Aviation Competition: Challenges in Enhancing Competition in Dominated Markets

Testimony issued by the General Accounting Office with an abstract that begins "The major network carriers dominate traffic at most of their large hubs and extensive evidence exists that fares in markets where competition is absent are consistently above competitive levels. GAO believes that the oversight scheme contemplated when the industry was deregulated--with antitrust enforcement by the Department of Justice (DOJ) and oversight of unfair trade practices by the Department of Transportation (DOT)--has not been entirely successful in preserving and ensuring competition. Although the current legislative scheme grants explicit authority for DOT to regulate unfair competitive practices, the legislation does give DOT substantial leeway on the scope of its action. Thus, with the range of competitive challenges confronting the industry and directly affecting consumers, especially in the face of unprecedented industry consolidation, GAO believes there is merit in the overall intent of the proposed Aviation Competition Restoration Act to direct DOT to actively monitor the state of competition in the industry and to institute remedial actions as appropriate."

Freight Railroads: Updated Information on Rates and Competition Issues

Testimony issued by the Government Accountability Office with an abstract that begins "The Staggers Rail Act of 1980 largely deregulated the freight railroad industry, giving the railroads freedom to price their services according to market conditions and encouraging greater reliance on competition to set rates. The act recognized the need for railroads to recover costs by setting higher rates for shippers with fewer transportation alternatives. The act also recognized that some shippers might not have access to competitive alternatives and might be subject to unreasonably high rates. It established a threshold for rate relief and granted the Interstate Commerce Commission and the Surface Transportation Board (STB) the authority to develop a rate relief process for those "captive" shippers. GAO's reported on rates, competition, and other industry trends in reports issued in October 2006 and August 2007. This statement is based on those reports and discusses (1) the changes that have occurred in the railroad industry since the enactment of the Staggers Rail Act, including changes in rail rates since 1985, (2) the extent of captivity in the industry and STB's efforts to protect captive shippers, and (3) STB's actions to address GAO's recent recommendations."

Private Health Insurance: Research on Competition in the Insurance Industry

Correspondence issued by the Government Accountability Office with an abstract that begins "Health care providers and members of Congress have raised concerns that consolidation in the private health insurance industry may be resulting in less competitive markets and contributing to rising health insurance rates paid by consumers and employers. However, measuring the extent of changes in market competition over time or the effects of changes is challenging. In particular, reliable, longitudinal data to measure concentration, that is, the number of competitors and their relative market share, are only available on health maintenance organizations (HMO) but not on preferred provider organizations (PPO) or other insurance products that may comprise the market. Further, data on health insurers are not available at all geographic levels. Despite these challenges, researchers have used the data available to study competition in health insurance markets, typically using one of two measures of competition: (1) HMO market concentration or (2) the number of HMOs in a market. Researchers acknowledge that market concentration and the number of competitors are not perfect measures of competition in private health insurance markets and that there are limits to the conclusions to be drawn from studies that rely on the available data. Telecommunications: Subscriber Rates and Competition in the Cable Television Industry

Testimony issued by the General Accounting Office with an abstract that begins "In recent years, rates for cable service have increased at a faster pace than the general rate of inflation. GAO agreed to (1) examine the impact of competition on cable rates and service, (2) assess the reliability of information contained in the Federal Communications Commission's (FCC) annual cable rate report, (3) examine the causes of recent cable rate increases, (4) assess the impact of ownership affiliations in the cable industry, (5) discuss why cable operators group networks into tiers, and (6) discuss options to address factors that could be contributing to cable rate increases. GAO issued its findings and recommendations in a report entitled Telecommunications: Issues Related to Competition and Subscriber Rates in the Cable Television Industry (GAO-04-8). In that report, GAO recommended that the Chairman of FCC take steps to improve the reliability, consistency, and relevance of information on cable rates and competition in the subscription video industry. In commenting on GAO's report, FCC agreed to make changes to its annual cable rate survey, but FCC questioned, on a cost/benefit basis, the utility of revising its process to keep the classification of effective competition up to date. …

Commercial Aviation: Financial Condition and Industry Responses Affect Competition

Testimony issued by the General Accounting Office with an abstract that begins "This testimony discusses the economic state of the airline industry. Many, but not all, major U.S. passenger airlines are experiencing their second consecutive year of record financial losses. In 2001, the U.S. commercial passenger airline industry reported losses in excess of $6 billion. For 2002, some Wall Street analysts recently projected that U.S. airline industry losses will approach $7 billion, and noted that the prospects for recovery during 2003 are diminishing. Carriers have taken many actions to lower their costs and restructure their operations. Since September 2001, carriers have furloughed 100,000 staff, renegotiated labor contracts, and streamlined their fleets by retiring older, costlier aircraft. Carriers have reduced capacity by operating fewer flights or smaller aircraft. In some cases, carriers eliminated all service to communities. As the aviation industry continues its attempts to recover, Congress will be confronted with a need for increased oversight of a number of public policy issues. First, airlines' reactions to financial pressures will affect the domestic industry's competitive landscape. Second, airlines' reductions in service will likely place additional pressure on federal programs supporting air service to small communities, where travel options are already limited. …

Testimony issued by the Government Accountability Office with an abstract that begins "Consumers paid an estimated $65.7 billion in residential real estate brokerage fees in 2005. Observing that commission rates have remained relatively uniform--regardless of market conditions, home prices, or the effort required to sell a home--some economists have questioned the extent of price competition in the residential real estate brokerage industry. Furthermore, while the Internet offers time and cost savings to the process of searching for homes, Internet-oriented brokerage firms account for only a small share of the brokerage market. This has raised concerns about potential barriers to greater use of the Internet in real estate brokerage. In this testimony, which is based on a report issued in August 2005, GAO discusses (1) factors affecting price competition in the residential real estate brokerage industry and (2) the status of the use of the Internet in residential real estate brokerage and potential barriers to its increased use."

Correspondence issued by the Government Accountability Office with an abstract that begins "Over 25 years ago, Congress transformed federal freight rail transportation policy. At that time, after almost 100 years of economic regulation, the railroad industry was in serious economic decline, with rising costs, losses, and bankruptcies. In response, Congress passed the Railroad Revitalization and Regulatory Reform Act of 1976 and the Staggers Rail Act of 1980. Together, these pieces of legislation substantially deregulated the railroad industry. Since the passage of the Staggers Rail Act in 1980, we have issued several reports on the freight railroad industry. In October 2006, we issued our most recent report on the freight rail industry. Testimony issued by the Government Accountability Office with an abstract that begins "The Department of Defense (DOD) began the Evolved Expendable Launch Vehicle (EELV) program in 1995 to provide a new generation of launch vehicles to ensure affordable access to space for government satellites. In November 1997, based on commercial forecasts at that time, the Office of the Secretary of Defense (OSD) approved maintaining competition between two contractors, and in 1998, DOD competitively awarded “other transaction agreements” to Boeing and Lockheed Martin for the development and the associated launch infrastructure to meet EELV program requirements. In 2005, DOD revised the EELV acquisition strategy to reflect the collapse of the commercial launch market and the ensuing erosion of the industrial base which DOD believed threatened its assured access to space. In acknowledging the government's role as the primary EELV customer, the new strategy maintained assured access to space by funding two product lines of launch vehicles. Shortly afterwards, Boeing and Lockheed Martin announced plans to consolidate their launch operations into a joint venture—United Launch Alliance (ULA).
