Petroleum prices have continued to rise sharply in 2008, at one time reaching more than $140 per barrel of crude oil. At the same time the average monthly volume of imports of energy-related petroleum products has fallen slightly. The combination of sharply rising prices and a slightly lower level of imports of energy-related petroleum products translates into an escalating cost for those imports. The prices of energy imports have been on a steady rise since summer of 2007, defying the pattern of declining energy import prices in the fall. This report provides an estimate of the initial impact of the rising oil prices on the nation's merchandise trade deficit.

The Americans with Disabilities Act (ADA), provides broad nondiscrimination protection for individuals with disabilities in employment public services, public accommodations and services operated by private entities, transportation, and telecommunication. This report briefly discusses the Americans with Disabilities Act's statutory provisions relating to contagious diseases and relevant judicial interpretations.

With a conventional military and weapons of mass destruction (WMD) threat from Saddam Hussein's regime removed, Iran seeks to ensure that Iraq can never again become a threat to Iran, either with or without U.S. forces present in Iraq. By supporting armed Shiite factions, Iran's influence in Iraq has at times hindered U.S. efforts to stabilize Iraq, and has heightened the U.S. threat perception of Iran generally. However, Iran faces difficult choices in Iraq now that its protege Shiite factions, formerly united, are competing and often fighting each other.

In its FY2007, FY2008, and FY2009 budget submissions, the Department of Defense (DOD) proposed increases in Tricare enrollment fees, deductibles, and pharmacy co-payments for retired beneficiaries not yet eligible for Medicare. In passing the FY2009 National Defense Authorization Act, Congress included measures establishing demonstration projects intended to find ways to contain costs through increased use of preventive care services by TRICARE beneficiaries. The scope of these measures are limited. Defense health care spending will likely remain an issue for the DOD in the next Administration, and Congress can anticipate being asked to consider new proposals to constrain costs.

Names for Navy ships traditionally have been chosen and announced by the Secretary of the Navy. Congress in recent years has proposed, and sometimes passed, legislation regarding the naming of specific ships.

Currently, federal law prohibits states from granting unauthorized aliens certain postsecondary educational benefits on the basis of state residence, unless equal benefits are made available to all U.S. citizens. This prohibition is commonly understood to apply to the granting of "in-state" residency status for tuition purposes. In the 110th Congress, several bills that would amend this federal law have been introduced. Meanwhile, some states have passed laws aimed at making unauthorized state residents eligible for in-state tuition without violating this provision. This report provides a legal overview of cases involving immigrant access to higher education, as well as an analysis of the legality of state laws that make in-state tuition rates available to illegal immigrants.

The Andean Trade Preference Act (ATPA) extends special duty treatment to certain U.S. imports from Bolivia, Colombia, Ecuador, and Peru that meet domestic content and other requirements. The purpose of ATPA is to promote economic growth in the Andean region and to encourage a shift away from dependence on illegal drugs by supporting legitimate economic activities. This report outlines the various aspects of the ATPA, including significant dates and modifications.

The U.S. military is building up forces on the U.S. territory of Guam to increase deterrence and power projection for possible responses to crises and disasters, counterterrorism, and contingencies in support of South Korea, Japan, the Philippines, Taiwan, or elsewhere in Asia. But the defense buildup on Guam is moderate. Guam's role has increased with plans to withdraw some U.S. forces from Japan and South Korea. The buildup will cost $10.3 billion, with Japan contributing about 60% ($6.1 billion).

The Navy wants to modernize 84 Aegis cruisers and destroyers over a period of more than 20 years at a total cost of billions of dollars. The modernizations are intended to ensure that the ships can be operated cost-effectively throughout their entire intended service lives. The program poses several potential issues for Congress.

There is no consensus definition of "middle class," neither is there an official government definition. What constitutes the middle class is relative, subjective, and not easily defined. The mid-point in the distribution is the median, and in 2007 the median household income was $50,233. How far above and below that amount the middle stretches remains an open question. This report explores the various definitions of the middle class and what salary ranges those definitions encompass, as well as related statistics and surveys that support this information.

Some in Congress have expressed concern about the government's use of private-sector lead system integrators (LSIs) for executing large, complex, defense-related acquisition programs. LSIs are large, prime contractors hired to manage such programs. Supporters of the LSI concept argue that it is needed to execute such complex acquisition efforts, and can promote better technical oversight and innovation.

The Federal Protective Service (FPS) -- within U.S. Immigration Customs Enforcement (ICE) in the Department of Homeland Security (DHS) -- is responsible for protecting federal government property, personnel, visitors, and customers, including property leased by the General Services Administration (GSA). FPS currently employs over 15,000 contract security guards to protect federal property. DHS intends, according to its FY2009 budget justification, to continue the use of contract security guards to focus FPS activities on maintaining security policy and standards, conducting building security assessments, and monitoring federal agency compliance with security standards.

China is a major source of U.S. imports of consumer products (such as toys) and an increasingly important supplier of various food products. Reports of unsafe seafood, pet food, toys, tires, and other products imported from China over the past year or so have raised concern in the United States over the health, safety, and quality of imported Chinese products. This report provides an overview of this issue and implications for U.S.-China trade relations.

Developments in wave, tidal, and in-stream energy generation technologies -- also referred to as hydrokinetic or marine energy -- are beginning to gain momentum. At the same time, their regulatory status is still evolving, as shown by recent changes in law aimed at clarifying hte federal role in ocean wave and renewable energy. Two federal agencies currently appear to have a lead role in offshore renewable energy projects -- the Department of the Interior's Minerals Management Service (MMS) and the Federal Energy Regulatory Commission (FERC).

The C-17 Globemaster III is a long-range cargo aircraft operated by the U.S. Air Force since 1993. To date, Congress has funded 190 C-17s for the Air Force. The C-17 program remains a key issue as Congress evaluates the needs of DOD's strategic airlift force. This paper provides program background for the C-17. Joint Cargo Aircraft (JCA) is a joint acquisition program between the Army and Air Force intended to procure a commercial off-the-shelf aircraft capable of meeting Army and Air Force requirements for intra-theater airlift. The C-27J Spartan, built by L-3 Communications, was awarded the JCA contract in 2007. This is an update of a report by William Knight and will be updated as conditions warrant.

Congress appropriated, in P.L. 110-329, approximately $4.36 billion for state and local homeland security assistance programs. This is approximately $135 million more than was appropriated in FY2008 ($4.22 billion). Congress chose not to fund the Real ID program in FY2009, however, it did appropriate funding ($2 million) for a new assistance program titled the Center for Counterterrorism and Cyber Crime at Norwich University in Northfield, Vermont.

The National Aeronautics and Space Administration (NASA) conducts U.S. civilian space and aeronautics activities. For FY2009, the Administration requested $17.614 billion for NASA, and increase of 1.8% from the FY2008 appropriation of $17.309 billion. The President's 2004 Moon/Mars Vision for Space Exploration is the major focus of NASA's activities. Issues for Congress regarding this goal include the development of new vehicles for human spaceflight, plans for the transition to these vehicles after the space shuttle is retired in 2010, and the balance in NASA's priorities between human space exploration and the agency's activities in science and aeronautics.
