Federal Spending for Older Americans

The federal government currently spends more than one-third of its budget on benefits and programs for older Americans. For people age 65 and over, estimated FY2005 spending for Social Security, Medicare, and Medicaid alone is $713 billion. Spending for retired federal employees and military personnel and for veterans is also significant, and smaller programs add to the total as well. In addition, tax expenditures might be taken into account to obtain a more complete budget picture.

The Americans with Disabilities Act and Emergency Preparedness and Response

The Americans with Disabilities Act provides broad nondiscrimination protection for individuals with disabilities in employment, public services, and public accommodation and services operated by private entities. Although the ADA does not include provisions specifically discussing its application to disasters such as Hurricane Katrina, its nondiscrimination provisions are applicable to emergency preparedness and responses to disasters. For example, this would mean that emergency planning should include individuals with disabilities and that emergency shelters should be accessible to individuals with disabilities. In order to further the goals of the ADA, President Bush issues an Executive Order on Jluy 22nd, 2004relating to emergency preparedness for individuals with disabilities and establishing the Interagency Coordinating Council on Emergency Preparedness and Individuals with Disabilities. The Department of Homeland Security issued a Nationwide Plan Review Phase 2 Report, which includes a discussion of people with disabilities and emergency planning and readiness. The National Council on Disability has also issued a recommendation on emergency preparation and disaster relief relating to individuals with disabilities. Legislation has also been introduced to address the needs of individuals with disabilities in emergency planning and relief.

The Americans with Disabilities Act (ADA): Statutory Language and Recent Issues

The Americans with Disabilities Act, the ADA, provides broad nondiscrimination protection in employment, public services, public accommodations and services operated by public entities, transportation, and telecommunications for individuals with disabilities. The Supreme Court has decided fifteen ADA cases including four cases in the 2001-2002 Supreme Court term. This report will summarize the major provisions of the ADA and will discuss selected recent issues, including the Supreme Court cases. It will be updated as developments warrant.

Older Americans: Continuing Care Retirement Communities Can Provide Benefits, but Not Without Some Risk

A letter report issued by the Government Accountability Office with an abstract that begins "A growing number of older Americans are choosing continuing care retirement communities (CCRC) to help ensure that their finances in retirement will cover the cost of housing and care they may require. However, recent economic conditions have placed financial stress on some CCRCs. GAO was asked to (1) describe how CCRCs operate and the risks they face, (2) describe how state laws address these risks, (3) describe risks that CCRC residents face, and (4) describe how state laws address these risks. To review these areas, GAO analyzed state statutory provisions pertaining to CCRCs with respect to financial oversight and consumer protection, met with selected state regulators, and interviewed CCRC providers, resident's associations, and consumer groups. While GAO is not recommending specific action at this time, the potential risks to CCRC residents--as well as the potential for this industry to grow--highlight the importance of states being vigilant in their efforts to help ensure adequate consumer protections for residents. GAO provided a draft copy of this report to the Department of Health and Human Services and the National Association of Insurance Commissioners for review, but neither commented on …

Older Americans: Continuing Care Retirement Communities Can Provide Benefits, but Not Without Some Risk

Testimony issued by the Government Accountability Office with an abstract that begins "This testimoney discusses continuing care retirement communities (CCRC), the risks they and their residents face, and their regulation. A growing population of older Americans is seeking options for ensuring that their assets and income in retirement will cover the cost of their housing and health care needs. One option for meeting these long-term care needs is to enter a CCRC, which aims to provide lifelong housing, household assistance, and nursing care in exchange for a sometimes sizable entrance fee and ongoing monthly fees. These communities may appeal to older Americans because they offer an independent lifestyle for as long as possible but also provide the reassurance that, as residents age or become sick or frail, they will receive the care they need within the same community. But choosing to enter a CCRC can be a difficult decision and is not without risk. Moving to a CCRC generally involves a significant financial and emotional investment. This report discusses the Uniformed and Overseas Citizens Absentee Voting Act (UOCAVA), under which members of the uniformed services and U.S. citizens who live abroad are eligible to register and vote absentee in federal elections. The report discusses recent improvements to UOCAVA, necessary as the result of controversy surrounding ballots received in Florida from absentee voters in the 2000 presidential election. The report also discusses related legislation, such as the National Defense Authorization Act for FY2010, which provided for a major overhaul of UOCAVA.

Interview with Dr. Victor Rodriguez spotlighting significant insights into his storied and sterling career through five time dimensions: (1) his early all-Hispanic elementary school training; (2) his continued study and budding athletic prowess in the Edna, TX, school district; (3) his Victoria Junior College athletic achievements and learning; (4) his higher education art training, Geezle membership, and track accomplishments at North Texas State College; and (5) his 37-year career as a teacher, coach, and superintendent in the San Antonio (TX) school district. Inspired by his Anglo third-grade teacher in an all-Hispanic school in Edna, TX, Victor responded to his teacher's challenge to be a civic contributor by becoming a daily bell ringer at the local Catholic church (described in detail in his book, The Bell Ringer), a job requiring him to arise at 4:30 each morning and to run two miles one way amid nipping dogs to ring the bell. This discipline and activity would tap his athletic ability later as he surfaced as a distance district winner despite running barefoot, in blue jeans, and in an oversized t-shirt.
