His, Hers, and Theirs: Domestic Relations and Marital Property Law in Texas to 1850

Texas law regarding the legal status of women and their property rights developed from the mingling of Spanish and English laws. Spanish laws regarding the protection of women's rights developed during the centuries-long Reconquest, when the Spanish Christians slowly took back the Iberian Peninsula from the Moorish conquerors. Women were of special importance to the expansion of Spanish civilization. Later, when Spain conquered and colonized the New World, these rights for women came, too. In the New World, women's rights under Spanish law remained the same as in Spain. Again, the Spanish were spreading their civilization across frontiers and women needed protection. When the Spanish moved into Texas, they brought their laws with them yet again. Archival evidence demonstrates that Spanish laws in early Texas remained essentially unchanged with regard to the status of women. Events in the history of England caused its legal system to develop in a different manner from Spain's. In England, the protection of property was the law's most important goal. With the growth of English common law, husbands gained the right to control their wives's lives in that married women lost all legal identity. The Historical Development of the University of Texas of the Permian Basin, Odessa, Texas

The University of Texas of the Permian Basin (UTPB) is a public university that serves over 4,500 undergraduate and graduate students as a branch of the University of Texas system located in Odessa, Ector County, Texas. The UTPB was established as an upper-division and graduate school on February 4, 1969, and first opened its doors to students in September, 1973. This historical study focuses on the development and progress of the UTPB from its inception until it was elevated from an upper-level institution to a four-year university twenty-two years later. The formation, mission, and curriculum are examined as well as are faculty and student characteristics and support. This study addresses the background history of higher education in the region, the role of community and college leaders in the UTPB's creation and struggle for four-year status, and the UTPB's unique features. The study was conducted by collecting data from available primary and secondary sources. The written data were then subjected to both external and internal criticism to determine the authorship and meaning of the documents. Frontier Defense in Texas: 1861-1865

The Texas Ranger tradition of over twenty-five years of frontier defense influenced the methods by which Texans provided for frontier defense, 1861-1865. The elements that guarded the Texas frontier during the war combined organizational policies that characterized previous Texas military experience and held the frontier together in marked contrast to its rapid collapse at the Confederacy's end. The first attempt to guard the Indian frontier during the Civil War was by the Texas Mounted Rifles, a regiment patterned after the Rangers, who replaced the United States troops forced out of the state by the Confederates. By the spring of 1862 the Frontier Regiment, a unit funded at state expense, replaced the Texas Mounted Rifles and assumed responsibility for frontier defense during 1862 and 1863. By mid-1863 the question of frontier defense for Texas was not so clearly defined as in the war's early days. Then, the Indian threat was the only responsibility, but the magnitude of Civil War widened the scope of frontier protection. From late 1863 until the war's end, frontier defense went hand in hand with protecting frontier Texans from a foe as deadly as Indians—themselves. A Comparative Content Analysis of Texas and Thai High School Biology Textbooks

There were two purposes of this study. The first was that of determining, through an analysis of Texas and Thai biology textbooks, which objectives -- cognitive, affective, manual skill, processes of scientific inquiry, and orientation—were emphasized in three major and twenty-seven minor fields of biology. The second purpose was to determine if significant differences exist in the frequency distribution of these objectives. Only one biology program is used in schools throughout Thailand. This program, which was published by the Ministry of Education, consists of four textbooks with 1977 copyright date. The five Texas textbooks used in this study were those adopted under the provisions of the Textbook Law. The contents of each of the six texts included in the study were classified by using the criteria of Klopfer's Table of Specifications for Science Education.

Economic Development in Texas During Reconstruction, 1865-1875

The study challenges many traditional stereotypes of Texas during Reconstruction. Contrary to what Democrats charged, the Davis government did not levy exorbitant taxes. Radical taxes seemed high in comparison to antebellum taxes, because antebellum governments had financed operations with indemnity bonds, but they were not high in comparison to taxes in other states. Radical taxes constituted only 1.77 percent of the assessed value of property in Texas, which was lower than the average for the United States and about the same for other states undergoing Reconstruction. In Texas most of the tax increases during Reconstruction were made necessary by the Civil War and the increase in population. The tax increases paid for state and local governments, frontier and local protection, public buildings, internal improvements, and public schools. Edmund J. Davis, Radical governor, contributed significantly to Texas government when he attempted to focus attention on reforming the tax system,limiting state expenses to state income, limiting state aid for railroad companies, and protecting the public from railroad company abuses.

Masters No More: Abolition and Texas Planters, 1860-1890

This dissertation is a study of the effects of the abolition of slavery on the economic and political elite of six Texas counties between 1860 and 1890. It focuses on Austin, Brazoria, Colorado, Fort Bend, Matagorda, and Wharton Counties. These areas contain the overwhelming majority of Stephen F. Austin's "Old Three Hundred," the original American settlers of Texas. In addition to being the oldest settled region, these counties contained many of the wealthiest slaveholders within the state. This section of the state, along with the northeast along the Louisiana border, includes the highest concentration of Texas' antebellum plantations. This study asks two central questions. First, what were the effects of abolition on the fortunes of the planter class within these six counties? Did a new elite emerge as a result of the end of slavery, or, despite the liquidation of a substantial portion of their estates, did members of the former planter class sustain their economic dominance over the counties? Second, what were abolition's effects on the counties' prewar political elite, defined as the county judge? Who were in power before the war and who were in power after it? Did abolition contribute to a new kind of politician?

Many historians have acknowledged the temptation to portray people as they see themselves and wish to be seen, blending history and ideology. The result is "mythistory." Twentieth century Texas writers and historians, remarking upon the exceptional durability of the Texas mythistory that emerged from the nineteenth century, have questioned its resistance to revision throughout the twentieth century. By placing the writing of Texas history within the context of American and European intellectual climates and history writing generally, from the close of the eighteenth century to the beginning of the twentieth, it is possible to identify a pattern that provides some insight into the popularity and persistence of Texas mythistory.

Cattle Capitalists: The XIT Empire in Texas and Montana

The Texas Constitution of 1876 set aside three million acres of Texas public land in exchange for construction of the monumental red granite Capitol that continues to house Texas state government today. The Capitol project and the land went to an Illinois syndicate led by men influential in business and politics. Austin's statehouse is a recognizable symbol of Texas around the world. So too, the massive Panhandle tract given in exchange -- what became the "fabulous" XIT Ranch -- has come to, for many, symbolize Texas and its role in the nineteenth century cattle boom. After finding sales prospects for the land, known as the Capitol Reservation, weak at the time, backed by British capital, the Illinois group, often called the Capitol Syndicate, turned their efforts to cattle ranching to satisfy investors until demand for the land increased. The operation included a satellite ranch in Montana to which two-year-old steers from Texas were sent for fattening, often "over the trail" on a route increasingly blocked by people and settlement. The Confederate Pension Systems in Texas, Georgia, and Virginia: The Programs and the People

The United States government began paying pensions to disabled Union veterans before the Civil War ended in April 1865. By 1890 its pension programs included any Union veteran who had fought in the Civil War, regardless of his financial means, as well as surviving family members, including mothers, fathers, brothers, and sisters. Union veterans did not hesitate to "wave the bloody shirt" in their attempts to liberalize pension laws. Pension programs for Confederate veterans were much slower to develop. Lacking any higher organization, each southern state assumed the responsibility of caring for disabled and/or indigent Confederate veterans and widows. Texas began paying Confederate pensions in 1899, Georgia in 1888 and Virginia in 1889. Unlike Texas, Georgia and Virginia provided artificial limbs for their veterans long before they started paying pensions. At the time of his enlistment in the 1860s, the typical future pensioner was twenty-five years of age, and fewer than half were married heads of households. Very few could be considered wealthy and most were employed in agriculture. The pensioners of Georgia, Texas, and Virginia were remarkably similar, although there were some differences in nativity and marital status. They were all elderly and needy by the time they asked …

Mary Jones: Last First Lady of the Republic of Texas

Abstract This dissertation uses archival and interpretive methods to examine the life and contributions of Mary Smith McCrory Jones in Texas. Specifically, this project investigates the ways in which Mary Jones emerged into the public sphere, utilized myth and memory, and managed her life as a widow. Each of these larger areas is examined in relation to historiographicaly accepted patterns and in the larger context of women in Texas, the South, and the nation during this period. Mary Jones, 1819-1907, experienced many of the key early periods in Anglo Texas history. The research traces her family’s immigration to Austin’s Colony and their early years under Mexican sovereignty. The Texas Revolution resulted in her move to Houston and her first brief marriage. Following the death of her husband she met and married Anson Jones, a physician who served in public posts throughout the period of the Texas Republic. Over time Anson was politically and personally rejected to the point that he committed suicide. This dissertation studies the effects this death had upon Mary’s personal goals, her use of a widow’s status to achieve her objectives, and her eventual emergence as a “Professional Widow.” Mary Jones’s attempts to rehabilitate her husband’s public …

The Old Alcalde: Oran Milo Roberts, Texas's Forgotten Fire-Eater

Oran Milo Roberts was at the center of every important event in Texas between 1857 and 1883. He served on the state supreme court on three separate occasions, twice as chief justice. As president of the 1861 Secession Convention he was instrumental in leading Texas out of the Union. He then raised and commanded an infantry regiment in the Confederate Army. After the Civil War, Roberts was a delegate to the 1866 Constitutional Convention and was elected by the state legislature to the United States Senate, though Republicans in Congress refused to seat him. He served two terms as governor from 1879 to 1883. Despite being a major figure in Texas history, there are no published biographies of Roberts. This dissertation seeks to examine Roberts's place in Texas history and analyze the factors that drove him to seek power. It will also explore the major events in which he participated and determine his historical legacy to the state.

The Administration of Unemployment Relief by the State of Texas during the Great Depression, 1929-1941

During the Great Depression, for the first time in its history, the federal government provided relief to the unemployed and destitute through myriad New Deal agencies. This dissertation examines how "general relief" (direct or "make-work") from federal programs—primarily the Emergency Relief and Construction Act (ERCA) and Federal Emergency Relief Administration (FERA)—was acquired and administered by the government of Texas through state administrative agencies. These agencies included the Chambers of Commerce (1932-1933), Unofficial Texas Relief Commission (1933), Texas Rehabilitation and Relief Commission (1933), Official Texas Relief Commission (1933-1934), Texas Relief Commission Division of the State Board of Control (1934), and the Department of Public Welfare (1939). Overall, the effective administration of general relief in the Lone Star State was undermined by a political ideology that persisted from, and was embodied by, the "Redeemer" Constitution of 1876.

A General Diffusion of Knowledge: Republican Efforts to Build a Public School System in Reconstruction Texas

From the early days as a Spanish colony Texas attracted settlers with the promise of cheap fertile land. During the period of Mexican control the population of Texas increased and a desire for public education manifested among the people. Through the end of the Civil War government in Texas never provided an adequate means for educating the children of the region. Even when funds became available with the Compromise of 1850 the state only established a school fund to help offset the costs of education, but did not provide a public school system. The first truly successful attempt at mass education in Texas came after the Civil War with the work of the Freedmen’s Bureau. The bureau helped the former slaves adjust to the emerging post war society through a variety of means such as education. In spite of its short existence the bureau managed to educate thousands of African Americans. By 1870 the former slaves wanted more education for their children, and Texans of all races began to see the need for a public school system. Implementation and Administration of Radical Education in Texas: Politics or Reform in Education from 1870-1873

This study examines the efforts of Radicals (Republicans) to establish a state-wide public school system in Texas between 1870 and 1873. Primary sources cover the chronological fringes of the period being examined. This study follows a chronological narrative with the four chapters examining first, educational trends in the southern states and Texas prior to Reconstruction, followed by examination of the Radical system in Texas, and, finally, its destruction by Conservative Texans. The final chapter focuses on immediate and long range results of Radical education. In examining the Radical educational program, an attempt has been made to dispel ideas popularly held by present-day Texans who believe that the Radical school program was simply another "carpetbagger" scheme for raiding the state treasury and building Radical patronage. This paper contends that the Radicals established as good a public school system as could be created at the time, and that it was administered in an honest and efficient manner. The system was destroyed by politicians and a grass roots revolt of taxpayers who had no faith in its methods, goals, or administrators.

The Relationship Between Tax Relief Implementation and Public School Finance in the State of Texas

The problem of this study is to determine whether or not Texas public schools lost revenue when constitutionally mandated tax relief measures were implemented. The study also traces the evolution of tax relief legislation in Texas from 1969 to 1980. Superintendents from randomly selected school districts identified educational program adjustments required if revenues were reduced. Superintendents also identified educational and property tax issues of concern to district constituents.

Passing as Gray: Texas Confederate Soldiers' Body Servants and the Exploitation of Civil War Memory

This dissertation is an examination of the interactions of enslaved body servants with their Texas Confederate masters from the American Civil War through the early twentieth century. The seven chapters of this study follows the story of these individuals from the fires of the Civil War, through the turbulence of Reconstruction in Texas, the codification of "Lost Cause" memory in the American South, and the exploitation of that memory by both former body servants and their ex-Confederate counterparts. This study demonstrates that the primary experience of blacks in the Confederate service was not as soldiers, but as enslaved laborers and body servants. Body servants, or camp slaves, were physically and in some cases emotionally close to their enslavers in this war-time environment and played an important part in Confederate logistics and camp life. As freed peoples after the war, former body servants found ways to use the bonds forged during the war and the flawed ideas of Lost Cause memory as a means to navigate the brutal realities of life in post-Civil War Texas. The impact of four basic capital project funding models for state participation was determined for the school districts in Texas. A review of the historical background for funding of capital projects and improvements by states was followed by a review of the historical background of state support for funding capital projects in the State of Texas. Additionally, the current funding models and methods of determining need were reviewed for all of the states. This historical review revealed that facility funding, like aid for maintenance and operation, has evolved with all the states at different stages.

Burying the War Hatchet: Spanish-Comanche Relations in Colonial Texas, 1743-1821

This dissertation provides a history of Spanish-Comanche relations during the era of Spanish Texas. The study is based on research in archival documents, some newly discovered. Chapter 1 presents an overview of events that brought both people to the land that Spaniards named Texas. The remaining chapters provide a detailed account of Spanish-Comanche interaction from first contact until the end of Spanish rule in 1821. Although it is generally written that Spaniards first met Comanches at San Antonio de Béxar in 1743, a careful examination of Spanish documents indicates that Spaniards heard rumors of Comanches in Texas in the 1740s, but their first meeting did not occur until the early 1750s. From that first encounter until the close of the Spanish era, Spanish authorities instituted a number of different policies in their efforts to coexist peacefully with the Comanche nation. The author explores each of those policies, how the Comanches reacted to those policies, and the impact of that diplomacy on both cultures. Spaniards and Comanches negotiated a peace treaty in 1785, and that treaty remained in effect, with varying degrees of success, for the duration of Spanish rule. From Lost Cause to Female Empowerment: The Texas Division of the United Daughters of the Confederacy, 1896-1966

The Texas Division of the United Daughters of the Confederacy (UDC) organized in 1896 primarily to care for aging veterans and their families. In addition to this original goal, members attempted to reform Texas society by replacing the practices and values of their male peers with morals and behavior that UDC members considered characteristic of the antebellum South, such as self-sacrifice and obedience. Over time, the organization also came to function as a transition vehicle in enlarging and empowering white Texas women's lives. As time passed and more veterans died, the organization turned to constructing monuments to recognize and promote the values they associated with the Old South. In addition to celebrating the veteran, the Daughters created a constant source of charity for wives and widows through a Confederate Woman's Home. As the years went by, the organization turned to educating white children in the “truth of southern history,” a duty they eagerly embraced. The Texas UDC proved effective in meeting its primary goal, caring for aging veterans and their wives. The members' secondary goal, being cultural shapers, ultimately proved elusivenot because the Daughters failed to stress the morals they associated with the Old South but because Texans never embraced …

A Stranger Amongst Strangers: An Analysis of the Freedmen's Bureau Subassistant Commissioners in Texas, 1865-1868

This dissertation is a study of the subassistant commissioners of the Freedmen's Bureau in Texas from late 1865 to late 1868. Its focus is two-fold. It first examines who these men were. Were they northern born or southern? Did they own slaves? Were these men rich, poor, or from the middle-class? Did they have military experience or were they civilians? How old was the average subassistant commissioner in Texas? This work will answer what man Freedmen's Bureau officials deemed qualified to transition the former slave from bondage to freedom. Secondly, in conjunction with these questions, this work will examine the day-to-day operations of the Bureau agents in Texas, chronicling those aspects endemic to all agents as well as those unique to certain subdistricts. The demand of being a Bureau agent was immense, requiring long hours in the office fielding questions and long hours in the saddle inspecting subdistricts. In essence, their work advising, protecting, and educating the freedmen was a never ending one. The records of the Freedmen's Bureau, both the records for headquarters and the subassistant commissioners, serve as the main sources, but numerous newspapers, Texas state official correspondences, and military records proved helpful. Evolution, Not Revolution: The Effect of New Deal Legislation on Industrial Growth and Union Development in Dallas, Texas

The New Deal legislation of the 1930s would threaten Dallas' peaceful industrial appearance. In fact, New Deal programs and legislation did have an effect on the city, albeit an unbalanced mixture of positive and negative outcomes characterized by frustrated workers and industrial intimidation. To summarize, the New Deal did not bring a revolution, but it did continue an evolutionary change for reform. This dissertation investigated several issues pertaining to the development of the textile industry, cement industry, and the Ford automobile factory in Dallas and its labor history before, during, and after the New Deal. New Deal legislation not only created an avenue for industrial workers to achieve better representation but also improved their working conditions. Specifically focusing on the textile, cement, and automobile industries illustrates that the development of union representation is a spectrum, with one end being the passive but successful cement industry experience and the other end being the automobile industry union efforts, which were characterized by violence and intimidation. These case studies illustrate the changing relationship between Dallas labor and the federal government as well as their local management. Challenges to the open shop movement in Dallas occurred before the creation of the New Deal, but …
