Speech Rights of Public Employees in the World of Social Media

Legal rights for public employees are not clear in the area of social media speech. Following the Garcetti v Ceballos (2006) U.S. Supreme Court case, the pursuant to duty test was established. The social media speech of public employees, including educators, could be considered pursuant to their duties as an employee. This means that public employees are vulnerable to disciplinary action from their employer for social media speech. Furthermore, public employees are vulnerable even when they believe their social media speech is done as a private citizen. For this research study, 28 cases at the federal and state levels were analyzed. Seven of the examined cases were U.S. Supreme Court cases involving public employee speech rights. The other 21 cases were extracted from cases determined at the federal and state levels. The cases taking place after the Garcetti v Ceballos (2006) pursuant to duty test were analyzed to see how the test was applied to employee speech. Cases were also analyzed to see what other precedents from the courts had been applied. Additionally, private sector social media rights research was analyzed and reviewed to create more clarity for employees. The findings of the research show the courts have tested employee …

State Created Danger and Chronic Traumatic Encephalopathy in Texas Schools: A Legal Examination

The recent breakthroughs in the research of brain trauma as it relates to athletics has revealed never before seen damage linked with football participation. Known as chronic traumatic encephalopathy (CTE), it is caused by activities inherent to the sport of football. School sponsored football has been granted immunity through case law and legislation in Texas. Recent research however indicates a different type of injury than those that school districts have been protected of liability from. This will provide a challenge to the immunity school districts have enjoyed regarding football. One route to abrogation of immunity is the state created danger provision established by the Supreme Court. The Fifth Circuit Court whose jurisdiction includes Texas has yet to officially adopt the state created danger theory. This research examined legal precedent to determine the challenge CTE may present the various layers of immunity surrounding school sponsored football in Texas.

The purpose of this study is to ascertain the opinions of chief executive officers (CEOs) and school board chairs of Texas private schools in educational service center (ESC) Regions 10 and 11 toward board training and the potential benefits for the success of their respective roles. Literature regarding private school board training is limited. As a result, most private school boards face challenges regarding school board training expectations, which could affect their roles and the roles of CEOs. The quantitative and qualitative cross-sectional research design examined Texas private school CEOs’ and school board chairs’ perceptions about school board training and the working relationships between Texas school CEOs and school boards. The researcher developed the survey and interview questions used in this study. Responses to a 4-point Likert-type scale instrument, short answer questions, and interviews were solicited from a population of private school CEO and school board chairs within ESC Regions 10 and 11 from schools with an enrollment of at least 100 students and that contained Grades 9 through 12. Supporting and Retaining Beginning Teachers during COVID-19

This explanatory sequential mixed methods study was designed to determine, from the perspective of beginning teachers, the extent to which the COVID-19 pandemic affected their intentions to remain in teaching. There were two additional goals in conducting the study: (a) to determine the key practices, supports, or events that played a role in impacting teachers' intentions to remain in teaching during a crisis; and (b) to determine the key practices, supports, or events teachers believe the district or school could do that might further impact their intention to remain in teaching during a crisis. In Phase 1, a survey was administered to teachers who began employment in the studied district in academic years 2018, 2019, 2020, and 2021. In Phase 2, a semi-structured focus group interview was conducted with volunteer participants who had taken the survey to develop a deeper understanding of the patterns observed from the survey responses. While this study was designed to determine the impact of the COVID-19 pandemic on teachers' intentions to remain in teaching, a statistically significant result was not identified. Analysis of Texas Education Agency Commissioner of Education Decisions Regarding Superintendent, Associate Superintendent, School Administrator, Athletic Director and Central Office Administrator Term Contract Nonrenewal Appeals From 1983 to 2013

I conducted a legal analysis of decisions by Texas Commissioners of Education in appeals by Texas school administrators from nonrenewal decisions made by Texas school districts from 1983 to 2013. I analyzed the findings of fact and conclusions of law described in the commissioners’ rulings to determine the legal basis of school districts’ decisions to nonrenew school administrators’ term employment contracts. I also examined the legal rationale for commissioners’ rulings and determined which party most commonly prevailed in these administrative proceedings—the respondent school district or the petitioner school administrator. In particular, the study determined factors that contributed to commissioners’ decisions to overrule or support school districts’ nonrenewal decisions. A careful review of commissioner decisions, which are accessible on the Texas Education Association website, identified 44 commissioner decisions involving appeals by superintendents, associate superintendents, public school administrators, athletic directors, or central office administrators concerning school districts’ term contract nonrenewal decisions from 1983 to 2013. Commissioners’ decisions in these cases were surveyed using legal research methods. Resource Allocation Efficiency at the Elementary and Middle School Levels in a Texas School District

In recent years much attention has gone to school efficiency, as determined by assessing student achievement relative to expenditures at the school district level. The present study built on prior work in school efficiency with a focus on the school campus level instead of the district level. Included in the study were 28 elementary and middle school campuses in a selected school district in Texas. The approach taken in the investigation was data envelopment analysis (DEA), which provided scores for efficiency and was intended to provide clarity on efficiency research at the campus level. Past studies using the DEA model have involved business and private institutions, but not public schools. The DEA model calculated and assigned efficiency scores for each campuses. The two variable categories used to determine campus efficiency were student demographics and resource allocation. The total enrollment numbers included the number of White, economically disadvantaged, at-risk, and limited English proficiency students. The resource allocation variables included the total expenditures in instruction, instructional related services, instructional leadership, campus leadership, and student support services. An Analysis of Litigation against North Carolina Educators and School Districts under the North Carolina Tort Claims Act

This dissertation discussed the impact of the North Carolina Tort Claims Act and the history of governmental immunity that has protected school districts and school employees in North Carolina. The research question addressed was: how have North Carolina state courts interpreted the North Carolina Tort Claims Act in litigation against North Carolina school districts and their employees? The North Carolina Tort Claims Act provided citizens with a vehicle to sue local governmental agencies and their employees, such as school employees. The act also provided immunity for schools, especially for excessive damages in the case of negligence by an employee. The study examined how state courts have responded to different plaintiffs since the passage of the North Carolina Tort Claims Act in 1951. The decisions in the cases analyzed have been mostly favorable to schools, which has strengthened immunity for school employees. There were four legal aspects addressed by the courts after the passage of the North Carolina Tort Claims Act either most frequently or were unique to the case law of North Carolina. The Effectiveness of a Professional Learning Community on Student Achievement in Elementary Reading and Mathematics in a Large Urban School District

The study was to determine the impact of a Professional Learning Community on student achievement as measured by the state's criterion referenced reading and mathematics achievement tests. Data for this study were extracted from the school district's student database. Two cohorts of 90 students each were randomly selected from a population of approximately 600 students in 3 schools that participated in a Professional Learning Community (treatment) and 3 schools that did not (control). Professional Learning Communities known as PLCs, can serve as a major theoretical framework to promote the improvement of classroom teachers' instructional practice, teacher effectiveness and student achievement. Reading and mathemtics mean scale scores were extracted at three time points (year 1, year 2, and year 3) across three grades (grade 3, grade 4 and grade 5). Test for equality of variance found that no statistically significant difference existed between the mean scale scores of the two cohorts at the beginning of the study. The findings revealed that both cohorts trend toward increased academic achievement from year to year individually; however, when compared to each other, no statistically significant difference existed. An Analysis of the Leadership Development Competency Frameworks of Nontraditional Principal Preparation Programs

This study explored the competency frameworks of nontraditional principal preparation programs to determine how they aligned to research-based best practices for school leaders. The research questions that guided this work were: To what degree are the McREL 21 Leadership Responsibilities addressed in the competency frameworks of nontraditional principal preparation programs? How do the leaders of the nontraditional principal preparation programs view the degree to which their competencies include the McREL 21 Leadership Responsibilities? A multi-case study analysis was conducted that compared the competency frameworks of four nontraditional principal preparation programs. The Knowledge is Power Program (KIPP), New Leaders, New York City Leadership Academy (NYCLA), and Teaching Trust were the nontraditional programs selected for this study. Leaders from the four organizations were interviewed. The findings from the research illustrated that a majority of the McREL 21 Leadership Responsibilities were included in the competency frameworks of nontraditional principal preparation programs. The study revealed that four of the McREL 21 were not included in any of the competency frameworks. Another finding was the lack of focus on talent management and personal dispositions in the McREL 21 Leadership Responsibilities. Socially Just Principals' Pursuit of Cultural Proficiency

The purpose of this research was to explore how the personal and professional experiences of school leaders strengthened or hindered their ability to engage in social justice leadership to advance educational equity and encourage culturally proficient practices in their schools. I employed a descriptive multi-case study and the research was viewed through a conceptual framework that included social justice, equity, and the five elements of cultural proficiency. Five principals from three different school districts were selected as participants. They represented elementary, middle and high schools. Interviews consisted of semi-structured face to face interviews with each principal participant and one focus group interview with five participants. Each participant also provided a cultural autobiography. Findings revealed while principals may care deeply about providing equitable opportunities for students, the interest does not supplement knowledge, skills, experience, and support. The information gained from this study can inform the practice of school leaders, and the way in which districts and programs of educational leadership prepare school leaders to serve and address the needs of all students as public schools become more culturally diverse.

School Board Presidents' Perception of Their Role and Its Relationship to Effective Board Practices

The purpose of this study was threefold: (a) to identify the priorities that Texas school board presidents perceive to be most important in their role as a school board member; (b) to describe the specific activities, behaviors, and actions that Texas school board presidents say they take to support the priorities they identify; and (c) to compare with and contrast board members' reported priorities, activities, behaviors, and actions with the eight characteristics of effective school board practices. A mixed-methods research design was used to explore school board presidents' perceptions of their role and its relationship to effective board practices. Quantitative data were gathered using an online survey and analyzed using descriptive statistics. Qualitative data were obtained from one-on-one semi-structured interviews which were manually coded using a three-step, hybrid-coding process, as well as from an observation protocol. Evidence from this study identified four top priorities: accountability driven actions, a untied team with the superintendent, aligned and sustained resources, and a vision of high expectations. Eleven subthemes emerged that describe the activities, behaviors, and beliefs that support these priorities including: clear goals, community partnerships, data-driven informed, governance, human capital, policy adoption, professional development, strong communication, student outcomes, training, and trust.

A Legal Analysis of Litigation against Louisiana Educators and School Districts, Before and After the Louisiana Governmental Claims Act

This dissertation analyzed court decisions in injuries on school grounds cases under the Louisiana Governmental Claims Act. The question addressed was: How have the Louisiana courts interpreted the Louisiana Governmental Claims Act in litigation against Louisiana school districts and their employees? The intent of this study was to show how Louisiana's legal system has evolved, and how that evolution affected tort cases involving school boards and school board employees. Doctrinal legal research was the methodology used to answer the research question. To limit the number of cases analyzed, this study only focused on tort claims involving injury on school property. In order to gain a broad perspective, tort claims cases filed prior to the 1974 Louisiana Constitution, cases filed after the 1974 Louisiana Constitution, and cases filed after the 1995 Louisiana Liability Limits Amendment, and the Louisiana Governmental Claims Act of 1996 were analyzed. By analyzing the tort claims brought against Louisiana school districts and employees during the various time-periods, it was clear to see how the case rulings reflected the frequent changes of the Louisiana Constitution and its' laws. In the end, the state continued to control who could sue them and how much they would pay in damages.

The purpose of this qualitative case study was to examine the systems in place to build the capacity of elementary instructional coaches in a fast-growth district. Through syntheses of research from educational scholars, the conceptual framework was developed with a focus on building capacity of instructional coaches in an ever-changing environment of fast-growth through the lens of professional learning communities, human and social capital, and support from district and campus administration. This study assessed the perceptions of six instructional coaches, six principals, and six district leaders from Rose ISD regarding the school district's support for building the capacity of instructional coaches within the elementary instructional coaching program. The three-part data collection process included document analysis, in-depth interviews, and focus group interviews to support triangulation of data. Through the a priori coding process, the following four themes emerged that highlight key components needed to support district leaders in establishing systems to build the capacity of instructional coaches in an ever-changing environment caused by fast growth: structured time for professional learning, program clarity, collaborative support systems, and implementation of a professional learning community framework. Culturally Relevant Recruitment and Hiring in an Urban District

This qualitative case study examined the recruitment and hiring practices of an urban district. Participants in this study included five district-level, human resource staff members and six campus principals. Data collected and analyzed including audio recordings of semi-structured interviews of each participant and documents at the district and campus levels used during the recruitment and hiring processes. The findings suggested that there is evidence of the district's use of the fit theory and culturally relevant pedagogy, and there is potential value in uniting and using both theories to identify and hire culturally responsive teachers. Findings also suggested that some tenets of both theories overlap, and some were more evident and more valued in the district processes than others. Since urban schools tend to experience significant staffing challenges and require teachers who are more culturally responsive, this study has the potential to help district and campus leaders examine their current hiring practices and establish stronger connections to the fit theory and culturally relevant pedagogy tenets.

Professional Learning Communities: A Comparative Case Study of Shared Personal Practice

Effective instructional practice has a significant impact on student learning. Shared personal practice within a professional learning team (PLT) is one of the key elements in consistently improved instructional practice. However, this PLT characteristic is often the least evident and the hardest to absorb into PLT culture. This study examined the relational characteristics, facilitating factors, or barriers to shared personal practice within a PLT. Two PLTs in core subject areas across two Texas high school campuses were included in this comparative case study. Data from document analysis, PLC observations, focus group interviews, and in-depth individual interviews were examined thematically to answer the research questions guiding this study. The results of this study revealed that building strong relationships and an emphasis on collective creativity were strong predictors of sharing personal practice. Collective clarity on PLT practices and the purpose of sharing personal practice increased the success and occurrence of sharing personal practice. The results also revealed that the copious tasks of teaching and negative perceptions of being observed by colleagues hindered consistent sharing of personal practice. This study describes the current context of shared personal practice as a foundation for future studies to examine how practice can be transformed.

Determinants of Principal Pay in the State of Texas

The purpose of the study was to examine district, campus, and community determinants of principal’s salaries using a spatial econometric framework. Among the district variables business tax (p = 0.001), property tax (p < .01), and the Herfindahl Index (measure of competition) were statistically significant indicators of principal salaries. The results suggest that more affluent districts tend to pay principals higher salaries, which was expected. Regarding campus characteristics, the percent of economically disadvantaged was not a statistically sound indicator (p = 0.468), but campus enrollment was significant (p = <.01). Interestingly as the percentage of economically disadvantaged students increased, the principal salary decreased. In contrast, as student enrollment increases the salary of principals increases, suggesting that principals of larger campuses earn higher salaries. Interestingly, student achievement was not a statistically significant predictor of principals’ salary given that pay for performance in Texas is at the forefront of political debate. Among the variables examined at the community level, only the percentage of homes owner occupied (p = 0.002) was found to be a statistically significant indicator of principal salary (p = .002). School System Improvement through Building Leadership, Adult Learning, and Capacity: A Consideration of Instructional Rounds as a Systemic Improvement Practice

The problem of the study was determining the supportive conditions related to instructional rounds (rounds) to understand better what conditions may allow for sustained systemic improvement over time. Three Texas school districts were studied to understand the perceptions of district leaders, principals, teacher leaders, and teachers with regard to the sustainability of instructional rounds as a systemic improvement practice, the supportive conditions necessary for sustainability, the salient characteristics that differentiated rounds from other improvement practices, and the potential of rounds to build organizational capacity. Observation of network rounds visits and document analysis was conducted to determine alignment of perception with observation and documents. Findings include perceptions, themes, and critical factors for the sustainability of rounds as an effective systemic improvement practice. Supportive conditions emerged as the most significant perception expressed by the participants. Implications for action for school districts beginning or continuing implementation of instructional rounds are suggested based upon findings from participant perceptions and observation of networks. Suggestions for future research are shared. With supportive conditions in place, instructional rounds has the potential to serve as an effective systemic improvement practice.

The problem for this study was the need to increase and maintain in student achievement in charter schools. The purpose of this single-case study was to discover how an inner city charter school with a high percentage of at-risk students increased overall student achievement and attained acceptable performance status when faced simultaneously with administrative challenges and increases in state and federal standards. The participants for the single-case study included the school district’s superintendent, the high school principal, the dean of students, four faculty of the district, and one outside consultant appointed to work with the district by the state of Texas. The sampling for this study allowed for the opportunity to study in greater depth the choice of reform strategies and organizational structure designed to result in increased student achievement and student success over the course of two years. Since this was a single-case study of one charter school district, participants were referenced by the role in which they served. All district, campus, and participant names remained anonymous. The results showed the increased student achievement was made possible by several reform strategies and best practices. Overwhelming evidence supports the fact that music instruction greatly increases academic achievement on standardized test scores at the elementary, middle and high school level. When school districts face budget deficits, typically they alleviate the shortfall by eliminating music programs. Currently in Dallas ISD, teacher salaries are affected by how well a student performs on the STAAR exam. In this quantitative, causal-comparative study, 5th grade music STAAR mathematics scores are investigated to discover if instrumental music instruction using the Little Kids Rock Modern Band method improves academic achievement on the STAAR exam.

The purpose of this descriptive case study was to examine the role of the central office staff and the strategies used to support capacity building in elementary principals in a rapid growth district. By synthesizing research and models from education reform scholars, the conceptual framework of professional capital, intrinsic motivation, the educational change process, and professional learning communities was generated to advance the understanding of utilizing PLCs as a foundation for central office to initiate and sustain continuous improvement in a rapid growth district. The Professional Learning Community Assessment - District Support developed by Olivier, Huffman, and Cowan was administered to 126 participants within the curriculum and instruction department and three elementary schools to collect data to analyze the five dimensions of PLCs within the school district. Eleven interviews were conducted with members of the curriculum and instruction department and elementary principals. According to the eleven interviewees, and PLCA-DS, six themes emerged to support the role of capacity building in elementary principals using the PLC model as a framework. School and Community Partnerships: Effect on At-risk Elementary Student Populations

The purpose of this study was to investigate the current practices of school and community partnerships in five North Texas elementary schools. In addition, the study focused on the influence community partnerships have on at-risk students based on at-risk indicators data. The literature revealed that when schools, parents, and families work together, students tend to earn higher grades, attend school more regularly, stay in school longer, and enrolled in coursework beyond high school. The target population included approximately 350 administrators, teachers, and paraprofessionals from five North Texas elementary schools. Also included were the respective partners from each of the five elementary schools. This research included online survey instrument and data were gathered and analyzed through a combination of statistical procedures and descriptive and inferential statistics. The results may provide other schools with a profile of school and community partnerships that can be implemented as a method to help their at-risk student populations. Findings included a descriptive analysis of factors that contributed to the success of community engagement efforts as well as those factors that limited those efforts. Little, if any, research exists that provides guidance for educators on the use of a dynamic assessment as a tool for better identifying Latinx students for gifted programs. The purpose of this qualitative case study was to explore the perceptions of campus principals and elementary teachers as dynamic assessment was being considered as part of the gifted and talented identification protocol. Data were collected through teacher and principal interviews and focus groups, along with an analysis of current practices and protocols within the studied district. The findings revealed several key themes that emerged from educator perspectives on the ability of emergent bilingual students to be placed in gifted programs and how dynamic assessment could or could not play a part in the assessment process. Using Data Envelopment Analysis to Predict the Impact of Socioeconomic Variables on Instructional Spending Efficiency and Student Achievement at the Elementary Level

Public school finance and school accountability are highly contentious subjects. This correlational study illustrates campus level instructional spending efficiency by examining various input and output variables. The study utilizes data envelopment analysis of selected variables to compare elementary campuses and create instructional spending efficiency measures within purposively selected metropolitan educational service regions in Texas. The study analyzes elementary school instructional spending and student classification as economically disadvantaged compared to student achievement in English language arts. The study finds a direct relationship between instructional spending efficiency and student achievement. The relationship between the socioeconomic variable of economically disadvantaged status is inverse. This finding suggests that in depth examinations of highly inefficient, but relatively high academic performing cases, may uncover effective instructional or operational practices tailored to the needs of the sub-populations.

Job Satisfaction, Organizational Commitment, and Turnover Intention of Teachers Using Computer-Based Curriculum Delivery in a Drop-Out Recovery High School

This current study examined the job satisfaction and turnover intention of teachers working in a drop out recovery program using online curriculum. The subjects of the study were from one charter school district in north Texas that is designated as a drop out recovery program. This qualitative case study used interviews and focus groups to examine eight different areas of teacher job satisfaction to examine factors that influence a teacher's intent to quit or remain at a school. Previous research showed a connection between job satisfaction levels and the intent of a teacher to terminate employment or not. Previous research had not looked into this specific school environment. Results showed that compensation was the largest factor in job satisfaction but negative feelings could be overcome if other areas of importance for teachers brought positive job satisfaction. Overall, teachers in this environment were more likely to have high job satisfaction and less likely to terminate employment.
