An Analysis of Litigation against Kansas Educators and School Districts under the Kansas Tort Claims Act

This dissertation examines the significance of the Kansas Tort Claims Act of 1979 on state of Kansas court decisions in litigation against Kansas school districts and their employees. Through providing a historical perspective of the adoption and abolishment of the doctrine of sovereign immunity in the United States, which subsequently led to the enactment of the Federal Tort Claims Act, and ultimately led to the Kansas Tort Claims Act, the researcher analyzes pertinent case law and scholarly commentary pertaining to school negligence litigation. The goal of the analysis is to answer the following research question: How have Kansas state courts interpreted the Kansas Tort Claims Act in litigation against state school districts and their employees? Although the KTCA provides citizens with a vehicle for redress against governmental entities by virtue of tort claims, the KTCA also provides immunities from liability for governmental entities and their employees under exceptions to the KTCA. Most notably, the discretionary function exception and the recreational use exception are two exceptions to liability applied in a significant number of tort cases against Kansas school districts and employees. An Experimental Analysis of Preference Problems in a Self-Control Choice Procedure by Adults with Mental Retardation

The original purpose of this study was to determine if Tegretol has an effect on the impulsive behavior exhibited by people with mental retardation. This was to be accomplished through a replication of the self-control choice procedures used by Ragotzy, Blakely, and Poling (1988). The procedure involved three stages. First, subjects chose between stimuli that provided either one or three edibles. Then the stimuli associated with the smaller and larger edibles were reversed. Following this, the procedure required the implementation of successively longer delays to the larger reinforcer. However, none of the subjects who participated was able to make the discriminations necessary to proceed, i.e., the subjects did not systematically select the stimulus associated with the larger magnitude edible choice. The identification and rectification of these errors in discrimination became the focus of this study. Various procedures were used to enhance discrimination, including fading, adjusting the magnitude of the edibles, and stimulus changes. None of these changes was successful in teaching the subjects the necessary discriminations.

Oral History Interview with Robert Warren, March 28, 2022

The National Museum of the Pacific War presents an interview with Robert Warren. Warren was born in Frisco, Texas in February 1921. After graduating from high school, he attended Texas A&M participating in the ROTC program for two years. Upon graduation in 1942 he applied for a commission in the United States Army Air Forces and was accepted. After participating in various stages of flight training, he was assigned as a C-47 pilot. Flying the Northern Route over Greenland, he joined the 439th Troop Carrier Wing, 94th Squadron, 9th Air Force in England. He tells of being involved in Operation Market Garden and of crossing the Rhine, where he pulled Waco CG-4 gliders, and of the Battle of the Bulge where he hauled fuel for General Patton’s tanks.

Interview with Walter White concerning his experiences as a federal labor mediator and conciliator. White speaks of his his thirty-year career with the U.S. Conciliation Service and the Federal Mediation and Conciliation Service, as well as his early boyhood employment with International Harvester Company. He discusses the Depression and New Deal, the Kansas Employment Service, his employment with U.S. Potash Company and experiences with Mine, Mill, and Smelter Workers Union, and his employment with the U.S. Conciliation Service in 1942. White also explains labor-management relations during World War II, his personal experiences in the Omaha and Des Moines offices, the Taft-Hartley Act, the formation of Federal Mediation and Conciliation Service, and the post-World War II labor unrest. In addition, White talks about his transfer to Texas, his personal philosophy concerning labor-management relations, personal experiences with and comments about James Hoffa, Sid Richardson, and John Connally, and Eugene Debs.

Interview with Howard Charles, a Marine WWII veteran and POW from Partridge, Kansas. Charles discusses growing up in the Great Depression; joining the Marine Corps and training; assignment to the USS Houston (CA-30) at Manila as a heavy machine gunner and events before the war; the Battle of Sunda Strait and sinking of the Houston; capture by the Japanese and being held at Serang, Java; experiences in internment and forced labor at Bicycle Camp in Batavia, Changi Camp in Singapore, various camps along the Burma Railway, and Saigon; liberation; psychological treatment, trauma, and adjusting to civilian life. In appendix is a letter written by Charles to Marcello including additional information for the interview.
