Congressional Authority Over the Federal Courts

This report examines Congress' legislative authority with respect to the Judicial Branch. While Congress has broad power to regulate the structure, administration and jurisdiction of the courts, its powers are limited by precepts of due process, equal protection and separation of powers. This report addresses the constitutional foundation of the federal courts, and the explicit and general authorities of Congress to regulate the courts. It then addresses Congress’ ability to limit the jurisdiction of the courts over particular issues, sometimes referred to as “court-stripping.” The report then analyzes Congress’ authority to regulate the availability of certain judicial processes and remedies for litigants. Congressional power to legislate regarding specific judicial decisions is also discussed.

Responding to concerns that human activities are increasing concentrations of “greenhouse gases” (such as carbon dioxide and methane) in the atmosphere, most nations of the world joined together in 1992 to sign the United Nations Framework Convention on Climate Change (UNFCCC). The United States was one of the first nations to ratify this treaty. It included a legally non-binding, voluntary pledge that the major industrialized/developed nations would reduce their greenhouse gas emissions to 1990 levels by the year 2000, and that all nations would undertake voluntary actions to measure, report, and limit greenhouse gas emissions.

New Zealand and the United States continue to have strong ties despite some differences. These close ties are based on shared cultural traditions and values. Differences between the United States and New Zealand emerged in the mid-1980s over New Zealand’s policy to ban nuclear-armed and nuclear-powered ships from its ports. This led to a de facto split between the United States and New Zealand within the context of the Australia-New Zealand-United States (ANZUS) alliance. Despite this issue, New Zealand is a regular contributor to international peace operations and has contributed troops to the war against terror in Afghanistan and to assist reconstruction efforts in Iraq.

Identity Theft: The Internet Connection

Concern is growing about identity theft — where one person assumes the identity of another by stealing personally identifiable information (PII), such as credit card or Social Security numbers. High profile incidents disclosed in early 2005 involving ChoicePoint, Bank of America, and LexisNexis, where the PII of more than a million Americans may have been compromised, have refocused congressional attention on this issue. Many associate the rise in identity theft cases with the Internet, but surveys indicate that comparatively few victims cite the Internet as the source of their stolen PII. Still, the Internet may play a role, particularly through a practice known as “phishing.” Congress already has passed several laws to address identity theft, and continues to debate whether additional action is needed. Several environmental statutes contain national security exemptions, which the Department of Defense (DOD) can obtain on a case-by-case basis. Since FY2003, DOD has sought broader exemptions that it argues are needed to preserve training capabilities and ensure military readiness. There has been disagreement in Congress over the need for broader exemptions in the absence of data on the overall impact of environmental requirements on training and readiness.
