The Au Pair Program

Legislation passed late in the 103rd Congress granted the U.S. Information Agency (USIA) authority to design and implement more rigorous rules regulating the au pair program. In 1997, the au pair program received considerable media attention as a result of the Louise Woodward court case regarding possible involvement of an au pair in the death of a child in Massachusetts. The U.S. Information Agency amended existing federal regulations for the au pair program in September 1997 to underscore the cultural exchange aspect of the program and strengthen au pair recruiting and training.

The "Son of Sam" Case: Legislative Implications

In Simon & Schuster, Inc. v. Members of the new York State Crime Victims Board, the U.S. Supreme Court held that New York State's "Son of Sam" law was inconsistent with the First Amendment's guarantee of freedom of speech and press. This report examines the Supreme Court decision and then considers whether its rationale renders the federal law unconstitutional. Concluding that it likely does, the report considers whether it would be possible to enact a constitutional Son-of-Sam statute. Finally, the report takes note of some state Son-of-Sam statutes that have been enacted since the Supreme Court decision.

Waste Trade and the Basel Convention: Background and Update

The United States played a major role in developing the 1989 United Nations-sponsored Basel Convention on the Control of the Transboundary Movement of Hazardous Wastes and Their Disposal, a key purpose of which is to protect countries from receiving unwanted shipments of wastes. The Convention entered into force in 1992, and by mid-1998, 121 countries (but not the United States) had ratified it. In 1991, the Bush Administration transmitted the Convention to the Senate for advice and consent to ratification aid offered implementing legislation. Legislation authorizing the negotiation and, where required, fast-track implementation of trade agreements expired in early 1994. Action in the 104th Congress to renew the authority, prompted in part by the near-term prospect of the negotiation of a free-trade agreement with Chile, which might later be followed by other agreements, reached an impasse in late 1995 because of a disagreement between Congress and the Administration as to the inclusion of labor and environmental issues in agreements approved by fast-track procedure.

Air Quality and the New Ozone NAAQS: The OTAG Process

The Ozone Transport Assessment Group (OTAG) represented a cooperative effort between states, the Environmental Protection Agency (EPA), and numerous stakeholders to address teh complex issue of ozone transport. However, opponents of the new ozone National Ambient Air Quality Standard (NAAQS) argue that the OTAG recommendations are far too vague and ambiguous to be cited by EPA as a basis for implementation. This report provides background on the effort, and summarizes OTAG's assessment and recommendations.

This report contains brief summaries of federal animal protection statutes, listed alphabetically. It does not include treaties, although it does include statutes enacted to implement treaties. It includes statutes concerning animals that are not entirely, or not at all, animal protection statutes. For example, it includes a statute authorizing the eradication of predators, because one of the statute's purposes is to protect domestic and "game, animals; and it includes statutes to conserve fish, although their ultimate purpose may not be for the fishes' benefit. It also includes statutes that allow the disabled to use service animals, and even includes statutes aimed at acts of animal rights advocates (the Animal Enterprise Protection Act of 1992, and the Recreational Hunting Safety and Preservation Act of 1994).
