A letter report issued by the Government Accountability Office with an abstract that begins "Since its establishment in 2009, the Office of Government Information Services (OGIS) has provided comments on proposed Freedom of Information Act (FOIA) regulations for 18 of 99 federal agencies that administer FOIA, as well as a number of Privacy Act system of records notices. While OGIS has suggested improvements to a number of those regulations and notices, it has not performed the reviews of regulations and notices in a proactive, comprehensive manner, and has not conducted any reviews of agencies' compliance with the law. In addition, since it was established 4 years ago, the office has not developed a methodology for conducting reviews of agencies' FOIA policies and procedures, or for compliance with FOIA requirements. OGIS is in the early stages of developing a methodology for conducting such reviews, but has not established a time frame for completion. Until OGIS establishes a methodology and time frame for proactively reviewing agencies' FOIA policies, procedures, and compliance, the office will not be positioned to effectively execute its responsibilities as required by the act."

Treaty of Guadalupe Hidalgo: Definition and List of Community Land Grants in New Mexico

A letter report issued by the General Accounting Office with an abstract that begins "Until the mid-nineteenth century, Spain made land grants to towns and individuals to promote development in the frontier lands that now constitute the American Southwest. Under the Treaty of Guadalupe Hidalgo, which ended the Mexican-American War, the United States agreed to recognize ownership of property of every kind in the ceded areas. Many people, including grantee heirs, scholars, and legal experts, still claim that the United States did not protect the property of Mexican-Americans and their descendants, particularly the common lands of community grants. Land grant documents contain no direct reference to "community land grants," nor do Spanish and Mexican laws define or use this term. GAO did find, however, that some grants refer to lands set aside for general communal use or for specific purposes, including hunting, pasture, wood gathering, or watering. Scholars, the land grant literature, and popular terminology commonly use the phrase "community land grants" to denote land grants that set aside common lands for the use of the entire community. Federal Law Enforcement: Survey of Federal Civilian Law Enforcement Mandatory Basic Training

A letter report issued by the Government Accountability Office with an abstract that begins "Federal law enforcement officers (LEO) are required to complete mandatory basic training in order to exercise their law enforcement authorities. GAO was asked to identify federal mandatory law enforcement basic training programs. This report builds on GAO's prior work surveying federal civilian law enforcement components regarding their functions and authorities (see GAO-07-121, December 2006). GAO defined an LEO as an individual authorized to perform any of four functions: conduct criminal investigations, execute search warrants, make arrests, or carry firearms. In this report GAO describes (1) the mandatory basic law enforcement training that the components reported requiring their LEOs to complete and the federal law enforcement job series classifications for which basic training programs are mandatory; and (2) a breakdown of the delivery of the of basic training programs, by type of organization providing the training and location. To conduct this work, GAO administered a Web-based survey to 105 federal civilian law enforcement components. Each was requested to self-report on, required basic training programs for LEOs, the organizations conducting the training, training locations, and the job series for which programs are mandatory. A letter report issued by the Government Accountability Office with an abstract that begins "To help combat fraud and abuse in health care programs, including Medicare and Medicaid, Congress enacted the Health Care Fraud and Abuse Control (HCFAC) program as part of the Health Insurance Portability and Accountability Act of 1996 (HIPAA). HIPAA requires that the Departments of Health and Human Services (HHS) and Justice (DOJ) issue a joint annual report to Congress on amounts deposited to and appropriated from the Federal Hospital Insurance (HI) Trust Fund for the HCFAC program. In April 2005, GAO reported on the results of its review of HCFAC program activities for fiscal years 2002 and 2003 and made recommendations to HHS and DOJ. The objectives of this requested review were to assess the extent to which HHS and DOJ (1) took actions to address the recommendations made in the 2005 report and (2) designed effective controls over reporting HCFAC deposits and expenditures for fiscal years 2008 and 2009. GAO reviewed HHS and DOJ documentation; selected nongeneralizable samples; and interviewed agency officials."

Testimony issued by the Government Accountability Office with an abstract that begins "The Institute of Education Sciences (IES) supports high-quality research, according to stakeholders, but lacks certain key procedures needed to fulfill other aspects of its mission. Since its inception, IES has substantially improved the quality of education research. However, stakeholders expressed some concerns about IES's ability to produce timely and relevant research that meets their various needs. For example, IES's efforts to respond quickly to its stakeholders are slowed, in part, because the time IES's products have spent in peer review substantially increased this past year, and IES does not monitor some aspects of these timeframes. In addition, IES does not have a structured process for incorporating stakeholder input into its research agenda, which previous GAO work has shown to be key to sound federal research programs. Lastly, IES's performance measures do not fully reflect its current programs, which is not consistent with GAO's leading practices for performance management. IES officials said, however, that they have begun to develop new performance measures for all of their programs."

A letter report issued by the Government Accountability Office with an abstract that begins "The E-Government Act (E-Gov Act) of 2002 was enacted with the general purpose of promoting better use of the Internet and other information technologies to improve government services for citizens, internal government operations, and opportunities for citizen participation in government. Among other things, the act specifically requires the establishment of the Office of Electronic Government within the Office of Management and Budget (OMB) to oversee implementation of the act's provisions and mandates a number of specific actions, such as the establishment of interagency committees, completion of several studies, submission of reports with recommendations, issuance of a variety of guidance documents, establishment of new policies, and initiation of pilot projects. Further, the act requires federal agencies to take a number of actions, such as conducting privacy impact assessments, providing public access to agency information, and allowing for electronic access to rulemaking proceedings. OMB has linked several of the act's provisions to ongoing e-government initiatives that it has sponsored. Not all of the agencies with which GAO spoke used all of the practices, and the application of the practices varied among agencies. For example, to collect information about an incident—the first step of the process—the Bureau of Diplomatic Security within the Department of State collects incident reports, footage from security cameras, and interviews witnesses. To disseminate lessons learned—the fifth step—the Los Angeles Police Department produces a formal document after a critical incident that captures the lessons learned and disseminates the document to its units for use in planning, preparation, and coordination exercises."

Data on these risks--collected through a safety reporting system (SRS) from reports of hazards, incidents, and accidents--can support safety efforts. However, no such system exists for all biological labs, and a limited system--managed by the Centers for Disease Control and Prevention (CDC) and the Animal and Plant Health Inspection Service (APHIS)--applies to only a subset of these labs. While a national SRS has been proposed, design and implementation are complex. In this context, GAO was asked to identify lessons from (1) the literature and (2) case studies; and to apply those lessons to (3) assess CDC and APHIS's theft, loss, or release (TLR) system for select agents, such as anthrax, and (4) suggest design and implementation considerations for a labwide SRS. To do its work, GAO analyzed SRS literature; conducted case studies of SRSs in aviation, commercial nuclear, and health care industries; and interviewed agency officials and biosafety specialists."

Children's Mental Health: Concerns Remain about Appropriate Services for Children in Medicaid and Foster Care

A letter report issued by the Government Accountability Office with an abstract that begins "An annual average of 6.2 percent of noninstitutionalized children in Medicaid nationwide and 4.8 percent of privately insured children took one or more psychotropic medications, according to GAO's analysis of 2007-2009 data from the Department of Health and Human Services' (HHS) Medical Expenditure Panel Survey (MEPS). MEPS data also showed that children in Medicaid took antipsychotic medications (a type of psychotropic medication that can help some children but has a risk of serious side effects) at a relatively low rate--1.3 percent of children--but that the rate for children in Medicaid was over twice the rate for privately insured children, which was 0.5 percent. In addition, MEPS data showed that most children whose emotions or behavior, as reported by their parent or guardian, indicated a potential need for a mental health service did not receive any services within the same year. The Centers for Medicare & Medicaid Services (CMS) and many states have initiatives under way to help ensure that children receive appropriate mental health treatments. Its funding comes from its own private trust fund assets and federal appropriations. The Smithsonian Board of Regents, the Smithsonian's governing body, is responsible for the long-term stewardship of the Smithsonian. In recent years, GAO and others have documented (1) significant governance and accountability breakdowns at the Smithsonian, which could ultimately put funding and the organization's credibility at risk, and (2) the deterioration of the Smithsonian's facilities and the threat this deterioration poses to the Smithsonian's collections. This testimony discusses (1) the Smithsonian's status in implementing governance reforms recommended by its Governance Committee and by GAO in a 2008 report (GAO-08-632)--as discussed in a GAO report being released today (GAO-10-190R)--and (2) the Smithsonian's progress in implementing facilities and funding recommendations GAO made in a 2007 report (GAO-07-1127). The work for this testimony is based on GAO-10-190R and an analysis of documentary and testimonial evidence from Smithsonian officials.
