Freedom of Speech and Press: Exceptions to the First Amendment

The First Amendment to the United States Constitution provides that “Congress shall make no law . . . abridging the freedom of speech, or of the press. . . .” This language restricts government both more and less than it would if it were applied literally. It restricts government more in that it applies not only to Congress, but to all branches of the federal government, and to all branches of state and local government. It restricts government less in that it provides no protection to some types of speech and only limited protection to others. This report provides an overview of the major exceptions to the First Amendment — of the ways that the Supreme Court has interpreted the guarantee of freedom of speech and press to provide no protection or only limited protection for some types of speech.

Social Security: The Windfall Benefit Provision

This report discusses the windfall elimination provision, which reduces the Social Security benefits of workers who also have pension benefits from employment not covered by Social Security. Its purpose is to remove an advantage these workers would otherwise receive because of Social Security's benefit formula that favors workers with smaller amounts of Social Security-covered career earnings. Opponents contend that the provision is basically inaccurate and often unfair. In both the 107th and 108th Congresses, five bills have been introduced that would modify or repeal the provision.

Child Support Enforcement: New Reforms and Potential Issues

P.L. 104-193 (the 1996 welfare reform legislation) made major changes to the Child Support Enforcement (CSE) program. Some of the changes include requiring states to increase the percentage of fathers identified, establishing an integrated, automated network linking all states to information about the location and assets of parents, and requiring states to implement more enforcement techniques to obtain collections from debtor parents. Additional legislative changes were made in 1997, 1998, and 1999, but not in 2000, 2001, 2002, or 2003. This report describes several aspects of the revised CSE program and discusses three issues that probably will be reexamined by the 108th Congress — CSE financing, parental access by noncustodial parents, and distribution of support payments.

Pension plans sponsored by the federal, state, and local governments, or by churches generally are exempt from ERISA.

Dual-Use Biological Equipment: Difficulties in Domestic Regulation

A question in the current debate over chemical and biological terrorism is: how well do current United States policies limit opportunities to terrorist groups for acquisition of such weapons? The domestic purchase and use of “dual-use” biological equipment, such as fermenters, centrifuges, and other equipment, is one area suggested as potentially providing opportunities for terrorist, biological weapons development. Dual-use equipment has both legitimate civilian and military use. Regulating international sale of dual-use equipment is used as a nonproliferation policy tool. Similar regulation of domestic sales has not been employed. This report will discuss the difficulties of applying domestic controls on dual-use biological equipment and the potential advantages and disadvantages of doing so.
