Transcript of the fifth public hearing held by the National Commission on Terrorist Attacks upon the United States held November 19, 2003 at Drew University in Madison, New Jersey. The Commission heard from New Jersey Governor James E. McGreevey; four panels of business officials and federal, state, and local government representatives; and individuals working to enhance emergency preparedness in the private sector.

This report provides background information and policy analysis pertinent to proposals to restructure first responder assistance programs. Specifically, this report provides information on existing programs, appropriations, legislation in the 108th Congress, and selected policy issues. This report does not discuss all relevant policy issues, but, rather, those issues that may be germane to any significant restructuring of existing programs.

A letter report issued by the Government Accountability Office with an abstract that begins "Market participants indicated that primary market disclosure for municipal securities—official statements—generally provides useful information, but investors and market participants cited a number of limitations to continuing disclosures. The most frequently cited limitations were timeliness, frequency, and completeness. For example, investors and other market participants said that issuers do not always provide all the financial information, event notices, or other information they pledged to provide for the lifetime of a security. While GAO's analysis of current regulatory requirements for municipal securities disclosure found that they largely reflected the seven principles of effective disclosure, regulators and market participants said that there are some limitations on the enforceability and efficiency of the regulations. However, the effect of these limitations on individual investors largely is unknown because limited information exists about the extent to which individual investors use disclosures to make investment decisions. Nevertheless, regulators remain concerned about this market, in part due to its size and the participation of individual investors. As discussed below, the Securities and Exchange Commission (SEC) and Municipal Securities Rulemaking Board (MSRB) have been taking or plan to take actions to improve disclosure."

This report examines debates over what constitutes an unfunded federal mandate and UMRA's implementation. It focuses on UMRA's requirement that CBO issue written cost estimate statements for federal mandates in legislation, its procedures for raising points of order in the House and Senate concerning unfunded federal mandates in legislation, and its requirement that federal agencies prepare written cost estimate statements for federal mandates in rules. It also assesses UMRA's impact on federal mandates and arguments concerning UMRA's future, focusing on UMRA's definitions, exclusions, and exceptions which currently exempt many federal actions with potentially significant financial impacts on nonfederal entities.

The Congressional Research Service (CRS) developed the Congressional Oversight Manual over 30 years ago. Over the years, CRS has assisted many Members, committees, party leaders, and staff aides in the performance of the oversight function: the review, monitoring, and supervision of the implementation of public policy.

This report tracks the process by which Congress provides the funding for U.S. assessed contributions to the regular budgets of the United Nations, its agencies, and U.N. peacekeeping operation accounts, as well as for U.S. voluntary contributions to U.N. system programs and funds. It includes information on the President's request and the congressional response, as well as congressional initiatives during this legislative process. Basic information is provided to help the reader understand this process.

Throughout its history, Congress has engaged in oversight of the executive branch - the review, monitoring, and supervision of the implementation of public policy. The first several Congresses inaugurated such important oversight techniques as special investigations, reporting requirements, resolutions of inquiry, and use of the appropriations process to review executive activity. Contemporary developments, moreover, have increased the legislature's capacity and capabilities to check on and check the Executive. Public laws and congressional rules have measurably enhanced Congress's implied power under the Constitution to conduct oversight.

Both Congress and the President have recognized the need to review and clarify the structure for overall leadership and coordination. The President recently requested that the Vice President oversee a coordinated national effort to improve national preparedness, including efforts to combat terrorism. Federal efforts to develop a national strategy to combat terrorism and related guidance have progressed, but key efforts remain incomplete. The first step toward developing a national strategy is to conduct a national threat and risk assessment. The Department of Justice and the Federal Bureau of Investigation have collaborated on such an assessment, but they have not formally coordinated with other departments and agencies on this task. Under current policy, the federal government also has improved its capabilities to respond to a domestic terrorist incident. A letter report issued by the General Accounting Office with an abstract that begins "Since 1986, China has narrowed the gap between the U.S. and Chinese semiconductor manufacturing technology from between seven to 10 years to two years or less. China's success in acquiring manufacturing technology from abroad has improved its semiconductor manufacturing facilities for more capable weapons systems and advanced consumer electronics. The multilateral Wassenaar Arrangement on Export Controls for Conventional Arms and Dual-Use Goods and Technologies has not affected China's ability to obtain semiconductor manufacturing equipment because the United States is the only member of this voluntary arrangement that considers China's acquisition of semiconductor manufacturing equipment a cause for concern. Under the Export Administration Regulations pertaining to China, the general licensing policy is to approve applications, except those items that would make a direct and significant contribution to specific areas of China's military. Furthermore, U.S. agencies have not done the analyses, such as assessing foreign availability of this technology or the cumulative effects of such exports on U.S. national security interests, necessary to justify such a practice or serve as the basis for licensing decisions.
