Temporary alien worker programs are meant to assure employers, including growers, of an adequate supply of labor when and where it is needed without adding permanent residents to the U.S. population. Guest worker programs are not supposed to harm the wage and job opportunities of U.S. workers while they alleviate spot labor shortages. President Bush’s proposal of a broad guest worker program has reignited interest in legislation introduced during the 108th Congress that relates specifically to the agricultural industry.

Wetlands Regulation and the Law of Property Rights "Takings"

When a wetland owner is denied permission to develop, or offered a permit with very burdensome conditions, the property's value may drop substantially. Wetlands programs also may impose costly development delays. For these reasons, federal and state wetlands regulation continues to generate "takings" lawsuits by land owners. Such suits allege that by narrowing or eliminating the economic uses to which a wetland can be put, the government has "taken" (permanently or temporarily) the wetland under the Fifth Amendment Takings Clause.

Child Welfare: Social Security and Supplemental Security Income (SSI) Benefits for Children in Foster Care

This report begins with a discussion of the foster care system and the Social Security benefits available to eligible children, including those in foster care. It then describes the role of representative payees and their responsibilities. The report provides data on the use of Social Security benefits to reimburse states for child welfare, and includes a discussion of the Keffeler decision. Finally, the report concludes with proposals supported by some advocates to change the current practice of using SSI and other Social Security benefits to fund foster care, as well as with a discussion of state initiatives to screen all foster children for Social Security and to pass along some benefits to eligible children.

Closing Yucca Mountain: Litigation Associated with Attempts to Abandon the Planned Nuclear Waste Repository

Passed in 1982, the Nuclear Waste Policy Act (NWPA) was an effort to establish an explicit statutory basis for the Department of Energy (DOE) to dispose of the nation's most highly radioactive nuclear waste. The Obama Administration, in conjunction with DOE, has taken three important steps directed toward terminating the Yucca Mountain project. While the result of the ongoing dispute over the legality of the attempted termination of the Yucca Mountain program remains uncertain, congressional action could have a significant impact on the fate of the Yucca Mountain facility. A number of leading House Republicans have voiced strong opposition to shutting down the Yucca Mountain facility. Consequently, the Yucca Mountain dispute will not only be contested before the NRC and the D.C. Circuit, but also in Congress.

Indian Ocean Earthquake and Tsunami: Humanitarian Assistance and Relief Operations

On December 26, 2004, a magnitude 9.0 undersea earthquake off the west coast of northern Sumatra, Indonesia, unleashed a tsunami that affected more than 12 countries throughout south and southeast Asia and stretched as far as the northeastern African coast. Current official estimates indicate that more than 160,000 people are dead and millions of others are affected, including those injured, missing, or displaced, making this the deadliest tsunami on record. News reports suggest that the death toll may be well above 200,000. Sections of Indonesia, Sri Lanka, India, and Thailand have suffered the worst devastation. Eighteen Americans are confirmed dead, with another sixteen presumed dead, and 153 remain unaccounted for.
