Wetland Issues (open access)

Wetland Issues

Wetlands, in a wide variety of forms, are found throughout the country. The various values of these areas have been increasingly recognized in recent years, but the remaining acreage continues to disappear. When European settlers first arrived, total wetland acreage was more than 220 million acres in the lower 48 states, according to estimates by the U.S. Fish and Wildlife Service. It estimates that by 1997 total wetland acreage was 105.5 million acres. Losses continue, although the rate of loss has slowed considerably during the past decade and restoration efforts have grown, and some regions are approaching the national policy goal of no-net-loss. Recent losses have been concentrated in forested wetlands, and net losses are greatest in the eastern United States.

Computer Services Personnel: Overtime Pay Under the Fair Labor Standards Act

The Fair Labor Standards Act of 1938 (FLSA), as amended, is the primary federal statute in the area of minimum wages and overtime pay. Through administrative rulemaking, the Secretary of Labor has established two tests through which to define eligibility under the Section 13(a)(1) exemption: a duties test and an earnings test. In the 106th Congress, legislation was introduced by Representatives Andrews and Lazio that would have increased the scope of the exemption: first, by expanding the range of exempt job titles, and then, through a relative reduction in the value of the earnings threshold or test. For example, were the minimum wage increased to $6.15 per hour, as pending proposals would do, the value of the computer services exemption threshold would be 4.5 times the federal minimum wage. Ultimately, neither bill was enacted, but the issue has re-emerged as H.R. 1545 (Andrews) and H.R. 546 (Quinn).

The Community Reinvestment Act (CRA) addresses how banking institutions meet credit needs in low- and moderate-income (LMI) neighborhoods. This report informs the congressional debate concerning the CRA's effectiveness in incentivizing bank lending and investment activity to LMI borrowers. After a discussion of the CRA's origins, it presents the CRA's examination process and bank activities that are eligible for consideration of CRA credits. Next, it discusses the difficulty of determining the CRA's influence on bank behavior.

Salvage Timber Sales and Forest Health

Interest in salvaging timber has increased markedly since extensive forest fires in 1994. The focus is to use the dead and dying timber before it goes to waste and to increase the supply of Federal timber available to the wood products industry. Supporters also note that salvage sales are one tool that can be used to improve forest health. Critics counter that some dead and dying trees are necessary for healthy ecosystems, and that salvage sales are costly to the U.S. Treasury and to the environment. This report describes the concerns over forest health, and then examines the benefits, costs, and financial consequences of salvage timber sales.

Each fiscal year, Congress appropriates funds for grants to state and local governments to further national goals and assist sub-national governments. Examples of goals include attaining minimum national standards and improving program effectiveness. The federal government provides grants for numerous substantive purposes, such as crime prevention, community development, and transportation. In 1999, grants-in-aid to state and local governments totaled $270 billion. Grants can be classified by the substantive purposes they address. This report, however, reviews the fundamental characteristics according to which they can also be classified. Examples of grant characteristics include range of eligible activities, objectives, award process, and administrative requirements.
