Competition in Federal Contracting: An Overview of the Legal Requirements
This report describes the competition requirements currently governing the procurement activities of federal agencies. It addresses several issues, including what contracts are subject to competition requirements, what constitutes full and open competition for government contracts, and the circumstances permitting agencies to award contracts on the basis of other than full and open competition. It also briefly describes the benefits and drawbacks of competition, situates recent reform efforts within their historical context, and discusses how the policy debates surrounding competition in federal contracting can shape legislative responses.

The Effect of Distributed Energy Resource Competition with Central Generation
Distributed Energy Resource (DER) has been touted as a clean and efficient way to generate electricity at end-use sites, potentially allowing the exhaust heat to be put to good use as well. However, despite its environmental acceptability compared to many other types of generation, it has faced some disapproval because it may displace other, cleaner generation technologies. The end result could be more pollution than if the DER were not deployed. On the other hand, the DER may be competing against older power plants. If the DER is built then these other plants may be retired sooner, reducing their emissions. Or it may be that DER does not directly compete against either new or old plant capacity at the decision-maker level, and increased DER simply reduces the amount of time various plants operate. The key factor is what gets displaced if DER is added. For every kWh made by DER a kWh (or more with losses) of other production is not made. If enough DER is created, some power plants will get retired or not get built so not only their production but their capacity is displaced. The Spectroscopy of {sup 183}Tl: An Extreme Case of Prolate-Oblate Shape-Competition
The yrast sequence in {sup 183}Tl has been studied for the first time in recoil-mass and decay tagged gamma-ray spectroscopic measurements. A rotational-like cascade of seven transitions is observed down to the bandhead with spin 13/2+. In contrast to adjacent nuclei, links from the yrast band to a lower lying weakly deformed (oblate) structure are not observed. It appears that the prolate energy minimum in {sup 183}Tl drops significantly compared to {sup 185}Tl and minimizes below the neutron i13/2 midshell (n <= 102). Possibilities for the decay out of the band in {sup 183}Tl are discussed.

Crystalline-Silicon Solar Cells for the 21st Century
The worldwide market share for crystalline-silicon solar cells has increased steadily in the last 10 years. In 1998, about 87% of the photovoltaic modules shipped worldwide are based on crystalline silicon. This dominance will likely continue into at least the first few years of the 21st century. The long-term growth of crystalline-silicon solar cells will depend on the development of low-cost polysilicon feedstock, silicon films, and advanced cell and module manufacturing processes.

US industry is fighting to maintain its competitive edge in the global market place. Markets fluctuate rapidly. Companies have to be able to respond quickly with improved, high quality, cost efficient products. Because companies and their suppliers are geographically distributed, rapid product realization is dependent on the development of a secure integrated concurrent engineering environment operating across multiple business entities. The way products are developed and brought to market can be improved and made more efficient through the proper incorporation of emerging technologies implemented in a secure environment. This documents the work done under this CRADA to develop capabilities, which permit the effective application, incorporation, and use of advanced technologies in a secure environment to facilitate the product realization process. Lockheed Martin Energy Systems (LMES), through a CRADA with the National Center for Manufacturing Sciences (NCMS), worked within a consortium of major industrial firms--Ford, General Motors, Texas Instruments, United Technologies, and Eastman Kodak--and several small suppliers of advanced manufacturing technology--MacNeal-Schwendler Corp., Teknowledge Corp., Cimplex Corp., Concentra, Spatial Technology, and Structural Dynamics Research Corp. (SDRC)--to create infrastructure to support the development and implementation of secure engineering environments for Rapid Response Manufacturing. Martin Marietta, Y-12 Plant Laboratory Partnership Program Plan
The Y-12 Plant currently embraces three mission areas; stockpile surveillance, maintaining production capability, and storage of special nuclear materials. The Y-12 Plant also contributes to the nations` economic strength by partnering with industry in deploying technology. This partnering has been supported to a great extent through the Technology Transfer Initiative (TTI) directed by DOE/Defense Programs (DP-14). The Oak Ridge Centers for Manufacturing Technology (ORCMT) was established to draw upon the manufacturing and fabrication capabilities at the Y-12 Plant to coordinate and support collaborative efforts, between DP and the domestic industrial sector, toward the development of technologies which offer mutual benefit to both DOE/DP programs and the private sector. Most of the needed technologies for the ``Factory of the Future`` (FOF) are being pursued as core areas at the Y-12 Plant. As a result, 85% of DP-14 projects already support the FOF. The unique capabilities of ORCMT can be applied to a wide range of manufacturing problems to enhance the capabilities of the US industrial base and its economic outcome. The ORCMT has an important role to play in DOE`s Technology Transfer initiative because its capabilities are focused on applied manufacturing and technology deployment which has a more near-term impact on …

The federal government -- through Congress and the Federal Communications Commission (FCC) -- is seeking to ensure fair competition among the players so that broadband will be available and affordable in a timely manner to all Americans who want it. While the FCC's position is not to intervene at this time, some assert that legislation is necessary to ensure fair competition and timely broadband deployment. One proposal would ease certain legal restrictions and requirements, imposed by the Telecommunications Act of 1996, on incumbent telephone companies who provide high speed data (broadband) access. Another proposal would compel cable companies to provide "open access" to competing Internet service providers.

Contract Reform: DOE's Policies and Practices in Competing Research Laboratory Contracts
Testimony issued by the General Accounting Office with an abstract that begins "DOE is the largest civilian-contracting agency in the federal government, and relies primarily on contractors to operate its sites and carry out its diverse missions. For fiscal year 2003, DOE will spend about 90 percent of its total annual budget, or $19.8 billion, on contracts, including $9.4 billion to operate 16 of its research laboratories (called federally funded research and development centers). Since 1990, GAO has identified DOE's contract management as high-risk for fraud, waste, abuse, and mismanagement. In 1994, DOE began reforming its contracting practices to, among other things, improve contractor performance and accountability. As part of that effort, DOE has at times used competition in awarding contracts to manage and operate its research laboratories. In September 2002, GAO reported on the status of contract reform efforts in DOE. OMB Circular A-76: Explanation and Discussion of the Recently Revised Federal Outsourcing Policy
The Office of Management and Budget has recently modified its Circular A-76, which governs the executive policy for the competition of commercial activities. This report provides a brief history of OMB Cir. A-76, a discussion of its place in the legal implementation of the Federal procurement policy, and a review of the main components of the Circular. Important for understanding the Circular is an understanding of the concepts of “commercial activity” and “inherently governmental activity.” These two concepts will be emphasized in the discussion.
