martial, follows the same order and format used in CRS Report RL31262, Selected Procedural Safeguards in Federal, Military, and International Courts, in order to facilitate comparison with safeguards provided in federal court and the International Criminal Court.

The Individuals with Disabilities Education Act (IDEA): Proposed Regulations for P.L. 108-446

The 108th Congress passed P.L. 108-446, which reauthorized and revised the Individuals with Disabilities Education Act (IDEA). IDEA is the major federal the statute authorizing funds for special education and related services for children with disabilities and providing detailed due process provisions to ensure that these children receive a free appropriate public education (FAPE). Although much of the the basic structure of IDEA has been retained, P.L. 108-446 does make a number of significant changes. Among these are the definition of “highly qualified” teachers, calculation of maximum state grants, funding for high-need children with disabilities, revised state performance goals and requirements for children’s participation in state and local assessments, changes in the private school provisions, exceptions to certain financial requirements, changes in procedural safeguards, and changes in compliance monitoring to focus on student performance.

Embryonic stem cells have the ability to develop into virtually any cell in the body and they may have the potential to treat medical conditions such as diabetes and Parkinson’s disease. In August 2001, President Bush announced that for the first time federal funds would be used to support research on human embryonic stem cells, but funding would be limited to “existing stem cell lines.”

Climate Change Legislation in the 109th Congress

Climate change and greenhouse gas (GHG) emissions are a continuing issue in the 109th Congress. Bills directly addressing climate change issues range from those focused primarily on climate change research to comprehensive emissions cap-and-trade programs. Additional bills focus on GHG reporting and registries, or on power plant emissions of carbon dioxide, as part of wider controls on pollutant emissions. The bills vary in their approaches to climate change issues. This report briefly discusses the basic concepts on which these bills are based and compares major provisions of the bills in each of the following categories: climate change research, technology deployment, GHG reporting and registries, and emissions reduction programs.

Iran's Nuclear Program: Recent Developments

Since 2003, the International Atomic Energy Agency (IAEA) inspections of Iran’s nuclear program have revealed significant undeclared activities with potential applications for nuclear weapons, including uranium enrichment facilities and plutonium separation efforts. Also since 2003, Iran has been negotiating with Germany, France, and the UK (EU-3) for a wide range of assistance in exchange for a halt to such activities. Yet, most evidence indicates that Iran has never completely suspended its enrichment activities, raising the question of whether Iran is buying time to build nuclear weapons.

The Senate follows a well-established routine on the opening day of a new Congress. The proceedings include swearing in new members, administrative business, and election of the President pro tempore, the constitutionally mandated officer elected to preside over the chamber in the absence of the Vice President. Other first day activities are dependent on specific circumstances and do not occur on the first day of every new Congress. Once these proceedings are completed, the Senate may then turn to routine business. The Senate committee assignment process begins prior to the convening of a new Congress.

Revenue Reconciliation Directives to the Senate Finance Committee in Congressional Budget Resolutions

During the more than 30 years that the congressional budget process has been in effect, the Senate Finance Committee has been subject to revenue reconciliation directives in a budget resolution on 18 occasions. Nine instances involved directives to reduce revenues, while the remaining nine instructed the committee to increase revenues. In all but three of the 18 instances, revenue reconciliation directives to the committee were accompanied by spending reconciliation directives.
