Catastrophe Risk: U.S. and European Approaches to Insure Natural Catastrophe and Terrorism Risks

A letter report issued by the Government Accountability Office with an abstract that begins "Natural catastrophes and terrorist attacks can place enormous financial demands on the insurance industry, result in sharply higher premiums and substantially reduced coverage. As a result, interest has been raised in mechanisms to increase the capacity of the insurance industry to manage these types of events. In this report, GAO (1) provides an overview of the insurance industry's current capacity to cover natural catastrophic risk and discusses the impacts of the 2004 hurricanes; (2) analyzes the potential of catastrophe bonds--a type of security issued by insurers and reinsurers (companies that offer insurance to insurance companies) and sold to institutional investors--and tax-deductible reserves to enhance private-sector capacity; and (3) describes the approaches that six European countries have taken to address natural and terrorist catastrophe risk, including whether these countries permit insurers to use tax-deductible reserves for such events. We provided a draft of this report to the Department of the Treasury and the National Association of Insurance Commissioners. Treasury provided technical comments that were incorporated as appropriate."

A letter report issued by the Government Accountability Office with an abstract that begins "In 1999, the Department of Health and Human Services' (HHS) Centers for Disease Control and Prevention (CDC) began funding jurisdictions' efforts to prepare for bioterrorism attacks through the Public Health Preparedness and Response for Bioterrorism program. After the events of September 11, 2001, and the 2001 anthrax incidents, program funds increased almost twentyfold. Citing jurisdictions' unexpended program funds, HHS reallocated some fiscal year 2004 funds to support other local and national bioterrorism initiatives. Jurisdictions and associations representing jurisdictions disputed HHS's assertion that large amounts of funds remain unused, noting that HHS did not acknowledge obligated funds that had not yet been expended. Correspondence issued by the Government Accountability Office with an abstract that begins "In the National Defense Authorization Act for Fiscal Year 2000, Congress directed the Department of Defense (DOD) to develop a laser master plan to include identification of potential weapon applications, critical technologies, a development path for those critical technologies, and the funding required to carry out the master plan. In response to this legislation, the High Energy Laser (HEL) Executive Review Panel was formed and issued the HEL Master Plan on March 24, 2000. The Master Plan recommended establishing a management structure for HEL technologies, including a HEL Joint Technology Office (JTO) to execute development and day-to-day management of a joint program to revitalize HEL technologies. The plan also recommended establishment of a HEL Technology Council--composed of senior science and technology executives from the military services and agencies--to provide oversight and approval authority for JTO's programs. As a result of the Master Plan, JTO was formed in June 2000. A letter report issued by the Government Accountability Office with an abstract that begins "Since 1998, GAO has issued numerous reports on nursing home quality and safety that identified significant weaknesses in federal and state oversight. Under contract with the Centers for Medicare & Medicaid Services (CMS), states conduct annual nursing home inspections, known as surveys, to assess compliance with federal quality and safety requirements. States also investigate complaints filed by family members or others in between annual surveys. When state surveys find serious deficiencies, CMS may impose sanctions to encourage compliance with federal requirements. GAO was asked to assess CMS's progress since 1998 in addressing oversight weaknesses. GAO (1) reviewed the trends in nursing home quality from 1999 through January 2005, (2) evaluated the extent to which CMS's initiatives have addressed survey and oversight problems identified by GAO and CMS, and (3) identified key challenges to continued progress in ensuring resident health and safety. GAO assessed the New Starts process for the fiscal year 2006 cycle. A letter report issued by the Government Accountability Office with an abstract that begins "Medicaid--the federal-state health care financing program covering nearly 54 million low-income people at a cost of $276 billion in fiscal year 2003--is by its size and structure at risk of waste and exploitation. Because of challenges inherent in overseeing the program, administered federally by the Centers for Medicare & Medicaid Services (CMS), GAO in 2003 added Medicaid to its list of high-risk federal programs. To help administer the program, states may employ consultants in a number of roles, sometimes under contracts whereby payment is contingent upon the consultant's performance. GAO was asked to report on states' use of contingency-fee consultants. GAO examined the extent to which (1) states are using contingency-fee consultants for projects to maximize federal Medicaid reimbursements, (2) claims from contingency-fee projects in selected states are consistent with federal law and policy, and (3) states and CMS are overseeing claims from such projects."

A letter report issued by the Government Accountability Office with an abstract that begins "The Federal Aviation Administration (FAA) uses the Air Transportation Oversight System (ATOS), which was developed around the principles of system safety, to oversee seven "legacy airlines" and nine other airlines. In this report, we refer to airlines that are not in ATOS as non-legacy airlines. Two other processes are used to oversee 99 non-legacy passenger airlines, which represent a fast-growing segment of the commercial aviation passenger industry and carried about 200 million passengers in 2004. The National Work Program Guidelines (NPG) establishes a set of inspection activities for non-legacy airlines. The Surveillance and Evaluation Program (SEP) uses principles of system safety to identify additional risk-based inspections for those airlines. GAO's objective was to assess the processes used by FAA to ensure the safety of non-legacy passenger airlines. GAO reviewed the strengths of FAA's inspection oversight for non-legacy passenger airlines and the issues that hinder its effectiveness."

Drug Control: High Intensity Drug Trafficking Areas' Efforts to Link Investigations to International Drug Traffickers

A letter report issued by the Government Accountability Office with an abstract that begins "In fiscal year 2002, the Attorney General called upon law enforcement to target the "most wanted" international drug traffickers responsible for supplying illegal drugs to America. In September 2002, law enforcement, working through the multi-agency Organized Crime Drug Enforcement Task Force (OCDETF) Program, developed a list of these drug traffickers, known as the Consolidated Priority Organization Target List (CPOT), to aid federal law enforcement agencies in targeting their drug investigations. Also, the White House's Office of National Drug Control Policy (ONDCP) collaborated with law enforcement to encourage existing High Intensity Drug Trafficking Areas (HIDTA) to conduct CPOT investigations. According to ONDCP, the 28 HIDTAs across the nation are located in centers of illegal drug production, manufacturing, importation, or distribution. ONDCP distributed discretionary funds to supplement some HIDTAs' existing budgets beginning in fiscal year 2002 to investigate CPOT organizations. In addition, the resulting data supplied by states has not been accurate, timely, or conducive to assessing program performance. Consequently, DOD doctrine calls for U.S. forces to be sufficiently trained to continue their missions in an NBC-contaminated environment. Given longstanding concerns about the preparedness of DOD's servicemembers in this critical area, GAO has undertaken a body of work covering NBC protective equipment and training. For this review, GAO was asked to determine the following: (1) To what extent do Army and Marine Corps units and personnel attending combat training centers participate in NBC training, and to what extent do these units and personnel perform NBC tasks at the centers to service standards? The U.S. Postal Service (USPS) agreed to make improvements, but concerns remained that it is still unclear, from an overall perspective, what actions USPS has taken to improve data quality. Ratemaking data quality has also factored into congressional deliberations to reform postal laws. Thus, questions remain about USPS's actions to improve ratemaking data quality and how proposed legislation will address long-standing issues in this area. GAO was asked to (1) describe key USPS actions that were responsive to the Study to improve the quality of ratemaking data and (2) discuss possible implications of postal reform legislation for ratemaking data quality. GAO did not assess the extent to which USPS's actions affected data quality. In its comments, USPS disagreed with GAO's finding on the need to reform the ratemaking structure. USPS also differed on GAO's finding that the legislation would likely lead to improving ratemaking data quality. Radiation Exposure Compensation Act: Program Status

Correspondence issued by the Government Accountability Office with an abstract that begins "From 1945 through 1962, the United States conducted a series of above-ground atomic weapons tests as it built up its Cold War nuclear arsenal. Many people who were exposed to radiation resulting from the nuclear weapons development and testing program subsequently developed serious diseases, including various types of cancer. On October 15, 1990, in order to establish a procedure to make partial restitution to these victims for their suffering associated with the radiation exposure, the Radiation Exposure Compensation Act (RECA) was enacted. RECA provided that the Attorney General be responsible for processing and adjudicating claims under the act. The Department of Justice (DOJ) established the Radiation Exposure Compensation Program (RECP), which is administered by its Civil Division. RECP began processing claims in April 1992. RECA has been amended several times, including on July 10, 2000, when the RECA Amendments of 2000 were enacted. The amendments of 2000 broadened the scope of eligibility for benefits coverage to include new victim categories and modified the criteria for determining eligibility for compensation. A letter report issued by the Government Accountability Office with an abstract that begins "Since 1940, Congress has provided a statutory framework that requires aliens entering or residing in the United States to provide address information. By 1981, aliens who remain in the United States for 30 days or more were required to initially register and report their address information and then to report their change of address only if they move. In the months immediately following the terrorist attacks on September 11, 2001, federal investigators' efforts to locate and interview nearly one-half of the 4,112 nonimmigrant aliens they attempted to contact were impeded by lack of current address information. Nonimmigrant aliens are defined as those who seek temporary entry into the United States for a specific purpose, including those aliens who are in the country as students, international representatives, or temporary workers, or for business or pleasure. Because of growing concern over the government's need to locate aliens, the Enhanced Border Security and Visa Entry Reform Act of 2002 directed GAO to study the feasibility and the utility of a requirement that each nonimmigrant alien in the United States self-report a current address on a yearly basis."

Clean Air Act: Observations on EPA's Cost-Benefit Analysis of Its Mercury Control Options

A letter report issued by the Government Accountability Office with an abstract that begins "Mercury is a toxic element that can cause neurological disorders in children. In January 2004, the Environmental Protection Agency (EPA) proposed two options for limiting mercury from power plants, and plans to finalize a rule in March 2005. The first would require each plant to meet emissions standards reflecting the application of control technology (the technology-based option), while the second would enable plants to either reduce emissions or buy excess credits from other plants (the cap-and-trade option). EPA received over 680,000 written comments on the proposal. EPA is directed by statute and executive order to analyze the costs and benefits of proposed rules, and the agency summarized its analysis underlying the two options in the proposal. In this context, GAO was asked to assess the usefulness of EPA's economic analysis for decision making. In doing so, GAO neither independently estimated the options' costs and benefits nor evaluated the process for developing the options or their consistency with the Clean Air Act, as amended."

Performance Budgeting: PART Focuses Attention on Program Performance, but More Can Be Done to Engage Congress

A letter report issued by the Government Accountability Office with an abstract that begins "GAO was asked to examine (1) the Office of Management and Budget's (OMB) and agency perspectives on the effects that the Program Assessment Rating Tool (PART) recommendations are having on agency operations and program results; (2) OMB's leadership in ensuring a complementary relationship between the PART and the Government Performance and Results Act of 1993 (GPRA); and (3) steps OMB has taken to involve Congress in the PART process. To do this, we also followed up on issues raised in our January 2004 report on the PART."

National Assessment of Educational Progress Exclusion Rates for Students with Disabilities

Correspondence issued by the Government Accountability Office with an abstract that begins "In July 2005, we issued a report entitled No Child Left Behind Act: Most Students with Disabilities Participated in Statewide Assessments, but Inclusion Options Could Be Improved (GAO-05-618) in response to a Congressional request for information about inclusion of students with disabilities in the statewide assessments. We found that most states were including these students in the assessments. In addition, we reviewed the National Assessment of Education Progress (NAEP) data to determine the extent to which students with disabilities were included in this assessment. Also called "The Nation's Report Card," the NAEP has been used to track trends in student achievement over time or to compare student performance in a particular state with the national average. With the assistance of Department of Education (Education) officials, we interpreted that in 2002 five percent of students with disabilities were excluded from the NAEP reading assessment."
