The Economic Development Administration (EDA), targeted for elimination or major “reinvention” early in the 104th Congress, gained a new lease on life in the waning days of the 105th. Having been kept alive via appropriations bills since its last authorizing legislation expired in 1982, P.L. 105-393 reauthorized the EDA and its programs for 5 years. On October 27, Congress approved a conference agreement recommending $286.7 million for EDAP and $28 million for S&E, for a totalFY2001 appropriation of$411.9 million for EDA. It became part of the Consolidated Appropriations Act (H.R. 4942, P.L. 106-553) signed into law on December 21, 2000.

Generally, soft money is funds that are raised and spent according to applicable state laws, which FECA prohibits from being spent directly on federal elections, but that may have an indirect influence on federal elections. Prior to enactment of the Bipartisan Campaign Reform Act of 2002 (BCRA), P.L. 107-155, the term “soft money” generally referred to unregulated funds, perceived as resulting from loopholes in the Federal Election Campaign Act (FECA), 2 U.S.C. §§ 431 et seq. The general intent of BCRA, (effective November 6, 2002), which amends FECA, is to restrict the raising and spending of soft money. This Issue Brief discusses constitutional and legal issues surrounding two major types of soft money that BCRA regulates: political party soft money and soft money used for issue advocacy communications. Corporate and labor union soft money, which FECA exempts from regulation and is not addressed by BCRA, is also discussed.

Education Vouchers: Constitutional Issues and Cases

This report details the constitutional standards that currently apply to indirect aid programs and summarizes all of the pertinent state and federal court decisions, including the Ohio case that will be heard by the Supreme Court. On September 25, 2001, the Supreme Court agreed to review a case raising the controversial issue of the constitutionality of education vouchers. In Zelman v. Simmons-Harris the Sixth Circuit held Ohio’s Pilot Scholarship Program, which provided up to $2500 to help low-income students in Cleveland’s public schools attend private schools in the city, to violate the establishment of religion clause of the First Amendment.

Indian Ocean Earthquake and Tsunami: Humanitarian Assistance and Relief Operations

On December 26, 2004, a magnitude 9.0 undersea earthquake off the west coast of northern Sumatra, Indonesia, unleashed a tsunami that affected more than 12 countries throughout south and southeast Asia and stretched as far as the northeastern African coast. Current official estimates indicate that more than 160,000 people are dead and millions of others are affected, including those injured, missing, or displaced, making this the deadliest tsunami on record. News reports suggest that the death toll may be well above 200,000. Sections of Indonesia, Sri Lanka, India, and Thailand have suffered the worst devastation. Eighteen Americans are confirmed dead, with another sixteen presumed dead, and 153 remain unaccounted for.

Energy Policy: Setting the Stage for the Current Debate

The Bush Administration issued its plan for a national energy policy on May 16, 2001. The plan was controversial, characterized by some as leaner on conservation and renewables than Democratic proposals, and predisposed to trade off environmental considerations to increase supply. Comprehensive energy legislation was introduced in the Senate by both parties by late March (S. 388, S. 389, S. 596, S. 597). Bills reported by several House committees (H.R. 2436, H.R. 2460, H.R. 2511, and H.R. 2587) were combined in a single bill, H.R. 4, passed by the House, August 1, 2001. The House version of H.R. 4 would require a 5 billion gallon reduction in light-duty truck and SUV fuel consumption and would open the Arctic National Wildlife Refuge (ANWR) to leasing.
