War Powers Resolution: Presidential Compliance

Two separate but closely related issues confront Congress each time the President introduces armed forces into a situation abroad that conceivably could lead to their involvement in hostilities. One issue concerns the division of war powers between the President and Congress, whether the use of armed forces falls within the purview of the congressional power to declare war and the War Powers Resolution. The other issue is whether or not Congress concurs in the wisdom of the action. A longer-term issue is whether the War Powers Resolution is an appropriate and effective means of assuring congressional participation in actions that might get the United States involved in war.

The Earthquake in South Asia: Humanitarian Assistance and Relief Operations

The powerful earthquake struck northern Pakistan and India damaged the homes of as many as three million people, forcing many of them to search for alternative means of shelter. The full extent of the destruction remains unknown because government authorities and relief organizations continue to have difficulty accessing some remote locations. As of the date of this report, the United States government (USG) has pledged $410 million toward the relief effort, almost all of it to assisting Pakistan, which remains a key U.S. ally in the war against terror. So far, about 35% of this pledge has been committed. Some aid agencies are saying that the country needs a great deal more aid than it is getting, and warn that the economic impact of the disaster will surpass $5.2 billion. This burden may contribute toward long-term instability in an area perceived to be of critical importance to the United States in the war on terror.

Afghanistan: Current Issues and U.S. Policy Concerns

The United States and its allies are helping Afghanistan emerge from more than 22 years of warfare, although substantial risk to Afghan stability remains. Before the U.S. military campaign against the orthodox Islamist Taliban movement began on October 7, 2001, Afghanistan had been mired in conflict since the Soviet invasion of Afghanistan in 1979. The defeat of the Taliban has enabled the United States and its coalition partners to send forces throughout Afghanistan to search for Taliban and Al Qaeda fighters and leaders that remain at large, including Osama bin Laden. As the war against remaining Al Qaeda and Taliban elements winds down, the United States is shifting its military focus toward stabilizing the interim government, including training a new Afghan national army, and supporting the international security force (ISAF) that is helping the new government provide security.

This report provides an overview of federal and state public health laws as they relate to the quarantine and isolation of individuals, a discussion of constitutional issues that may be raised should individual liberties be restricted in a quarantine situation, and federalism questions that may arise where federal and state authorities overlap. In addition, the possible role of the armed forces in enforcing public health measures is discussed, specifically whether the Posse Comitatus Act would constrain any military role, and other statutory authorities that may be used for the military enforcement of health measures.

Among the current issues in U.S.-Egyptian relations are the shared concerns over the terrorist attacks against Egyptian police, religious, government, and tourist facilities, and what those attacks maysignal for Egypt’s domestic stability. The two nations may disagree over Egypt’s interpretation of applying human rights practices to Islamic terrorists. The two countries disagree over the speed and depth, but not the need for some of Egypt’s economic reforms. Egypt and the United States agree on the importance of the Egyptian-Israeli peace treaty, the need to continue current Arab-Israel peace talks, and the need for regional stability. The two nations agree on Egypt’s determination to introduce democratic reforms to Egypt.
