Some form of a valueadded tax (VAT) has been frequently discussed as a replacement to the U.S. income tax system. In addition, some Members of Congress have expressed interest in the feasibility of using a value-added tax to finance health care reform.

Excited Utterances, "Testimonial" Statements, and the Confrontation Clause

The United States Supreme Court will hear oral argument this term in appeals from two state supreme court cases, Hammon v. Indiana and Davis v. Washington, concerning the admissibility of “excited utterance” statements made by non-testifying witnesses at criminal trials. In the landmark Crawford v. Washington case in 2004, the Court held that the Sixth Amendment’s Confrontation Clause forbids hearsay “testimonial” evidence from being introduced against the accused unless the witness is unavailable to testify and the defendant has had a prior opportunity to crossexamine the witness. However, the Crawford Court declined to provide a comprehensive definition of “testimonial,” leaving such task “for another day.”

Iraq: Post-Saddam National Elections

Elections for a transitional National Assembly, provincial councils, and a Kurdish regional assembly were held on January 30, 2005. High voter turnout in mostly Shiite and Kurdish areas led to a first and second-place finish for slates backed by these two communities. Sunni Arabs, dominant under Saddam Hussein, appear to have been further marginalized by their relative lack of participation in the vote. This report will be updated regularly. Privacy and Civil Liberties Oversight Board: 109th Congress Proposed Refinements

Among the recommendations made by the National Commission on Terrorist Attacks Upon the United States (9/11 Commission) in its final report was the creation of a board within the executive branch to oversee adherence to guidelines on, and the commitment to defend, civil liberties by the federal government. This report examines the realization of this recommendation with the creation of the Privacy and Civil Liberties Oversight Board, and efforts in the 109th Congress to refine the mandate and the mission of the board (H.R. 1310). This report will be updated as events warrant.

Older Workers: Employment and Retirement Trends

As the members of the “baby boom” generation — people born between 1946 and 1964— approach retirement, the demographic profile of the U.S. workforce will undergo a substantial shift: a large number of older workers will be joined by relatively few new entrants to the labor force. According to the U.S. Bureau of the Census, while the number of people between the ages of 55 and 64 will grow by about 11 million between 2005 and 2025, the number of people who are 25 to 54 years old will grow by only 5 million. This trend could affect economic growth because labor force participation begins to fall after age 55. In 2004, 91% of men ages 25 to 54 and 75% of women in this age group participated in the labor force. In contrast, just 69% of men ages 55 to 64 and 56% of women ages 55 to 64 were either working or looking for work in 2004.

Disaster Unemployment Assistance (DUA)

The Disaster Unemployment Assistance (DUA) program provides monetary assistance to individuals unemployed as a direct result of a major disaster and who are not eligible for regular Unemployment Compensation (UC) benefits. DUA is funded through the Federal Emergency Management Agency (FEMA). DUA is administered by the Department of Labor (DOL) through each state’s UC agency. In the 109th Congress, P.L. 109-176 was signed into law on March 6, 2006, extending the duration of DUA benefits from 26 to 39 weeks for victims of the Hurricane Katrina and Rita disasters.

Social Security Reform: Economic Issues

The President has indicated that Social Security reform will be a major issue in the 109th Congress. While Social Security originated as a Depression-era program aimed at alleviating the economic circumstances of the elderly, social insurance also corrects market failures in the annuity market (adverse selection), prevents free-riders (requires workers to provide for their retirement), spreads risk, and may correct for failure to optimize by shortsighted individuals.

Pakistan's Domestic Political Developments

Pakistan is a strategically important country and home to one of the world’s largest Muslim populations. In October 1999, Pakistan’s Chief of Army Staff Gen. Pervez Musharraf replaced Prime Minister Nawaz Sharif in a bloodless coup. In the wake of the military overthrow of the elected government, Islamabad faced considerable international opprobrium and was subjected to automatic coup-related U.S. sanctions. The September 2001 terrorist attacks on the United States and Musharraf’s ensuing withdrawal of support for the Afghan Taliban regime, however, had the effect of greatly reducing Pakistan’s international isolation. Congress removed restrictions, and large-scale U.S. aid to the country resumed, in the final months of 2001.

Bosnia: Overview of Issues Ten Years After Dayton

On November 21-22, 2005, the United States will host a meeting with Bosnia’s collective leadership to commemorate the 10th anniversary of the Dayton accords, an agreement brokered under U.S. leadership that ended the 1992-1995 conflict in Bosnia- Herzegovina. Since early 2005, the Bush Administration has given renewed emphasis to “unfinished business” in the western Balkan region, such as the unresolved status of Kosovo, a U.N.-run province of Serbia. The United States also seeks to bolster Bosnia’s further development as a unified, democratic, and stable state on the path toward Euro- Atlantic integration, including major constitutional reforms. This report provides an overview of prominent current issues concerning Bosnia and will be updated after the 10th anniversary meeting in Washington.

Drinking Water State Revolving Fund: Program Overview and Issues

In the Safe Drinking Water Act (SDWA) Amendments of 1996 (P.L. 104-182), Congress authorized a drinking water state revolving loan fund (DWSRF) program to help public water systems finance infrastructure projects needed to comply with federal drinking water regulations and to protect public health. Under the program, states receive capitalization grants to make loans to water systems for drinking water projects and certain other SDWA activities. Since the program was first funded in FY1997, Congress has provided $7.8 billion, including roughly $844 million for FY2005. The President has requested $850 million for FY2006. Through June 2004, the DWSRF program had provided $7.9 billion in assistance and had supported 6,500 projects.
