This report discusses constitutional and other legal issues related to the creation and implementation of location-based preferences in federal contracting, as well as summarizes key authorities requiring or allowing federal agencies to "favor" contractors located in specific places. The report does not address federal preferences for domestic products or provisions of federal law that could, depending upon their implementation, effectively prefer local contractors, such as project labor agreements.

In July 2008, a new temporary unemployment benefit, the Emergency Unemployment Compensation (EUC08) program, began. The most recent legislation, P.L. 111-205, extended the authorization of the EUC08 program, but did not change the structure of the program or augment benefits. This temporary unemployment insurance program provides up to 20 additional weeks of unemployment benefits to certain workers who have exhausted their rights to regular unemployment compensation (UC) benefits. This report discusses the various tiers of the EUC08 program, as well as related legislation. This report will be updated to reflect current congressional action or programmatic changes.

The proposed U.S.-Colombia Trade Promotion Agreement, also called the U.S.-Colombia Free Trade Agreement (CFTA), is a bilateral free trade agreement between the United States and Colombia which, if ratified, would eliminate tariffs and other barriers in goods and services between the two countries. The CFTA negotiations grew out of a regional effort in 2004 to produce a U.S.-Andean free trade agreement (FTA) between the United States and the Andean countries of Colombia, Peru, and Ecuador. In his January 2010 State of the Union address, President Barack Obama called for a new National Export Initiative (NEI) to boost U.S. exports and create jobs. One component of the NEI calls for opening new markets for U.S. exports by resolving outstanding issues with Colombia, Korea, and Panama with the objective of moving forward with the pending FTAs at the appropriate time. There is currently no indication that the 111th Congress will consider implementing legislation for the proposed U.S.-Colombia FTA.

This report provides an overview of the various contract types (e.g., fixed-price, cost-reimbursement) used in federal procurement and the legal requirements and issues pertaining to each. Current congressional and public interest in contract types is, in part, an outgrowth of the reported increase in the use of cost-reimbursement contracts during the George W. Bush Administration1 and the Obama Administration's proposal to reduce by at least 10% the funds obligated in FY2010 by "high risk-contracting authorities," such as cost-reimbursement, time-and-materials, and labor-hour contracts.

This report is divided into two segments. The first section provides the most recent information on the FY2011 continuing resolution. The second segment focuses on the (1) history and recent trends, including the nature, scope, and duration of CRs during the past 35 years; (2) CR types by duration; (3) major substantive legislative provisions included in some CRs; and (4) funding gaps.

This report discusses the President's Fiscal Year (FY) 2011 budget request for the Military Construction, Veterans Affairs, and Related Agencies appropriations bill, which provides funding for the planning, design, construction, alteration, and improvement of facilities used by active and reserve military components worldwide.

On March 31, 2010, the Office of Federal Procurement Policy (OFPP) in the Office of Management and Budget (OMB) issued a proposed policy letter on inherently governmental functions and other "work reserved for performance by federal government employees." While not final, the policy letter represents the Obama Administration's proposed guidance for agencies determining (1) whether particular functions are inherently governmental and (2) when functions closely associated with the performance of inherently governmental functions and critical functions should be performed by government personnel. The proposed policy letter raises several legal and policy issues of potential interest to Congress, given recently enacted and proposed legislation regarding inherently governmental functions and other limitations upon contracting out.

A letter report issued by the Government Accountability Office with an abstract that begins "The Departments of Defense (DOD) and State and the U.S. Agency for International Development (USAID) have relied extensively on contracts, grants, and cooperative agreements for a wide range of services in Afghanistan and Iraq. However, as GAO previously reported, the agencies have faced challenges in obtaining sufficient information to manage these contracts and assistance instruments. As part of our third review under the National Defense Authorization Act for Fiscal Year (FY) 2008, as amended, GAO assessed the implementation of the Synchronized Predeployment and Operational Tracker (SPOT) and data reported by the three agencies for Afghanistan and Iraq for FY 2009 and the first half of FY 2010 on the (1) number of contractor and assistance personnel, including those providing security; (2) number of personnel killed or wounded; and (3) number and value of contracts and assistance instruments and extent of competition for new awards. GAO compared agency data to other available sources to assess reliability."

This report discusses the standards and procedures that federal agencies use in making responsibility determinations under the Federal Acquisition Regulation (FAR). It discusses (1) how responsibility determinations relate to other mechanisms that the government relies upon to ensure that contractors are responsible and otherwise eligible for federal contracts; (2) the performance-related and collateral standards used in making responsibility determinations; (3) the procedures for making responsibility determinations; and (4) recently enacted or proposed amendments to the standards or procedures for responsibility determinations.

This report provides an overview of the economic issues surrounding the current debate over China's currency policy. It identifies the economic costs and benefits of China's currency policy for both China and the United States, and possible implications if China were to allow its currency to significantly appreciate or to float freely. It also examines proposed legislation in the 111th Congress that seek to address China's currency policy.

The Kurdish-inhabited region of northern Iraq is relatively peaceful and prospering economically, but the Iraqi Kurds' political autonomy and political strength in post- Saddam Iraq is causing friction with Arab leaders in Iraq, Turkey, and Iran. However, an overall reduction in violence in Iraq, coupled with continued U.S. political influence over the Kurds, is likely to prevent a destabilizing escalation of the Iraqi Kurd-Arab disputes. The status and the most important issues in neutrino physics will be summarized as well as how the current, pressing questions will be addressed by future experiments. Since the discovery of neutrino flavor transitions by the SuperKamiokande experiment in 1998, which demonstrates that neutrinos change and hence their clocks tick, i.e. they are not traveling at the speed of light and hence are not massless, the field of neutrino physics has made remarkable progress in untangling the nature of the neutrino. However, there are still many important questions to answer.

We report results on lithium alumino-silicate ion source development in preparation for warmdense-matter heating experiments on the new Neutralized Drift Compression Experiment (NDCXII). The practical limit to the current density for a lithium alumino-silicate source is determined by the maximum operating temperature that the ion source can withstand before running into problems of heat transfer, melting of the alumino-silicate material, and emission lifetime. Using small prototype emitters, at a temperature of ~;;1275 oC, a space-charge-limited Li+ beam current density of J ~;;1 mA/cm2 was obtained. The lifetime of the ion source was ~;;50 hours while pulsing at a rate of 0.033 Hz with a pulse duration of 5-6 mu s.

This conceptual design report addresses development of replacement remote-handled low-level waste disposal capability for the Idaho National Laboratory. Current disposal capability at the Radioactive Waste Management Complex is planned until the facility is full or until it must be closed in preparation for final remediation (approximately at the end of Fiscal Year 2017). This conceptual design report includes key project assumptions; design options considered in development of the proposed onsite disposal facility (the highest ranked alternative for providing continued uninterrupted remote-handled low level waste disposal capability); process and facility descriptions; safety and environmental requirements that would apply to the proposed facility; and the proposed cost and schedule for funding, design, construction, and operation of the proposed onsite disposal facility.

GRIDS Project: USC is developing an iron-air rechargeable battery for large-scale energy storage that could help integrate renewable energy sources into the electric grid. Iron-air batteries have the potential to store large amounts of energy at low cost—iron is inexpensive and abundant, while oxygen is freely obtained from the air we breathe. However, current iron-air battery technologies have suffered from low efficiency and short life spans. USC is working to dramatically increase the efficiency of the battery by placing chemical additives on the battery’s iron-based electrode and restructuring the catalysts at the molecular level on the battery’s air-based electrode. This can help the battery resist degradation and increase life span. The goal of the project is to develop a prototype iron-air battery at significantly cost lower than today’s best commercial batteries.

Inspired by recent photoelectron spectroscopy (PES) experiments on hydroxide solutions, we have examined the conditions necessary for enhanced (and, in the case of solutions, detectable) intercoulombic decay (ICD)--Auger emission from an atomic site other than that originally excited. We present general guidelines, based on energetic and spatial overlap of molecular orbitals, for this enhancement of ICDbased energy transfer in solutions. These guidelines indicate that this decay process should be exhibited by broad classes of biomolecules and suggest a design criterion for targeted radiooncology protocols. Our findings show that PES cannot resolve the current hydroxide coordination controversy.
