Commuter Rail: Many Factors Influence Liability and Indemnity Provisions, and Options Exist to Facilitate Negotiations

A letter report issued by the Government Accountability Office with an abstract that begins "The National Railroad Passenger Corporation (Amtrak) and commuter rail agencies often share rights-of-way with each other and with freight railroads. Negotiating agreements that govern the shared use of infrastructure can be challenging, especially on issues such as liability and indemnity. As requested, this report discusses (1) the liability and indemnity provisions in agreements among passenger and freight railroads, and the resulting implications of these provisions; (2) federal and state court opinions and Surface Transportation Board (STB) decisions related to contractual liability and indemnity provisions of passenger and freight railroad agreements; (3) factors that influence the negotiations of liability and indemnity provisions among passenger and freight railroads; and (4) potential options for facilitating negotiations of liability and indemnity provisions. GAO obtained information from all existing and proposed commuter rail agencies, Amtrak, and major freight railroads through site visits or telephone interviews. GAO analyzed the liability and indemnity provisions in agreements between commuter rail agencies, Amtrak, and freight railroads. Examination of Al- 1.65w/o Pu and Al- 12 w/o Si- 1.65 w/o Pu capsules irradiated 55- 60% burnout of the plutonium atoms revealed a 1.4% volume increase and no apparent microstructural changes. A four rod cluster containing Al-8 w/o Pu and Al-12 w/o Si-8 w/o Pu alloy cores is currently under irradiation in Loop 3 of KE Reactor at a water temperature of approximately 230C. A second cluster has been fabricated an is scheduled for charging late in 1958. Two seven-rod clusters for irradiation in KER are also being fabricated.

Design, fabrication, and initial operation of HTGR-ORR capsule OF-2

The OF-2 irradiation experiment was designed and built to test candidate High-Temperature Gas-Cooled Reactor (HTGR) fuel and fuel-rod matrix designs. The capsule was designed with two separate specimen cells, allowing for independent temperature control as well as independent fission gas release measurements. The OF-2 capsule is presently operating at the Oak Ridge Research Reactor (ORR). Initial fuel rod linear heat rates are between 16.4 and 23.0 kW/m (5 and 7 kW/ft) and fuel centerline temperatures are approximately 1150 and 1350/sup 0/C. Plans are to operate the capsule for nine ORR cycles to accumulate a maximum damage fluence of 9 x 10/sup 21/ neutrons/cm/sup 2/ (E > 0.18 MeV).
