Federal Recess Judges

This report discusses the recess clause and takes a look at the history of recess appointments. Under Article II of the Constitution, the President is empowered "to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session." Presidents have used the recess appointment power on more than 300 occasions to place judges on the district, appellate, and U.S. Supreme Court level. This practice slowed after the 1950s, but recent recess appointments to federal appellate courts (the Fourth, Fifth, and Eleventh Circuits) have revived a number of constitutional issues.

Design and evaluation of Nemesis, a scalable, low-latency, message-passing communication subsystem.

This paper presents a new low-level communication subsystem called Nemesis. Nemesis has been designed and implemented to be scalable and efficient both in the intranode communication context using shared-memory and in the internode communication case using high-performance networks and is natively multimethod-enabled. Nemesis has been integrated in MPICH2 as a CH3 channel and delivers better performance than other dedicated communication channels in MPICH2. Furthermore, the resulting MPICH2 architecture outperforms other MPI implementations in point-to-point benchmarks.

This letter partially answers the request in Reference (b) to provide unirradiated and irradiated material properties for beryllium, beryllium oxide, isotopically enriched boron carbide ({sup 11}B{sub 4}C) and lithium hydride. With the exception of {sup 11}B{sub 4}C, the information is provided in Attachments 1 and 2. At the time of issuance of this document, {sup 11}B{sub 4}C had not been studied.

Angle Resolved Photoemission Spectroscopy Studies of the Mott Insulator to Superconductor Evolution in Ca2-xNaxCuO2Cl2

It is widely believed that many of the exotic physical properties of the high-T{sub c} cuprate superconductors arise from the proximity of these materials to the strongly correlated, antiferromagnetic Mott insulating state. Therefore, one of the fundamental questions in the field of high-temperature superconductivity is to understand the insulator-to-superconductor transition and precisely how the electronic structure of Mott insulator evolves as the first holes are doped into the system. This dissertation presents high-resolution, doping dependent angle-resolved photoemission (ARPES) studies of the cuprate superconductor Ca{sub 2-x}Na{sub x}CuO{sub 2}Cl{sub 2}, spanning from the undoped parent Mott insulator to a high-temperature superconductor with a T{sub c} of 22 K. A phenomenological model is proposed to explain how the spectral lineshape, the quasiparticle band dispersion, and the chemical potential all progress with doping in a logical and self-consistent framework. This model is based on Franck-Condon broadening observed in polaronic systems where strong electron-boson interactions cause the quasiparticle residue, Z, to be vanishingly small. Comparisons of the low-lying states to different electronic states in the valence band strongly suggest that the coupling of the photohole to the lattice (i.e. lattice polaron formation) is the dominant broadening mechanism for the lower Hubbard band states. Evaluation of the Emission, Transport, and Deposition of Mercury, Fine Particulate Matter, and Arsenic from Coal-Based Power Plants in the Ohio River Valley Region

Ohio University, in collaboration with CONSOL Energy, Advanced Technology Systems, Inc (ATS) and Atmospheric and Environmental Research, Inc. (AER) as subcontractors, is evaluating the impact of emissions from coal-fired power plants in the Ohio River Valley region as they relate to the transport and deposition of mercury, arsenic, and associated fine particulate matter. This evaluation will involve two interrelated areas of effort: ambient air monitoring and regional-scale modeling analysis. The scope of work for the ambient air monitoring will include the deployment of a surface air monitoring (SAM) station in southeastern Ohio. The SAM station will contain sampling equipment to collect and measure mercury (including speciated forms of mercury and wet and dry deposited mercury), arsenic, particulate matter (PM) mass, PM composition, and gaseous criteria pollutants (CO, NOx, SO{sub 2}, O{sub 3}, etc.). Laboratory analysis of time-integrated samples will be used to obtain chemical speciation of ambient PM composition and mercury in precipitation. Near-real-time measurements will be used to measure the ambient concentrations of PM mass and all gaseous species including Hg{sup 0} and RGM. REMOTE MATERIAL HANDLING IN THE YUCCA MOUNTAIN WASTE PACKAGE CLOSURE CELL AND SUPPORT AREA GLOVEBOX

The Yucca Mountain Waste Package Closure System (WPCS) cells provide for shielding of highly radioactive materials contained in unsealed waste packages. The purpose of the cells is to provide safe environments for package handling and sealing operations. Once sealed, the packages are placed in the Yucca Mountain Repository. Closure of a typical waste package involves a number of remote operations. Those involved typically include the placement of matched lids onto the waste package. The lids are then individually sealed to the waste package by welding. Currently, the waste package includes three lids. One lid is placed before movement of the waste package to the closure cell; the final two are placed inside the closure cell, where they are welded to the waste package. These and other important operations require considerable remote material handling within the cell environment. This paper discusses the remote material handling equipment, designs, functions, operations, and maintenance, relative to waste package closure.

Dynamic Response of Single Crystalline Copper Subjected to Quasi-Isentropic, Gas-Gun Driven Loading

A transmission electron microscopy study of quasi-isentropic gas-gun loading (peak pressures between 18 GPa and 52 GPa) of [001] monocrystalline copper was carried out. The defect substructures at these different pressures were analyzed. Current experimental evidence suggests a deformation substructure that transitions from slip to twinning, where twinning occurs at the higher pressures ({approx}52 GPa), and heavily dislocated laths and dislocation cells take place at the intermediate and lower pressures. Evidence of stacking faults at the intermediate pressures was also found. Dislocation cell sizes decreased with increasing pressure and increased with distance away from the surface of impact. The results from the quasi-isentropic experiments are compared with that of flyer-plate and laser shock experiments carried out by Cao et al. [1] and Schneider et al. [2], respectively. The Preston-Tonks-Wallace and Zerilli-Armstrong constitutive descriptions are used to model both isentropic and shock compression experiments and predict the pressure at which the slip-twinning transition occurs in both cases. Both models predict a higher transition for isentropic then for shock experiments, and indeed, that twinning should not take place in the ICE experiments at the pressures investigated.

Scanning Hall Probe Microscopy of Magnetic Vortices inVery Underdoped yttrium-barium-copper-oxide

Since their discovery by Bednorz and Mueller (1986), high-temperature cuprate superconductors have been the subject of intense experimental research and theoretical work. Despite this large-scale effort, agreement on the mechanism of high-T{sub c} has not been reached. Many theories make their strongest predictions for underdoped superconductors with very low superfluid density n{sub s}/m*. For this dissertation I implemented a scanning Hall probe microscope and used it to study magnetic vortices in newly available single crystals of very underdoped YBa{sub 2}Cu{sub 3}O{sub 6+x} (Liang et al. 1998, 2002). These studies have disproved a promising theory of spin-charge separation, measured the apparent vortex size (an upper bound on the penetration depth {lambda}{sub ab}), and revealed an intriguing phenomenon of ''split'' vortices. Scanning Hall probe microscopy is a non-invasive and direct method for magnetic field imaging. It is one of the few techniques capable of submicron spatial resolution coupled with sub-{Phi}{sub 0} (flux quantum) sensitivity, and it operates over a wide temperature range. Chapter 2 introduces the variable temperature scanning microscope and discusses the scanning Hall probe set-up and scanner characterizations. Final Technical Report

The City of Albuquerque Aviation Department began planning for an alternative fuels facility in 1999 and began actively pursuing funding for the project in 2000. The original project scope was intended to provide a fueling station that provided unleaded gasoline, E-85, diesel, compressed natural gas (CNG) and propane. When the tragedy of 9/11 occurred, all capital projects were put on hold and then reassessed to validate needs and priorities. The alternative fuels station was scaled back to a CNG facility to: (1) Provide fuel for the common shuttle that served the rental car facilities at the airport; (2) Provide a CNG fuel center for use by all levels of government for vehicle fueling; (3) Provide another CNG facility near the interstate to improve the State network for CNG fueling; (4) Provide a backup fueling facility for the University of New Mexico and the City of Albuquerque Transit Department who were also using CNG vehicles; and (5) Provide another fueling facility accessible to the general public.

Regional Seismic Signals from Chemical Explosions, Nuclear Explosions and Earthquakes: Results from the Arizona Source Phenomenology Experiment

Routine industrial mining explosions play two important roles in seismic nuclear monitoring research: (1) they are a source of background events that need to be discriminated from potential nuclear explosions; (2) as some of the only explosions occurring in the current de facto global moratoria on nuclear testing, their signals should be exploited to improve the calibration of seismic m monitoring systems. A common issue monitoring arising in both of these roles is our limited physical understanding of the causes behind observed differences and similarities in the seismic signals produced by routine industrial mining blasts and small underground nuclear tests. In 2003 a consortium (Weston, SMU, LLNL, LANL and UTEP) carried out a Source Phenomenology Experiment (SPE), a series of dedicated explosions designed to improve this physical understanding, particularly as it relates to seismic methods of discriminating between signals from three different source types: earthquakes, industrial blasts, and nuclear tests. Here we very briefly review prior field experimental work that examined the seismic relationships between these source types.
