Ryan White CARE Act: Effects of Certain Funding Provisions on Grant Awards

A letter report issued by the Government Accountability Office with an abstract that begins "Funds are made available under the Ryan White Comprehensive AIDS Resources Emergency Act of 1990 (CARE Act) for individuals affected by HIV/AIDS. Part A provides for grants to metropolitan areas and Part B provides for grants to states and territories and associated jurisdictions for HIV/AIDS services and for AIDS Drug Assistance Programs (ADAP). The Ryan White HIV/AIDS Treatment Modernization Act of 2006 (RWTMA) reauthorized CARE Act programs for fiscal years 2007 through 2009. RWTMA requires name-based HIV case counts for determining CARE Act funding, but an exemption allows the use of code-based case counts through fiscal year 2009. RWTMA formulas include hold-harmless provisions that protect grantees' funding at specified levels. RWTMA also included provisions under which Part A and B grantees with unobligated balances over 2 percent at the end of the grant year incur a penalty in future funding. GAO was asked to examine CARE Act funding provisions. The Department of Homeland Security (DHS) issued guidance in 2006 that instructed lead federal agencies, referred to as sector-specific agencies, to develop plans for protecting the sector's critical cyber and other (physical) infrastructure. These agencies issued plans in 2007, but GAO found that none fully addressed all 30 cyber security-related criteria identified in DHS's guidance and recommended that the plans be updated to address it by September 2008. GAO was asked to determine the extent to which sector plans have been updated to fully address DHS's cyber security requirements and assess whether these plans and related reports provide for effective implementation. As a result, the public is concerned about the oversight of these laboratories. The deliberate or accidental release of biological pathogens can have disastrous consequences. A letter report issued by the Government Accountability Office with an abstract that begins "Preparing for the tax filing season is a significant undertaking for Internal Revenue Service (IRS). The filing season is when most individuals file their tax returns, receive refunds, and contact IRS if they have questions. As returns are received, IRS begins a series of automated compliance checks to correct errors on tax returns and ensure that refunds are justified. For example, IRS rejects electronically filed returns with basic errors requiring taxpayers to correct and resubmit them. It uses what is called "math error authority" to automatically correct obvious noncompliance such as violations of limits on deductions or credits, which allows IRS to avoid costly audits. IRS must begin preparing for each filing season months in advance and preparations include the following. (1) Revising tax forms and publications to implement tax law changes. Recent major law changes that affected the 2009 filing season include the (a) Economic Stimulus Act of 2008, which contained the recovery rebate credit allowing taxpayers who did not receive the full economic stimulus payment last year to claim some or all of the unpaid credit on their 2008 returns; (b) Housing and Economic …

A letter report issued by the Government Accountability Office with an abstract that begins "Until recently, ethics programs and practices of defense contractors were self-policed. Given the significant sums spent to acquire goods and services, the Federal Acquisition Regulation (FAR) was amended twice starting in December 2007 to first mandate and later amplify contractor ethics program rules. Before FAR changes were finalized in December 2008, Congress required GAO to report in 2009 on the ethics programs of major defense contractors. This report (1) describes the extent that contractors had ethics programs before the finalization of the FAR rules that included practices consistent with standards now required by the FAR and (2) assesses the impact the new FAR rules have on Department of Defense (DOD) oversight of contractor ethics programs. To do this work, in September 2008 GAO surveyed all 57 contractors--those receiving more than $500 million in 2006 DOD contract awards--and interviewed DOD contractor oversight agency officials on the impact of the new FAR rules on oversight."

A letter report issued by the Government Accountability Office with an abstract that begins "As part of the 2005 Base Realignment and Closure (BRAC) round, the Department of Defense (DOD) plans to relocate over 123,000 military and DOD civilian personnel, thereby increasing the staffing at 18 bases nationwide. In addition, DOD and local officials expect thousands of dependents and DOD contractor employees to relocate to communities near the BRAC 2005 growth bases. These actions will greatly increase traffic in the surrounding communities. BRAC recommendations must be implemented by September 2011. The House and Senate Committees on Appropriations directed GAO to assess and report on the impact of BRAC-related growth on transportation systems and on the responses of federal, state, and local governments. Accordingly, GAO determined the (1) expected impact on transportation in communities affected by BRAC decisions, and (2) federal, state, and local response to the expected impacts. A letter report issued by the Government Accountability Office with an abstract that begins "Since September 11, 2001, the Army has heavily used its reserve components--the Army National Guard and Army Reserve--for ongoing operations even though they were envisioned and resourced to be strategic reserves. A congressional commission, the Department of Defense (DOD), and the Army have concluded the Army will need to continue to use its reserve components as an operational force. The transition will require changes to force structure as well as manning and equipping strategies that could cost billions of dollars. The 2009 Defense Authorization Act directed GAO to study this transition. This report provides additional information on (1) progress and challenges the Army faces, (2) to what extent the Army has estimated costs for the transition and included them in its projected spending plans, and (3) the effect of the operational role on the Guard's availability to state governors for domestic missions. Testimony issued by the Government Accountability Office with an abstract that begins "Biosafety laboratories are primarily regulated by either the Department of Health and Human Services (HHS) or the U.S. Department of Agriculture (USDA), depending on whether the substances they handle pose a threat to the health of humans or plants, animals, and related products, respectively. Currently, all operational biosafety level 4 (BSL-4) labs are overseen by HHS's Centers for Disease Control and Prevention (CDC). BSL-4 labs handle the world's most dangerous agents and toxins that cause incurable and deadly diseases. This testimony summarizes GAO's previously issued reports on perimeter security at the nation's BSL-4 laboratories that were issued in September 2008 (GAO-08-1092) and July 2009 (GAO-09-851). The Department of State (State) faces an ongoing challenge of ensuring it has the right people, with the right skills, in the right places overseas to carry out the department's priorities. In particular, State has long had difficulty staffing its hardship posts overseas, which are places like Beruit and Lagos, where conditions are difficult and sometimes dangerous due to harsh environmental and extreme living conditions that often entail pervasive crime or war, but are nonetheless integral to foreign policy priorities and need a full complement of qualified staff. State has also faced persistent shortages of staff with critical language skills, despite the importance of foreign language proficiency in advancing U.S. foreign policy and economic interests overseas. In recent years GAO has issued a number of reports on human capital issues that have hampered State's ability to carry out the President's foreign policy objectives. This testimony discusses (1) State's progress in addressing staffing gaps at hardship posts, and (2) State's efforts to meet its foreign language requirements."

Testimony issued by the Government Accountability Office with an abstract that begins "This testimony discusses the implementation of the Department of Homeland Security's (DHS) Secure Border Initiative (SBI) program--a multiyear, multibillion dollar program aimed at securing U.S. borders and reducing illegal immigration. Securing the nation's borders from illegal entry of aliens and contraband, including terrorists and weapons of mass destruction, continues to be a major challenge. In November 2005, DHS announced the launch of SBI to help address this challenge. The U.S. Customs and Border Protection (CBP) supports this initiative by providing agents and officers to patrol the borders, secure the ports of entry, and enforce immigration laws. In addition, CBP's SBI program is responsible for developing a comprehensive border protection system using technology, known as SBInet, and tactical infrastructure--fencing, roads, and lighting--along the southwest border to deter smugglers and aliens attempting illegal entry. Since fiscal year 2005, SBI has received funding amounting to over $3.7 billion. Approximately $1.1 billion has been allocated to SBInet and $2.4 billion to tactical infrastructure. Prior GAO reports show that the use of deployed civilians has raised questions about the potential for differences in policies on compensation and medical benefits. When these civilians are deployed and serve side by side, differences in compensation or medical benefits may become more apparent and could adversely impact morale. This statement is based on GAO's June 2009 congressionally requested report, which compared agency policies and identified any issues in policy or implementation regarding (1) compensation, (2) medical benefits, and (3) identification and tracking of deployed civilians. Testimony issued by the Government Accountability Office with an abstract that begins "In fiscal year 2008, the Department of the Interior collected over $22 billion in royalties and other fees related to oil and gas. Within Interior, the Bureau of Land Management (BLM) manages onshore federal oil and gas leases, and the Minerals Management Service's (MMS) Offshore Energy and Minerals Management (OEMM) manages offshore leases. A federal lease gives the lessee rights to explore for and develop the lease's oil and gas resources. MMS is responsible for collecting royalties for oil and gas produced from both onshore and offshore leases. GAO has reviewed federal oil and gas management and revenue collection and found many material weaknesses. This testimony is based primarily on key findings from past GAO reports and some preliminary findings from ongoing work. These findings focus on Interior's: (1) policies for oil and gas leasing, (2) oversight of oil and gas production, (3) royalty regime and policies to boost oil and gas development, (4) oil and gas information technology (IT) systems, and (5) royalty-in-kind program. For DHS to effectively leverage these systems as mission enablers and transformation tools, it needs to employ a number of institutional acquisition and IT management controls and capabilities, such as using an operational and technological blueprint to guide and constrain system investments (enterprise architecture) and following institutional policies, practices, and structures for acquiring and investing in these systems. Other institutional controls and capabilities include employing rigorous and disciplined system life cycle management processes and having capable acquisition and IT management workforces. As GAO has reported, it is critical for the department to implement these controls and capabilities on each of its system acquisition programs. Testimony issued by the Government Accountability Office with an abstract that begins "This testimony discusses issues relating to efforts to reform the regulatory structure of the financial system. In the midst of the worst economic crisis affecting financial markets globally in more than 75 years, federal officials have taken unprecedented steps to stem the unraveling of the financial services sector. While these actions aimed to provide relief in the short term, the severity of the crisis has shown clearly that in the long term, the current U.S. financial regulatory system was in need of significant reform. Our January 2009 report presented a framework for evaluating proposals to modernize the U.S. financial regulatory system, and work we have conducted since that report further underscores the urgent need for changes in the system. Given the importance of the U.S. financial sector to the domestic and international economies, in January 2009, we also added modernization of its outdated regulatory system as a new area to our list of high-risk areas of government operations because of the fragmented and outdated regulatory structure. Testimony issued by the Government Accountability Office with an abstract that begins "Due to concerns about long standing delays in the security clearance process, Congress mandated reforms in the Intelligence Reform and Terrorism Prevention Act of 2004 (IRTPA), which requires, among other things, that the executive branch report annually to Congress. Since 2005, the Department of Defense's (DOD) clearance program has been on GAO's high-risk list due to delays and incomplete documentation. The Office of Personnel Management (OPM) conducts much of the government's clearance investigations. In 2007, the Director of National Intelligence and DOD established a Joint Reform Team to coordinate governmentwide improvement efforts for the process. The Office of Management and Budget (OMB) oversees these efforts. Based on two recent GAO reports, this statement addresses (1) progress in reducing delays at DOD, (2) opportunities for improving executive branch reports to Congress and (3) the extent to which joint reform efforts reflect key factors for reform. Government Performance: Strategies for Building a Results-Oriented and Collaborative Culture in the Federal Government

Testimony issued by the Government Accountability Office with an abstract that begins "Since 1997, periodic GAO surveys indicate that overall, federal managers have more performance information available, but have not made greater use of this information for decision making. To understand the barriers and opportunities for more widespread use, GAO was asked to (1) examine key management practices in an agency in which managers' reported use of performance information has improved; (2) look at agencies with relatively low use of performance information and the factors that contribute to this condition; and (3) review the role the President and Congress can play in promoting a results-oriented and collaborative culture in the federal government. This testimony is primarily based on GAO's report, Results-Oriented Management: Strengthening Key Practices at FEMA and Interior Could Promote Greater Use of Performance Information, which is being released today. In this report, GAO made recommendations to the Departments of Homeland Security (DHS) and the Interior for improvements to key management practices to promote greater use of performance information at FEMA, the National Park Service, Bureau of Reclamation, as well as at Interior. The Federal Emergency Management Agency (FEMA) is the agency within the Department of Homeland Security (DHS) responsible for the current Emergency Alert System (EAS) and the development of the new Integrated Public Alert and Warning System (IPAWS). In this testimony, based on its report released today, GAO discusses (1) the current status of EAS, (2) the progress made by FEMA in implementing an integrated alert and warning system, and (3) coordination issues involved in implementing an integrated alert and warning system. GAO conducted a survey of states, reviewed FEMA and other documentation, and interviewed industry stakeholders and officials from federal agencies responsible for public alerting."

High-Containment Laboratories: National Strategy for Oversight Is Needed

Testimony issued by the Government Accountability Office with an abstract that begins "This testimony discusses our report on a national strategy for high-containment laboratories that deal with dangerous--pathogens also known as biosafety level-3 (BSL-3) laboratories and biosafety level-4 (BSL-4) laboratories--in the United States, which was released yesterday. The number of high-containment laboratories that work with dangerous biological pathogens have proliferated in recent years. In 2007, we reported on several issues associated with the proliferation of high-containment laboratories in the United States, including risks posed by biosafety incidents that have occurred in the past. The Federal Bureau of Investigation's allegation in August 2008 that a scientist at the U.S. Army Medical Research Institute of Infectious Diseases was the sole perpetrator of the 2001 anthrax attacks raised additional concerns about the possibility of insider misuse of high-containment laboratory facilities, material, and technology. The public is concerned about these laboratories because the deliberate or accidental release of biological agents can have disastrous consequences by exposing workers and the public to dangerous pathogens. Highly publicized laboratory errors and controversies about where high-containment laboratories should be located have raised questions about whether the governing framework, oversight, and standards for biosafety and biosecurity measures are adequate. …

Testimony issued by the Government Accountability Office with an abstract that begins "This testimony is based largely on GAO's July 8, 2009 report, in response to a mandate under the American Recovery and Reinvestment Act of 2009 (Recovery Act). This testimony provides selected updates, including the status of federal Recovery Act outlays. The report addresses: (1) selected states' and localities' uses of Recovery Act funds, (2) the approaches taken by the selected states and localities to ensure accountability for Recovery Act funds, and (3) states' plans to evaluate the impact of Recovery Act funds. GAO's work for the report is focused on 16 states and certain localities in those jurisdictions as well as the District of Columbia--representing about 65 percent of the U.S. population and two-thirds of the intergovernmental federal assistance available. GAO collected documents and interviewed state and local officials. GAO analyzed federal agency guidance and spoke with Office of Management and Budget (OMB) officials and with program officials at the Centers for Medicare and Medicaid Services, and the Departments of Education, Energy, Housing and Urban Development, Justice, Labor, and Transportation."
