This report briefly summarizes the process of amendments between the House of Representatives and the Senate, which occurs if the House and Senate approve differing versions of a measure. The House and Senate must approve an identical version of a measure before it may be presented for the President's approval or veto. If the House and Senate approve differing versions of a measure, the differences must first be resolved.

This is one report in the series of reports that discuss the campaign finance practices and related issues. Concerns over financing federal elections have become a seemingly perennial aspect of our political system, centered on the enduring issues of high campaign costs and reliance on interest groups for needed campaign funds. Federally supported child nutrition programs and related activities — including school meal programs and the Special Supplemental Nutrition Program for Women, Infants, and Children (the WIC program) — reach over 37 million children and almost 2 million lower-income pregnant/postpartum women. In FY2004, anticipated spending on these programs is $16.6 billion, and the FY2004 appropriations law (P.L. 108-199) supports this spending level (although with new appropriations of a lesser amount, some $16 billion). The Administration’s FY2005 revised budget request envisions spending a total of $17.15 billion, supported by new appropriations of $16.47 billion. The House FY2005 appropriations bill (H.R. 4766) would support spending of $16.97 billion with new appropriations of $16.29 billion.

U.S.-China economic ties have expanded substantially over the past several years. China is now the third largest U.S. trading partner, its second largest source of imports, and its fourth largest export market. However, U.S.-China commercial ties have been strained by a number of issues, including a surging U.S. trade deficit with China, China's refusal to float its currency, and failure to fully comply with its World Trade Organization (WTO) commitments, especially its failure to provide protection for U.S. intellectual property rights (IPR). This report explores these issues in detail, especially concerning the lack of protection for U.S. IPR.

Interruptions of congressional operations by incidents such as episodic computer virus infections and the 2001 anthrax contamination, the February 2004 ricin incident have demonstrated the importance of congressional continuity of operations (COOP) planning. This report discusses the circumstances surrounding COOP planning, including provisions for alternative meeting sites and methods for conducting House and Senate meetings and floor sessions when Capitol facilities are not available.

The 2002 farm bill (P.L. 107-171) as modified by the FY2004 USDA appropriation (P.L. 108-199) requires country-of-origin labeling (COOL) for fresh produce, red meats, and peanuts starting September 30, 2006, and for seafood starting September 30, 2004. The House Agriculture Committee approved on July 21, 2004, a bill (H.R. 4576) to make COOL voluntary. Some lawmakers still support a mandatory program, especially after recent discoveries of “mad cow” disease in a Canadian and a U.S. cow (the latter from Canada). Others counter that COOL is a marketing, not an animal or human health, issue and should be voluntary.

Data mining is emerging as one of the key features of many homeland security initiatives. Often used as a means for detecting fraud, assessing risk, and product retailing, data mining involves the use of data analysis tools to discover previously unknown, valid patterns and relationships in large data sets. This report examines the legislative debate over giving FDA the authority to regulate tobacco products and provides some analysis of S. 2461/H.R. 4433. It begins with an overview of the FDA’s 1996 tobacco rule that includes a summary of the agency’s arguments for asserting jurisdiction over tobacco products. That is followed by an analysis of the U.S. Supreme Court decision in FDA v. Brown & Williamson, which overturned the FDA tobacco rule. The report then reviews the 1997 proposed national tobacco settlement, which would have codified the FDA rule and given the agency explicit authority to regulate tobacco products as medical devices.
