The Endangered Species Act (ESA), Migratory Bird Treaty Act (MBTA), and Department of Defense (DOD) Readiness Activities: Background and Current Law

This report provides a brief overview of how the Endangered Species Act (ESA)1 and the Migratory Bird Treaty Act (MBTA)2 and their relevant regulations may apply to military training and readiness activities of the Department of Defense (DOD). Military activities may “take” protected creatures directly (e.g,. killing with ordnance during rifle, gunnery or assault drills), or might destroy habitat (e.g., artillery or bombing practices), even if these results are not the purpose of the activities. The applicability of the MBTA and ESA to military readiness activities has been controversial recently and legislation has been enacted in both the 107th and 108th Congresses on these topics.

F-22 Raptor Aircraft Program

This report discusses the background information, analysis and the recent developments in the F-22 Raptor Aircraft Program. The F-22 program raises questions about its cost and the need for this aircraft, the capabilities it would have, and the number of these planes needed to meet military requirements. The F-22 has had strong congressional support, although some have criticized the program on grounds of cost, requirements, and coordination with other tactical aircraft programs. Deletion of procurement funds in the FY2000 defense appropriation bill passed by the House made the future of the program a major issue for House and Senate conferees in 1999.

Black and Hispanic Federal Judges: 1900 to Present

This report shows that in recent years, attention has increasingly focused upon the minority composition of the Federal judiciary, in apparent response to concerns that judges appointed to the Federal bench should more compositely reflect the U.S. population they serve. Two of the larger U.S. subpopulations served by the Federal judiciary are blacks and Hispanics. Accordingly, this mini brief lists chronologically and cumulatively the appointments of blacks and Hispanics to the Federal bench, which includes the U.S.Supreme Court, Circuit Courts of Appeals, and District courts.

Congressional Gold Medals 1776-1999

Since the American Revolution, Congress has commissioned gold medals as its highest expression of national appreciation for distinguished achievements and contributions. These medals should not be confused with the Medal of Honor, which is presented “in the name of the Congress of the United States,” and is often referred to as the Congressional Medal of Honor. Regulations for the Medal of Honor are established by the armed services. Congressional Gold Medals, conversely, can only be approved by Congress. This report provides a response to such inquiries and includes a historical examination and chronological list of these awards intended to assist Members of Congress in their consideration of future proposals to award Congressional Gold Medals. It will be updated annually.

USA PATRIOT Act: Background and Comparison of House- and Senate-approved Reauthorization and Related Legislative Action

The House and Senate have each passed USA PATRIOT Reauthorization Acts, H.R. 3199 and S. 3189. Both make permanent most of the expiring USA PATRIOT Act sections, occasionally in modified form. After amending two of the more controversial expiring sections, 206 (roving Foreign Intelligence Surveillance Act (FISA) wiretaps) and 215 (FISA tangible item access orders (business records-library records)), they postpone their expiration date, S. 1389 until December 31, 2009; H.R. 3199 until December 31, 2015. Both address questions raised as to the constitutionality of various “national security letter” (NSL) statutes by providing for review, enforcement, and exceptions to the attendant confidentiality requirements in more explicit terms. S. 1389 limits its NSL adjustments to the statute that affords federal foreign intelligence investigators access to communications records; H.R. 3199 amends the communications, and the financial institution and the credit bureau NSL statutes.

(OECD Expert Group meeting on reduction of capital costs of nuclear power plants, Paris, France, July 21--26, 1989): Foreign trip report

The OECD initiated a study of means to reduce the capital costs of nuclear power plants in the latter part of 1988. To accomplish the study, an Expert Group consisting of representatives of OECD member countries was formed. The initial meeting of the Expert Group was held in November 1988. A second meeting, documented in an ORNL trip report by this author, was held in May 1989. This meeting represents the third follow-on meeting with the primary goal of reviewing the draft report written by members of the Expert Group.
