Navy-Marine Corps Amphibious and Maritime Prepositioning Ship Programs: Background and Oversight Issues for Congress

The Navy is proposing to maintain in coming years a Navy with 31 amphibious ships and an additional squadron of 14 Maritime Prepositioning Force (Future), or MPF(F), ships. The squadron is intended to implement a new concept called sea basing, under which forces would be staged at sea and used to conduct expeditionary operations ashore with little or no reliance on nearby land bases. Potential oversight issues for Congress include the amphibious-ship force-level goal, the potential affordability and cost-effectiveness of the sea basing concept, and Navy and Marine Corps coordination with other services in developing the concept.

The Cost of Iraq, Afghanistan, and Other Global War on Terror Operations Since 9/11

With the passing of FY2006 supplemental bill H.R. 4939, Congress will have appropriated a total of about $437 billion for the three military operations initiated since the 9/11 attacks: Operation Enduring Freedom (OEF) covering Afghanistan and other Global War on Terror (GWOT) operations, Operation Noble Eagle (ONE) providing enhanced security at military bases, and Operation Iraqi Freedom (OIF), Iraq. On a monthly basis, the Department of Defense (DOD) spent an average of about $6.4 billion for OIF, $1.3 billion for OEF, and $180 million for enhanced base security in FY2005. Potential oversight issues for Congress include getting estimates of the cost to repair and replae war-worn equipment and of possible offsetting costs to DOD's regular budget because equipment is being fixed or bought earlier than planned. DOD's annual war funding may reach $118 billion in FY2006 if the pending supplemental is enacted.

Congress may also want to look at ways to improve war reporting and to evaluate DOD policy and contracting decisions that affect certain types of war support costs.

Awards of Attorneys' Fees by Federal Courts and Federal Agencies

In the United States, the general rule, which derives from common law, is that each side in a legal proceeding pays for its own attorney. There are many exceptions, however, in which federal courts, and occasionally federal agencies, may order the losing party to pay the attorneys’ fees of the prevailing party. The major common law exception authorizes federal courts (not agencies) to order a losing party that acts in bad faith to pay the prevailing party’s fees. This report discusses the Equal Access to Justice Act (EAJA), which makes the United States liable for attorneys’ fees of up to $125 per hour in many court cases and administrative proceedings that it loses (and some that it wins) and fails to prove that its position was substantially justified.
