A letter report issued by the General Accounting Office with an abstract that begins "The North American Free Trade Agreement (NAFTA) allowed Mexican commercial trucks to travel throughout the United States. Because of concerns about the safety of these vehicles, the United States has limited Mexican truck operations to commercial zones near the border. Relatively few Mexican carriers are expected to operate beyond these commercial zones once the United States fully opens its highways to Mexican carriers. Specific regulatory and economic factors that may limit the number of Mexican carriers operating beyond the commercial zones include (1) the lack of established business relationships beyond the U.S. commercial zones that permit drivers to return to Mexico carrying cargo, (2) difficulties obtaining competitively priced insurance, (3) congestion and delays in crossing the U.S.-Mexico border that make long-haul operations less profitable, and (4) high registration fees. Over time, improvements in trucking and border operations may increase the number of Mexican commercial vehicles traveling beyond the commercial zones. To reduce these numbers, the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) nearly doubled funding for the Federal Highway Administration's (FHWA) Highway Safety Improvement Program (HSIP). SAFETEA-LU added requirements for states to develop strategic highway safety plans that include four key elements and to publicly report on at least the top 5 percent of hazardous locations on all of their public roads. The act also set aside funds for a legacy rail-highway crossing program and a new high-risk rural road program. As requested, GAO examined (1) states' implementation of HSIP following SAFETEA-LU, (2) HSIP results to date, and (3) FHWA's guidance and assistance to states. Federal law, however, does not recognize any accepted medical use for marijuana and individuals remain subject to federal prosecution for marijuana possession. Debate continues over medical effectiveness of marijuana, and over government policies surrounding medical use. State laws in Oregon, Alaska, Hawaii, and California allow medical use of marijuana under specified conditions. All four states require a patient to have a physician's recommendation to be eligible for medical marijuana use. Alaska, Hawaii, and Oregon have established state-run registries for patients and caregivers to document their eligibility to engage in medical marijuana use; these states require physician documentation of a person's debilitating condition to register. Laws in these states also establish maximum allowable of marijuana for medical purposes. California's law does not establish a state-run registry or establish maximum allowable amounts of marijuana. Relatively few people had registered to use marijuana for medical purposes in Oregon, Hawaii, and Alaska. These data--which are collected manually by CBP officers--are unreliable because CBP officers inconsistently implement an approved data collection methodology, and the methodologies used vary by crossing. Although illegal alien apprehensions have shifted, there is no clear indication that overall illegal entry into the United States along the Southwestern border has declined. INS' current efforts to measure the effectiveness of its border control efforts could be enhanced by analyzing the data in its automated biometric identification system (IDENT). However, U.S. citizens are required to establish citizenship to a CBP officer's satisfaction. On its Web site, U.S. Customs and Border Protection (CBP) advises U.S. citizens that an officer may ask for identification documents as proof of citizenship, including birth certificates or baptismal records and a photo identification document. In 2003, we testified that CBP officers were not readily capable of identifying whether individuals seeking entry into the United States were using counterfeit identification to prove citizenship. Specifically, our agents were able to easily enter the United States from Canada and Mexico using fictitious names and counterfeit driver's licenses and birth certificates. Later in 2003 and 2004, we continued to be able to successfully enter the United States using counterfeit identification at land border crossings, but were denied entry on one occasion. Because of Congress's concerns that these weaknesses could possibly be exploited by terrorists or others involved in criminal activity, Congress requested that we assess the current status of security at the nation's borders. In 2002, there were 42,815 fatalities and over 2.9 million injuries on the nation's highways. Crashes on rural roads (roads in areas with populations of less than 5,000) account for over 60 percent of the deaths nationwide, or about 70 deaths each day. Further, the rate of fatalities per vehicle mile traveled on rural roads was over twice the urban fatality rate. The agency estimates that its inspectors have the ability to annually inspect less than 1 percent of the railroad activities covered in regulation. As a result, railroads have the primary responsibility for safety of the railroad system. To formulate regulations, FRA instituted the Railroad Safety Advisory Committee, a forum for FRA, the railroads, rail labor organizations, and other stakeholders to arrive at a consensus on proposed rules. Border Security: Agencies Need to Better Coordinate Their Strategies and Operations on Federal Lands

A letter report issued by the General Accounting Office with an abstract that begins "Since the mid-1990s--and especially since September 11--the government has focused attention and resources on preventing illegal aliens, drug smugglers, and potential terrorists from entering the United States across its land borders with Mexico and Canada. The Border Patrol is responsible for protecting the nation's borders. However, a significant portion of the borderlands are federal or tribal lands managed by the Bureau of Indian Affairs, Bureau of Land Management, Fish and Wildlife Service, National Park Service, and Forest Service. Realizing the importance of coordinating federal law enforcement efforts, GAO agreed to assess: (1) border-related law enforcement challenges for land management agencies in Arizona and Washington, (2) resources land management agencies have received to address these challenges, and (3) how the Border Patrol and land management agencies coordinate border-related law enforcement efforts."

Firearms Trafficking: U.S. Efforts to Combat Arms Trafficking to Mexico Face Planning and Coordination Challenges

A letter report issued by the Government Accountability Office with an abstract that begins "In recent years, violence along the U.S.-Mexico border has escalated dramatically, due largely to the Mexican government's efforts to disrupt Mexican drug trafficking organizations (DTO). U.S. officials note the violence associated with Mexican DTOs poses a serious challenge for U.S. law enforcement, threatening citizens on both sides of the border, and U.S. and Mexican law enforcement officials generally agree many of the firearms used to perpetrate crimes in Mexico are illicitly trafficked from the United States across the Southwest border. GAO was asked to examine (1) data on the types, sources, and users of these firearms; (2) key challenges confronting U.S. government efforts to combat illicit sales of firearms in the United States and stem the flow of them into Mexico; (3) challenges faced by U.S. agencies collaborating with Mexican authorities to combat the problem of illicit arms; and (4) the U.S. government's strategy for addressing the issue. GAO analyzed program information and firearms data and met with U.S. and Mexican officials on both sides of the border."
